Subject: Director's Minor Modification (DIR-2006-25) for a modification to a use permit
(9-U-83) for the Seven Springs Development for a 224 square foot second story
addition to an existing 2,934 square foot residence at 11596 Cedar Spring Ct.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION:
This is a Planned Residential Development P(Res). The conditions of approval to the
use permit state that if the applicant receives approval from the ArchitectUral Control
Committee/Board of the homeowners association, a change to the existing floor plans is
possible with approval from the Director of Community Development. The applicant
has received approval from the Architectural Control Board (See Exhibit A).
The proposed development has no adverse impacts on surrounding neighbors. The
proposed addition is to add 66 square feet to the front of the existing second story of the
house and a 158 square foot addition to the rear of the existing second story. These
changes allow for the addition of.a study and a new bathroom on the second floor. The
applicant is also proposing to change the existing kitchen window to be a bay window.
The applicant initially wanted to add a bedroom to the house. However, research
indicates that as a condition of approval of the zoning application (25-Z-80), the
development was restricted to a maximum of 1,360 bedrooms. If the development
wanted to exceed the maximum, a newall-day trip generation study will need to be
done to determine that the development does not exceed 3,860 trips in one day.
The floor plans for the homes within the development, at the time it was approved,
designated certain rooms as dens, although they can easily function as bedrooms. If
these rooms are factored into the total bedroom count of the development, it far exceeds
the maximum of 1,360. Therefore, this approval requires that the study shall not be used
as a bedroom. The applicant agreed to change the room to be an open study room.

The floor area ratio (F.A.R.) of the existing house is 47%. With these changes the F.A.R.
of fb.e house increases to 50.5%. The lot coverage does not change with these proposed
changes. The ratio of the second story to the first story changes from 53.8% to 65.6%.
However, since this is a planned development, it is not uncommon for residences in this
zone to exceed the F.A.R.s and the second story to first story ratios of the single-family
residential zones.
APPROVAL:
The Director of Community Development deems the modification minor and approves
the plans subject to the following condition:
1. The applicant shall record an appropriate deed restriction and covenant running
with the land, subject to approval of the City Attorney, which restricts the
property owners from further enclosing the second floor study room in the
future and also prohibits the use of the room as a bedroom.

STEP 1 REQUIREMENTS
1. ../ OWNER to complete and submit a "Request to Generate Architectural Impact Review Report
form.
2. ..,/' OWNER to submit two set of scaled and detailed drawings of the proposed addition together with
the original drawings of the structure, including floor plans, sections, elevations, property lines, easements,
a layout of existing setbacks and a grade and/or drainage plan.
3. ./ OWNER to submit a check in the amount of $ 100.00 made payable to the Management Company.
This is a processing fee.
4. / OWNER to submit a check in the amount of $500.00 made payable to the Association Architect
(Please call Management Company for name of appointed architect).

STEP 2 REQUIREMENTS
Upon receipt of the Architectural Impact Review Report:

2. ..LManagement Company will publish a notice of the proposed change in the Newsletter.
3. ..........Management Company will place the proposed change on the Agenda for the Board of Director's
meeting so that members may discuss the application and voice their concerns or support of the proposed
change/addition.

their office and make them available for inspection by owners for review during normal business hours.

contractor, along with a schedule of values for the intended work.
3. OWNER to submit evidence of Liability Insurance from the contractors, naming the Association as
one of the insured.
4. OWNER to submit a statement of the intended construction period (start date and completion date).
5. = OWNER to provide and submit a signed agreement allowing the Association and/or its
representatives to inspect the modification during construction and after completion for conformance to the
approved plan and City requirements.
6. _ OWNER to provide and submit a signed "Construction Restriction and Rules" agreeing to the
listed allowable construction hours and time limits for trash and debris removal.
7. _ OWNER to submit a check equal to 10% of the estimated construction cost as a "performance
bond" payable to: Seven Springs Owners Association. The deposit will earn interest at prevailing checking
account interest rates during the period it is held by the Association.
