De Anza Circle within an RI-7.5 zoning district. Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. BACKGROUND: On July 17, 2003, the applicant, Marshall Maple, received approval of a Director's Minor Modification (DIR-2003-07) for a 262 square foot, single-story addition to an existing single-family residence located at 22285 S. De Anza Circle. However, the applicant did not construct the addition and the approval expired. On March 31,2006, the applicant submitted revised plans for an expanded addition to the existing residence than previously approved. As a result, a new Director's Minor Modification application was submitted for a proposed 500 square foot single-story addition. The subject property is zoned RI-7.5; however, the residence was originally developed as part of a cluster subdivision of residences with smaller building setbacks than would normally be found in the RI-7.5 zoning district that were approved through variances. The variance (I-V-65) that is applicable to this property allows the "City Planner" to approve minor changes to residences without going through another variance process. The variance condition states: "In the event that the applicant shall desire to make any change, alteration, or amendment in the approved Development Plan after they had been approved by the City Council as a condition to a Variance, a written request and a revised Development Plan shall be submitted to the City Planner. G:\ Planning \ PDREPORT\ DIRreports \ 2006 \ DIR-2006-10.doc DIR-2006-10 Page 2 June 8, 2006 -- .,' If the number of dwelling units is not increased, and the City Planner makes a finding that the changes are minor and do not affect the general appearance of the area or the interests of owners of property within or adjoining the Development Area, the City Planner may certify the change on the revised plan. If such approval is withheld, the applicant may appeal to the Planning Commission. . . II DISCUSSION: The proposed 500 square foot single-story addition consists of a 275 square foot addition on the east side to accommodate an expanded family room, an 88 square foot addition along the front (south side) for an expanded den, and a 137 square foot addition at the rear (north side) for an expanded master bedroom and new bathroom. The existing residence was constructed with smaller building setbacks than normally found in the RI-7.5 zoning district only along the front and west side yard areas. The existing front yard setback is 13.5 feet and the existing west side yard setback is 3.5 feet. The proposed addition along the front elevation merely fills in a gap within the frontage and will still maintain the existing front yard setback. No addition is proposed along the west side yard that will affect the existing setback. The existing rear yard setback ranges between 17.5 feet at a minimum to approximately 45 feet to a maximum. The addition at the rear of the residence is proposed 'at a minimum of 10 feet; however, this addition is minimal in length and is consistent with the current Rl ordinance that allows a minimum 10 foot rear yard setback if, after the reduction, the useable rear yard area is not less than 20 times the lot width. .The proposed addition within the rear yard area will maintain a useable rear yard area that exceeds the minimum requirements by approximately 750 square feet. The addition along the east side yard will maintain an approximately 12 foot setback that is consistent with the Rl ordinance. The addition will bring the total square footage of the residence (including attached garage) to 3,260.5 square feet and the total Floor Area Ratio and lot coverage to 39.6%. This complies with the Rl requirements that allow an FAR and lot coverage of up to 45%. The exterior of the residence will consist of stucco and will be painted to match the existing residence. Additionally, a new gabled entry feature, a gabled architectural enhancement and base trim will be added along the front of the residence facing S. De Anza Circle to provide some architectural relief and enhancements to the elevation. The City Arborist's report verified the existence of an oak tree on the property along the east property line. The report indicates that if the existing fence between the subject property and the adjacent property to the east is left intact, there should be no harm to this tree. The applicant is not proposing to remove any trees as a part of this DIR-2006-10 Page 3 June 8, 2006 .... application. Conditions of approval per the arborist's recommendations have been added to ensure protection of the existing trees on site. ACTION: The Director of Community Development deems the modification minor and approves the minor site improvements with the following conditions of approval: 1. The existing retaining wall along the north side of the property shall be retained to protect the root systems of the neighbor's trees. 2. Protective fencing shall be installed around the camphor tree (tree #9) prior to construction and be retained until the completion of construction, per the arborist's tree assessment report. 3. No excavation may occur within 10 feet of the trunks of the oak tree (tree #5) to prevent damage to the root system of that tree. A pedestrian path of 2.5 feet in width may be allowed adjacent to the house near the oak tree; however, no equipment shall be allowed in the area beneath the tree. 4. Protective fencing shall be installed around the blue spruce tree (#6) prior to construction and be retained until completion of construction, per the arborist's tree assessment report. Coate Consulting Arborist May 5, 2006 Job #05-06-094 AN INVENTORY OF TREES AT TH~PLE PROPERTY 22285 S. DE ANZA CIRCLE, CUPERTINO - Assignment I was asked to review the trees on the property before remodeling begins. This review is based on a plan titled "The Maple Residence" new site plan by an unnamed professional and undated sheet A-part 2. Summary The site plan has a list of ten plants on it some of which appear on the site and some of which are gone. Many of the plants that are on the list are not large enough to be controlled by City of Cupertino ordinances however. For this reason I will only address those that are large enough to be of concern to the City. Several trees on the adjoining property could be affected by activity on the Maple property. They are identified by letter A - D to avoid confusion with trees on the Maple property. Protection of the camphor tree #9 and oak #5 should be relatively simple if the fences prescribed here are installed and maintained. Summary Only trees #5 and 9 are large enough to be of concern to the City, however there are trees on the adjacent property to the north which could be affected by the construction on this property if the retainer wall near the back property line is removed. In addition a large tree was apparently removed in the area in which the addition will be made on the northwest comer of the property. I am told the owners were told the tree was diseased and dying and for that reason it was removed. That tree is #D in the following report. Specific Comments Tree #1 is a sizable mayten tree (May tenus boaria) that is not large enough to be controlled by City ordinance, nearby plant #8 are several Photinia fraseri which are not large enough to be controlled by city ordinance but which serve an important screening function between this property and the neighbors to the west and for that reason deserve mention. Along the back on the north fence there is only one tree mentioned, which is a small lemon and too small to be of concern to the City. However, trees #A, B and C are immediately adjacent to this property on the neighbor's property to the north. Tree A is a group of three of European white birch of 8-10 inch diameter each, and trees B and C each are Tristania laurina (swamp myrtle) of 7-8 inch diameter each and in reasonably good health. Trees identified as #3 and 6 on the plan along the west property line have apparently died. There is no evidence of their presence. PREPARED BY: BARRIE D. COATE, CONSULTING ARBORIST MAY 6,2006 AN INVENTORY OF TREES AT TH~PlE PROPERTY 22285 S. DE ANZA CIRCLE, CUPERTINO - 2 Tree #5 is a twin trunk coast live oak of 8 and 12 inch DBH (diameter at 4.5. feet above grade) that is seen behind an existing wood fence which extends from the house to the adjacent property fence. If that fence is left intact during construction there should be no contact of significance with this tree. Tree #9 a camphor tree of l4-inch diameter is a reasonably healthy tree. A protective fence is installed between construction activity and tree #9 and the construction activity and the root system of tree #5 there should be essentially no affect of construction on trees large enough to be of concern to the city. Recommendations 1. Tree #8 the Photinia fraseri shrubs not be removed but if desired by the owners could be pruned on the east side to provide better clearance for contractors. No wood larger than 2-inch diameter should be pruned in that process. 2. The existing retainer wall along the north side should be retained as currently seen to protect the root systems of the neighbor's trees. 3. A protective fence must be installed as shown on the enclosed plan to protect the root system of tree #9. That fence must be installed before construction begins and be retained until all contractors and subcontractors are off the job. 4. No excavation may occur within 10 feet of the trunks of tree #5 to prevent damage to the root system of that tree. If a pedestrian path of 2.5 feet in width is needed adjacent the house near oak #5 that is quite acceptable but no equipment should be allowed in the area beneath that tree. 5. Tree #6, a tall rather scrawny blue spruce is not large enough to be protected by city ordinance but if the owner wants to retain that tree in healthy condition they should prevent any construction equipment from travelling in areas of 6 feet of the trunk. In my opinion, with the most rudimentary efforts to protect trees and the installation of the fence as prescribed the planned home renovation should have no effect on the existing significant trees on the property.
