Subject: Director's Minor Modification, DIR-2006-03, to construct a skylight above a
portion of an existing one-story building located at 20400 Mariani Avenue
within a P(Commercial, Office, Industrial) zoning district.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION:
The applicant, Cameron Peach of South Bay Construction, is proposing to construct a
115 foot long by 21 foot wide skylight over a portion of the building that will be
occupied by Apple Computer's graphic design studio. Apple will be occupying the rear
half of the building and is requesting approval of the skylight to provide some natural
light inside the building for its graphic design studio. In total, Apple will occupy
47,569 square feet of the existing one-story building to accommodate its additional
corporate administrative, marketing and communication offices, and its graphic design
studio. The front half of the building is occupied by Dade Behring, a clinical diagnostics
company, which occupies the remaining half of the building at 57,685 square feet.
The proposed skylight will be a maximum of 6 feet in height situated above the existing
roof of the building. The structure will consist of skylight windows of insulated glass
with a honeycomb core that will allow for natural sunlight to filter into the building, but
will prevent views from the exterior of the structure downward into the design studio
for security purposes. The structure will also consist of a stucco exterior and painted
aluminum window frames around the skylight windows to match the existing building.
The roof will be covered with asphalt roofing material.
The structure is not likely to be visible from Mariani Avenue as it will be located over
the rear most portion of the building and will be approximately 380 feet from the front
of the building and approximately 500 feet away from Mariani Avenue. The structure,
at a height of 6 feet, is also not likely to be highly visible as it will be partially

surrounded by roof screening of approximately the same height to screen roof-mounted
mechanical equipment for the building.
The skylights are also not likely to impact surrounding properties given that there are
several mature trees planted along the perimeter of the site and the site is surrounded
by residential uses only to the south. The structure will be approximately 240 feet
away from the residential properties to the south. Apple Computers occupies buildings
to the north across Mariani Avenue and to the west along De Anza Blvd. To the east is
school district property that includes Lawson Middle School.
ACTION:
The Director of Community Development deems the modification minor and approves
the minor site improvements.
This approval of the modification is effective March 3,2006. The fourteen calendar day
appeal period will expire on March 17, 2006.
