Subject: Director's Minor Modification, DIR-2007-34, to a Use Permit (15-U-74) to
repaint the building and improve the landscaping at an existing shopping center, 20916
& 20956 Homestead Road
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow any
Council member or Planning Commissioner to appeal the decision within
fourteen calendar days.
BACKGROUND:
The applicants, Bay 18 Joint Venture and the Armanini Family Fund, are proposing
improvements to their adjacent commercial buildings in a shopping center located at
the southeast corner of Homestead Road and Stelling Avenue. The improvements are
being proposed at the direction of City Council who is reviewing a rezoning of the two
properties from P(REC, ENTER, LTD COM) to CG (General Commercial). The purpose
of the rezoning is to allow the property owners to attract a greater range of commercial
and office tenants than the current zoning allows.
DISCUSSION:
Both buildings need repainting to update the drab wall and roof colors (Exhibit A) and
both buildings will be painted the same colors. Additional trees are proposed along
Homestead Road and shrubs at the rear of the center (Exhibt B). The trees are 24" box
London Plane trees that will grow to a large enough size and tall enough height to
provide a nice streetscape without obscuring the building signage. The oleander shrubs
are small, but fast-growing, and will provide a sufficient landscaping buffer between
the rear parking lot activities and the adjacent apartment building.
ACTION:
The Director of Community Development deems the modifications minor and approves
the minor modification, file no. DIR-2007-34 per the submitted Exhibits A & B for 20916
and 20956 Homestead Road. This approval of the modification is effective November
20,2007. The fourteen calendar day appeal period will expire on December 4,2007.
