29-U-74 to allow the enclosure of a second-story balcony on an existing single-family
residence at 10358 Heney Creek Place.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes to a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application:
File No. DIR-2006-24: Director's Minor Modification of a use permit file no. 29-U-74
to allow the enclosure of a second-story balcony on an existing single-family residence at
10358 Heney Creek Place.
The applicant, Eric Lai, is proposing to enclosed a 67 square foot, second-story balcony to
provide a walk-in closet. The zoning is peRl 0-2) Planned Development with sing1e-
family residential intent and a density of 0-2 dwellings per acre. With the addition, the
building area will increase to 4,006 square feet, which will be 40.4 % floor-to-area ratio.
The enclosure is architectural integrated with the house and will use the same building
finishes. There are no new second-story windows that might have a privacy impact.
Action:
The Director of Community Development deems the modification minor and approves
the balcony enclosure per the attached plan set titled "Closet AdditionlLai
Residencell0358 Heney Creek Place/ Cupertino, California 95014" consisting of one
sheet dated 3/27/06 and labeled 1.
This approval of the modification is effective September 7,2006. The fourteen calendar
day appeal period will expire on September 21,2006.
