Chapter 19.128 of the Cupertino Municipal Code allows for the Director of Community
Development to grant a temporary use permit for a time period not exceeding
administrative approval of minor changes to a project. The Director reports his decision
to the City Council and Planning Commission in time to allow any Councilmember or
Planning Commissioner to appeal the decision within fourteen calendar days.
Application:
File No. DIR-2006-28: Director's Minor Modification to an architectural site approval
(1-ASA-95) to remove awnings and change exterior colors and signs at 10225 S. De Anza
Boulevard, northwest corner of S. De Anza Boulevard and Rodrigues Avenue.
This property received architectural approval for awnings in 1995 (see Exhibit A). The
applicant proposes to remove the awnings for the former Petco tenant space, which will
be Vardy's Jewelers, and for the deli space. The awning on the Radio Shack space will
remain until there is a change in the tenant, as required by their lease agreement.
The applicant proposes to repaint the building, which is currently tan, to a combination
of a brown/ olive top-band color with a barn-red lower color (see Exhibits B and C). He
also proposes a new sign program for the building, which was approved by staff on
June 6, 2006, since s~gn programs are approved at staff level (Exhibit D).
Action:
The Director of Community Development approves the modification with the following
conditions:
1. Only the red awning for Radio Shack shall remain, and shall be replaced with a
sign when there is a change in the tenant.

2. The sides of the building facing Rodrigues Avenue shall be painted red without a
top color band. The rear and north side of the building shall be painted
"corduroy" without a top color band.
3. A landscaping plan shall be approved by the Director of Community
Development and shall be installed prior to final occupancy.
This approval of the modification is effective September II, 2006. The fourteen-day
appeal period will expire on September 25, 2006.

. The property located on De Anza Blvd. between Rodriguez Street and Sunrise
Drive. The address is 10211 through 10235 De Anza Blvd.
. The computation ofthe sign area is in accordance with city ordinance 17.24.060.
. The maximum height of the sign is 24" and length is 70% of frontage. The
minimum size of the sign will be not less than 20 square feet.
. The colors of the signs can be in most except neon colors.
. The sign should be individual block letters or script lettering.
. The lighting shall be individually illuminated from behind (halo), channel letters
block or script.
. The signs are going to be located above each corresponding business.
. The material could be metal or plastic, anodized or painted. The finished
appearance will be painted.
