Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes to a project. The Director reports his decision to the
City Council and Planning Commission in time to allow any Councilmember or
Planning Commissioner to appeal the decision within fourteen calendar days.
Application:
File No. DIR-2005-05: Minor Modification of a use permit (file no. U-2002-05) to
expand a stairwell on the front exterior of an existing building at 10051 Pasadena
Avenue.
The applicant, David Chui, received minor modification approval in 2004 to
relocate the church assembly hall from the first floor to the second floor of the
building. The change to a higher room occupancy on the second floor created
building code exiting issues that could only be addressed by expanding two
existing stairwells to meet current building code requirements. The west side
stairwell could be expanded internally to meet building exiting requirements
without affecting the exterior of the building, but the same could not be done for
the east facing stairwell. The east stairwell occupies a If notchll or recessed
portion of the front elevation. It needs to be pushed out 3 feet 6 inches to achieve
the necessary clearance. Given the configuration of the stairwell, the building
pop-out will start 5 feet above the grade of the sidewalk and run to the second
floor. The visibility of the pop-out will be masked by the mass of the second
floor building deck and the use identical building materials and treatments.
Action:
The Director of Community Development deems the modification
minor and approves the stairwell expansion on the front elevation
of the building per the attached plan set titled If Interior
AlterationlElevator for the Church in Cupertino, 10051 Pasadena
Avet Cupertinot CAlf consisting of 3 sheets dated 2/4/05 and
labeled A-2, A-3 and A-5. The approval is subject to the following
additional condition of approval.
The applicant, the Monta Vista Church in Cupertinot agrees to
abide by the use permit condition (file no. U-2002-05) that requires
the applicant to convert ground floor tenant spaces that front on
Pasadena A venue to a permitted use allowed under the General
Commercial (CG) zoning ordinancet except office uses which are
prohibited. Upon completion of the current remodeling project, the
applicant has 60 days to convert the space into retail or quasi retail
with direct front door access to Pasadena Avenue and an open
store front.
If the applicant is unable to rent it to retail tenants, the church \,\rill
operate such a retail store in order to create a physical retail
presence on Pasadena A venue.
This approval is effective April It 2005. The fourteen calendar
day appeal period will expire on April 25t 2005
