Subject: Director's Minor Modification, DIR-2007-36, to a Use Permit (ll-U-82) to
construct a 625 square foot Community Center, 10092 Bianchi Way
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
tb the City Council and Planning Commission in time to allow any
Council member or Planning Commissioner to appeal the decision within
fourteen calendar days.
BACKGROUND:
On December 8, 2003, the Planning Commission approved a modification (M-2003-07)
to a Use Permit, ll-U-82, to construct a 625 square foot community center at Cupertino
Community Housing for the Disabled, Le Beaulieu. The applicant requests a redesign
and a reduction in size to approximately 295 square feet. Since the modification expired
on December 8,2005, this request is a modification to the original use permit.
DISCUSSION:
The front (west) elevation for the Community Center that was approved in 2003 is
shown below.

Staff has no concerns about the smaller building, other than the loss of architectural
details. A condition of approval is to include the lattice under the entry and the trellis
feature in the current proposal.
ACTION:
The Director of Community Development approves the minor modification to reduce
the size of the Community Center with the following conditions:

. The lattice at the entry way and the trellis feature on the front elevation
approved as part of the larger Community Center shall be included in the
smaller building, to the satisfaction of the Director of Community Development.
. Landscaping and landscaping features shall be installed prior to final occupancy.
This approval of the modification is effective November 19, 2007. The fourteen calendar
day appeal period will expire on December 2, 2007.
