Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DESCRIPTION: The subject property is located at 19220 Stevens Creek Boulevard between Finch Avenue to the west and Tantau Avenue to the east. It shares a rear property line with Cupertino High School. The applicant proposes to enclose an existing open area at the rear of an existing building. . The building is going to be used as a learning school. The applicant plans to enclose the open area to create yard space for use by children during recess. The applicant proposes to do this by installing a four-foot tall decorative fence at the rear of the learning center. DISCUSSION: Since the building is located in the Planned (P) zoning district, any exterior modifications to the site need to be reviewed by the Planning Department. The existing open area is currently covered by ground cover and unusable as a yard since it is open to a driveway at the rear. This driveway has reciprocal ingress egress easements with the properties on either side and runs from Finch A venue to the property to the east of the subject property. Since this driveway is used by all three properties that share it, it will be unsafe to use the open area as a yard without enclosing the area. The applicant plans on changing the landscaping planter to the east to grass. She plans on changing the landscaping planter to the west to grass in the future. The applicant has verbally indicated that there are no plans to add any play structures in this area. Staff has reviewed the plans for these exterior changes and believes that there will be no adverse impacts due to the construction of the fence and change in the landscaping. DIR-2006-32 Page 2 October 19,2006 ACTION: The Director of Community Development deems the modification minor and approves the fence installation based on the attached plan set titled: "Fence Addition Plan" consisting of 3 sheets dated Sep 22, 2006, and labeled 1-3, except as may be amended by the conditions contained hereafter in this approval. This approval of the modification is effective October 19, 2006. The fourteen-calendar day appeal period will expire on November 2, 2006.
