Chapter 19.128 of the Cupertino Municipal Code allows for the Director of Community
Development to grant a temporary use permit for a time period not exceeding
administrative approval of minor changes to a project. The Director reports his decision
to the City Council and Planning Commission in time to allow any Councilmember or
Planning Commissioner to appeal the decision within fourteen calendar days.
Application:
File No. DIR-2006-29: Director's Minor Modification to a use permit (9-U-66) to locate a
demonstration building in a parking lot for a three-year period, 19111 Pruneridge
Avenue.
Hewlett Packard proposes to locate a temporary building on the HP campus to serve as
a demonstration building. Although the building appearance is like a home, the
demonstrated products are not home-related. The size of the building is 1,859 square
feet. It will have minimum visibility from Pruneridge Avenue.
The building will be located in a parking lot that is remote from the office buildings.
This area has been used for a contractor's trailer for several years, and the applicant
reports no adverse parking impacts from this use. The building and landscaping would
utilize approximately 20 - 22 parking spaces.
The applicant subsequently submitted a modification to the application, which would
rotate the building 180 degrees and provide access from the perimeter road (see Exhibit
A). Approval is based on this modification.

Action:
The Director of Community Development approves the modification with the following
conditions:
1. The modification shall expire on October 6, 2009.
2. The building may be rotated as shown in Exhibit A, as long as the adjacent trees
and tree roots are not adversely impacted.
3. The area shall be restored as a parking lot upon expiration of the modification.
This approval of the modification is effective September 22, 2006. The fourteen-day
appeal period will expire on October 6,2006.

Dear Ciddy:
Last April I came to City Hall to discuss relocation of a modular 'home' to Hewlett Packard's
Cupertino Site. This is to be an adjunct to the Site's marketing efforts, providing a home-like
setting for the demonstration of various high-tech devices.
At that time you reviewed my binder of the site and existing home photos with Steve Piasecki,
from which it was agreed that the project would qualify for a Director's Minor Modification. This
was on the basis of the following:
1. The home appears as shown in the attached photo, taken when it was used as a
display at a trade show. It will be in place temporarily at the HP site, to be removed
after a period of about three years.
2. It will be located in a former parking lot about 120 feet from Pruneridge Avenue,
which is substantially screened per the attached site photos. The surface and
grades of the parking lot will be modified to suit the proposed landscape shown. Per
the attached sketches the plantings and hardscape will be residential in scale, in
keeping with the scale and style of the house itself.
3. After removal of the demonstration home, the parking lot will be restored to its former
condition, or (if HP desires) submittal made to the Planning Department for an
alternate treatment.
4. The Home will be accessible per ADA, including a handicap parking stall and
accessible access to the building entries by means of ADA-compliant sidewalks.
5. After granting of the Minor Modification permit, we will submit to the Building
Department for building permit in compliance with applicable codes, prior to
preparation and placement of the Home at this location.
