Prepared by: Piu Ghosh, Assistant Planner To: Date: September 25, 2006 Subject: Director's Minor Modification, DIR-2006-26, to an existing two story residential permit (R-2004-42) to change second story setbacks and floor plans for both first and second floors. Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION: The applicant, Eddy Shen, has an existing approval for a 4,145 sq. ft. new two-story home on the subject site. He proposes to modify the approval to a 4,057 sq. ft. two story home by adjusting the approved setbacks. In his original approval, the applicant intended to keep the existing first story setbacks at the rear and at the sides and the existing first story foundation and framing while conforming to the front setback by removing a portion of the existing garage. However, after the approval, the setbacks shown on the original approval were found to be different from the actual setbacks on site. Due to the changes in setbacks, 'the applicant has made slight modifications to the first story floor plans. The applicant is also revising second story setbacks and consequently, the second story floor plan due to the changes to the first floor setbacks. These changes to the setbacks and the floor plans have resulted in minor changes to the elevations of the building. The table on the following page summarizes the approved and proposed setbacks and the resulting impacts from these changes. The table above shows that the changes being proposed are minor. There are no impacts . to neighbors from the first story setbacks since these are existing setbacks. The proposed second story side setbacks are larger at the sides and are likely to impact the neighbors less than the previously approved setbacks. The second story front setback has been reduced by three feet; however, the front neighbor is approximately 105 feet away and it is unlikely that they shall be adversely affected by this change. All. of the original conditions from the two-story approval (R-2004-42) are still applicable, including the requirement of privacy protection trees and covenant. ACTION: The Director of Community Development deems the modification to be minor and approves the modification with the following condition: 1. The type, species and size of the existing trees for use as privacy protection trees shall be included in the building permit. This approval of the modification is effective September 25,2006. The fourteen-calendar day appeal period will expire on October 9, 2006.
