Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project, The Director reports his decision to the City Council and Planning Commission in time to allow an appeal. of the decision within fourteen calendar days. BACKGROUND: The use permit (6-U-97) for the Oak Valley Subdivision Development requires minor modifications for new accessory structures. The use permit also establishes landscaping requirements and restrictions for private open space areas. No structures are allowed in private open space areas. DISCUSSION: The applicant proposes a pool patio lanai structure and landscape improvements in the rear yard of a single-family residence in Oak Valley. The lanai structure will be attached to the existing residence, and therefore, must meet the setbacks of the main residence. The lanai is approximately 18.5 feet long, 11.5 feet wide, and 10 feet talL and is within the setbacks of the residence. The property has a 30-footwide private open space easement at the rear. The existing II play area," located within the private open space area, is a structure, and shall be removed or relocated. Adjacent homeowners will be notified of this action. Action Taken: The Director approves DIR-2005-19 with the following condition: The play structure shall be removed or relocated to a conforming location.
