Subject: Director's Minor Modification DIR-2006-12 to a use permit (1-U-95) for a new
patio, trellis and trash enclosure at an existing retail center located at 22390
Homestead Road.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION:
The applicant proposes to: 1) relocate an existing trash enclosure, 2) add a new trellis
and outdoor patio seating area to an existing building to be occupied by Starbucks
Coffee. The proposed area of work is away from public views from Homestead Road.
Staff supports the exterior and site improvements.
ACTION:
The Director of Community Development deems the modification minor and approves
the canopy and building repainting, and the sign changes with the following
conditions:
1. The approval is based on the attached plan set titled: "Starbucks - Homestead
Retail, 22390 & 2300 Homestead Road, Cupertino, CA" consisting of 2 sheets
dated April 12, 2006, and labeled L1 & L2, except as may be amended by the
conditions contained hereafter in this approval.
2. A revised landscaping plan shall be reviewed and approved by the Planning
Department prior to the issuance of building permits. The landscaping plan shall
show sufficient landscaping screening around the new trash enclosure and
outdoor seating area to the satisfaction of the Director of Community
Development.

3. A revised trash enclosure plans shall be reviewed and approved by the Planning
Department prior to the issuance of building permits. The new trash enclosure
roof cover shall be revised to the satisfaction of the Director of Community
Development. The revisions shall include but not be limited to the following,
deletion of the roof fascia & additional architectural embellishments to the roof
cover.
4. The trash enclosure shall adhere to the conditions set forth by the Public Works
Department based on a Memorandum dated April 24, 2006.
This approval of the modification is effective April 25, 2006. The fourteen calendar day
appeal period will expire on May 9, 2006.
