Subject: Director's Minor Modification for a twenty-four month extension of the
approved ozone injection and soil vapor extraction treatment system at an
existing gasoline station located at 19S50 Stevens Creek Boulevard
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
. of the decision within fourteen calendar days.
DISCUSSION:
The applicant SECOR proposes a twenty-four month extension for the approved ozone
injection and soil vapor extraction treatment system installed at an existing gas station.
The original Director's Minor Modification was approved on September 21, 2004 and
expired on AprilS, 200S. The extension is necessary due to technical problems at the
site.
The system is designed to oxidize and remove soil and ground water
contaminants/volatile organic compounds from leaky underground storage tanks. This
is to satisfy the requirements of the Santa Clara Valley Water District (SCVWD). The
project site is located at the southwest corner of Stevens Creek Blvd. and Miller Ave.
The treatment system is temporary and will be there for no more than twenty-four
months. Once the remediation process is completet the SCVWD will certify that the site
is cleaned and the equipment will be removed permanently. An eight-foot tall chain
link fence encloses the equipment located at the southeast corner of the property.
Planter boxes with shrubs have also been placed on each side of the enclosure to help
screen the equipment.
ACTION:
The Director approves the applicationt file no. DIR-2005-11, with the following
conditions:
1) The Director of Community Development deems the modification minor and
approves the twenty-four month extension for the ozone injection and soil vapor
extraction treatment system based on the attached plan set titled: "Ozone
Injection and Soil Vapor Extraction Treatment System, 76 Station (Former BP)
No. 11220, 19550 Stevens Creek Blvd., Cupertino, CAli consisting 10 sheets dated
May 5t 2004 unless as amended by the conditions of approval of this project.
2) This approval of the modification is effective May 25, 2005. The 14-calendar day
appeal period will expire on June 8, 2005.
3) The ozone injection and soil vapor extraction treatment system shall be removed
after twenty-four months from the time of the approval (May 25, 2007). If
additional time is required, a new director's minor modification shall be obtained
from the Planning Department.
4) The project shall be consistent with the recommended noise mitigation measures
specified in the Noise Assessment and Mitigation Study prepared by Stanton
Shelly dated September 2, 2004. A letter from the noise consultant shall be
submitted to the planning department confirming noise compliance.
