Director's Minor Modification DIR-2006-33 to a use permit (16-U-77) to rebuild
a front deck and entry staircase for a single-family residence in a planned
development zoning district.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION:
The applicant is requesting a Director's Minor Modification DIR-2006-33 to a use permit
(16-U-77) to rebuild a front deck and entry staircase for a single-family home located in
a Planned Development (P) zoning district. Planned Development districts permit
greater flexibility for setbacks than conventional single-family (R-1) zoning districts.
The original use permit approval for the existing buildings included a front yard area
with a retaining wall and staircase built around the existing oak tree. The proposal calls
for a tree well built around the oak tree and the retaining wall and deck are pulled back
behind the tree. The new staircase will encroach in the front yard setback by four feet.
Staff supports the new design for the deck, stairs and tree well.
ACTION:
The Director of Community Development deems the modification minor and approves
the minor site improvements.
This approval of the modification is effective November 6, 2006. The fourteen calendar
day appeal period will expire on November 20, 2006.
