Subject: DIR-2005-06 Director's Minor Modification of a use permit (14-U-82) for
demolition of Building CAC41 and landscaping and exterior building
modifications
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
BACKGROUND
Hewlett-Packard proposes to demolish a 135t936 square foot building. The building's
former manufacturing and warehouse functions are no longer needed by the company.
The proposal also involves retaining the demolished materials on site, landscaping the
area affected by the demolitiont and refacing the exteriors of adjacent buildings.
DISCUSSION:
Square Footage
As shown on the enclosed Site Area Tabulation sheett the total square footage on the
Hewlett-Packard campus is 1,509,258 gross square feet. Square footage after demolition
will be 1,373,322 square feet. Hewlett-Packard has a development agreement with the
City that vests the land use policies established in the 1993 General Plan for permitted
usest densityt intensity of use, range of heights and sizes of proposed buildings. The
Development Agreement expires in 2015, so Hewlett-Packard has the right to rebuild
this square footage during the term of the agreement.
Site Plan
The location of Building 41 in relation to the overall Hewlett-Packard campus is shown
on Exhibit A. The applicant states that the building is 390 feet from the property line
along Homestead Road and a minimum of 530 feet from the property line along

Pruneridge A venue. The building is flanked by Building 42 to the west and Building 43
to the east. Access to the site is from Pruneridge Avenue and Wolfe Road. After
demolitiont the area will consist of an approximately 25,000 square foot footprint of
recycled materials surrounded by an 85-110 foot wide hydro-seeded and landscaped
area. The recycled materials will be six to 6.5 feet high above the lowest adjacent grade.
A vinyl-clad, chain-link fence will surround three sides of the hydro-seeded area; the
fourth side is the face of Building 42. In addition, 4.5-foot high, landscaped berms will
be on both the north and south sides of the demolition area. Walkways will be
provided on the north and south sides of the area to provide access between Buildings
42 and 43.
Visual Impacts
There are virtually no negative visual impacts created by the project. Three-foot high
shrubs on top of the berms will obstruct any views into the site from the north and
south directions. There will be limited views from the east side of the project because
the existing building directly abuts the project area, with no doors or windows. The
west side faces the loading dock of an existing building; the only windows facing the
area are on a second story hallway. The cyclone fence will be vine covered. The berms
and the buildings prevent any views of the project from off-site. Exhibit B shows a
viewline through the fill area.
Landscaping
Tree removal is proposed on both the north and south elevations to accommodate the
construction of the berms. Severalliquidambar trees will be removed along the north
elevation, and a row of small crape myrtle trees will be removed along the south
elevation. Shrubs and ground cover will be planted, but no trees will be planted at this
time due to the potential for rebuilding in the future. New landscaping is both drought
tolerant and pest resistant.
Noise Impacts
Demolition and recycling activities will create the need for noise control. The following
mitigation measures are proposed to reduce noise:
. Construction trucks will access the site from Lawrence to Pruneridge Drive, so
they have minimum impacts on residential areas. The existing north wall of
Building 41 will be temporarily braced during demolition to provide a sound
baffle for neighbors to the north, and will come down at the end of demolition.
. Demolition will occur mostly during regular working hours, so neighboring
properties will not be affected by nighttime noise. Hewlett Packard's concern for
its own employees in adjoining buildings also mandates good noise control.
. Construction noise will need to comply with Cupertino's noise ordinance. Noise
readings will be taken every hour.

Architectural Changes
Portions of the east elevation of Building 42 will be refaced with an aluminum panel
system, since this wall will be exposed with the removal of Building 41 (Exhibit C).
Long-term Use of Project Area
Staff believes that it is in the public interest to limit the amount of time the recycled
materials can remaint in that the City generally discourages the use of sites for
stockpiling materials. Howevert making using of recycled materials for future on-site
uses is consistent with City recycling goals, so a condition of approval allows this use
for a 5-year period.
Community Outreach
In February, Hewlett-Packard sent letters to 816 property owners to inform them of the
project; no responses have been received.
ACTION:
The Director of Community Development approves the application with the following
conditions:
. The recycled materials shall be either used or removed within five years of this
approval. A landscape plan to restore the area shall be approved by staff and
installed three months after the expiration date.
. Noise mitigation shall be consistent with the noise abatement measures as
described in Exhibit C.
This approval of the modification is effective AprilS, 2005. The fourteen-calendar day
appeal period will expire on April 19, 2005.

This letter of explanation comes to you per our previous emails and conversations about
Hewlett Packard Company's desire to demolish existing Building CAC41 at the Cupertino Site.
This building was the first to be erected at the Site, and it's original manufacturing and
warehouse functions no longer playa part in HP's long-term plans for the Site.
It is HP's intention to accomplish the demolition safely and with minimal noise generation; to
landscape the resulting footprint suitably but minimally, consistent with future redevelopment;
and to retain the demolished materials on-site to fold into the Site's future development.
The attached materials are in support of this application for a Minor Modification finding for this
project:
Impact on overall Site Buildina Area:
Please see Page 4 of this letter showing the impact upon overall site building area by the
demolition of Building CAC41.
Construction Activities and Noise Control
(See attached Rudolph and Sletten Noise Abatement History and Plan, and Site Logistic Plan)
1. CAC41 is 390 feet from the H P property line along Homestead Road, and a minimum
530 feet to the property line along Pruneridge Avenue - with even more distance to the
nearest dwellings across the street. Taking advantage of.the extra separation towards
Pruneridge, the demolition will be approached from the south as the Logistic Plan
shows. Additionally, the existing north wall of CAC41 will be temporarily braced during
demolition, coming down only at the end of demolition - in order to provide a sound
baffle for the neighbors to the north.

2 The same contractor (Rudolph and Sletten) who successfully managed noise during the
seismic upgrade of Buildings CAC44 and CAC46 will continue on this project. The
History of their experience on those projects is attached, by way of assurance that they
managed this issue to the City's satisfaction.
3, The attached History also highlights that since CAC44 and CAC46 were occupied during
construction, a noise-sensitive evening-and-weekend work schedule was required. In
contrast the CAC41 demolition will occur primarily during regular working hours, when
noise impacts will be further lessened.
4. HP's concern for its own employees in adjoining buildings also mandates good noise
control.
landsc,ape and Civil treatment
(See attached Sheets L-1 thru 5, and C-1 thru 3)
1. In addition to small-scale landscaping of the former building footprint, both the north and
south frontages will be provided with screening by means of vine growth on vinyl-clad
chain link fences. Note that the east and west are screened by either CAC42 on the
west or a service yard (with new vine-and.fence treatment) and CAC43 on the east.
2,. This screening is further supplemented by planted berms to north and south, whose
plantings soften the view of the site and absorb some of the recyclable material from the
building demolition. The screened views thus created are best illustrated by the site
section found on Sheet L-5.
3. All this treatment serves to screen the ground-up concrete remaining from demolition of
CAC41. HP is intent that this be responsible and sustainable demolition, by recycling or
salvaging as much of the building as practical - including salvage of the wood roof
structure, and grinding of all concrete elements for storage on-site towards future
construction. It's anticipated that this ground-up concrete will be stored within 23% of
the old building footprint - allowing for landscaping of the remaining 77%. Since its
future use for construction would be compromised by plantings or weather-borne debris,
this storage fill will be covered by a weather-tight membrane.
4. The accompanying Civil drawings illustrate the resulting grading and drainage to serve
the old CAC41 footprint. Note that erosilon control measures are also detailed, and
preparation and compliance with a Storm Water Pollution Prevention Plan is
anticipated in our project planning.

Architectural Treatment
The attached elevation "HP 41 Demolition Study" illustrates the metal panel treatment proposed
for cladding of the open face of CAC42 to the west, once CAC41 has been demolished; a
similar treatment will occur at the small end of the single story CAC48 link to the east. The
Bronze Anodized Aluminum color option to match existing will be used, with reveals at modules
consistent with the existing building.
Community Outreach
HP has already issued a mailing to the neighbors in order to introduce the project at the grass-
roots level, and plans for a social gathering to field any resulting questions are in progress at
this time.
I trust that this letter of explanation and the accompanying materials illustrate our intent to your
satisfaction, and that the Minor Modification finding can be speedily accomplished. Please feel
free to call me at any time if revision or supplementary material is needed.
