The purpose of this letter on behalf of Dr. Wu and Jane Wu (Mariani Business Center
LLC) is to obtain a Complete Total Final Resolution on this entire matter and in the
words of the Wus "to close out the case" as follows:
(1) The Wus agree to the Revised Plan (Attachment A) presented to them by Dave
Stillman on January 8,2008 and further agree to sign off on the letter agreement
(Attachment B) prepared by the City of Cupertino to permit construction of the
Revised Plan (Attachment A).

(2) In conjunction with the above and in order to achieve a Final Resolution the
following items must be agreed to by Sand Hill Property Company (Karen Ngo
requested that these be in writing and sent to her for consideration by her
Supervisor).
CD Re-striping ofWu's parking lot by Sand Hill Property Company;
~ Repair of sprinkler system by Sand Hill Property Company;
CID Erection of sign on Mariani Ave. (subject to City approval) for the Wu's
business by Sand Hill Property Company;
@ $100,000 lump sum payment by Sand Hill Property Company.
If the above is agreed to by Sand Hill Property Company then the 1996 Reciprocal
Easement must also be amended to reflect the change brought about by the new plan
(Attachment A). This will be prepared by Sand Hill Property Company.
Ms. Karen Ngo please advise if the above is acceptable and Wu's will sign off on
Attachment B and the Amended Easement (once it is prepared).

Dear Mr. Stillman:
We, Mr. Andrew Wu and Mrs. Jane Wu, acknowledge that we have reviewed the site
layout for 10495 N. De Anza Boulevard (Any Mountain) dated 1/8/2008, and we approve
of the improvements noted on the plan. Specifically, we approve of the realignment of
the handicap ramp and the necessary relocation of boulders, the installation of a 32-foot
driveway approximately six feet away from the ramp (approximately 8 feet of which will
reside on our side of the property line), a 19-foot (approximately) two-way drive aisle
between the driveway and our property, and closing of the previously-approved opening
between the new Any Mountain parking garage and our property,
We also grant Sand Hill property the right to enter our property for the purpose of
constructing these improvements.

Notice of Appeal re: Resolution No. 261
Dear Mr. lung:
Pursuant to the December 14,2007 Notice of Resolution #261, the adjacent property
owner/Appellants' Mariani Busin~ss Center LLC (20600 Mariani Ave., Cupertino, Ca.
95014) hereby appeal Resolution #261 on the following grounds and request a Public
Hearing:
(1) The 32 ft. proposed driveway in its present configuration does not permit equal
and unobstructed use of the reciprocal easement for inl:ress/el:ress across Sand
Hill's property because cars turning left from Mariani Avenue going to the rear
parking lot of Mariani Business Center LLC (Dr. Wu's patients coming to his
office) have to go thru a "complicated maze" (ie. parking lot - parking structure -
parking lot and finally unto Dr. Wu's rear parking lot). This is not acceptable and
constitutes an unsafe method. Whereas Sand Hill customers in their new parking
structure simply exit onto Dr. Wu's rear parking lot without going thru this
~'maze". The "proposal" needs to be modified to eliminate this "maze method".

(2) The proposed modifications violate the terms and the intent of the existing
"reciprocal/ineress/eeress/parkine easement".
(3) Adjacent landowners/Appellants need to review the revised landscape plan and
traffic circulation sienaee plan to avoid adverse impact on their adjacent
property .
(4) The plan would render non-productive the portion of the Appellants' property
immediately next to Appellants' building.
(5) Appellants' business address is on Mariani Avenue and Appellants must have a
convenient entrance for their patients on Mariani Avenue.
(6) Sand Hill Property must re-do the ramp and the barrier so that Appellants' property
immediately adjacent to Appellants' building would be wide enough to
accommodate a driveway entrance into Appellant's business parking lot from
Mariani Avenue.

SUBJECT: DESIGN REVIEW COMMITTEE ACTION LETTER - Application DIR-2007-33
This letter confirms the decision of the Design Review Committee, given at the meeting
of December 6, 2007; approving a Director's Minor Modification referral to an
Architectural ans Site approval (file no. ASA-2006-16) to relocate a driveway located on
the north property line on an approved office building under construction, located at
10495 N. De Anza Boulevard, according to Resolution No. 261.
Please be aware that if this permit is not used within two years, it shall expire on
December 6, 2009.
Also, please note that an appeal of this decision can be made within 14 calendar days
from the date of this letter. If this happens, you will be notified of a public hearing,
which will be scheduled before the Planning Commission.

SECTION II: FINDINGS
WHEREAS, the Design Review Committee of the City of Cupertino received a referral of an
application for a Director's Minor Modification, as described in this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Design Review Committee has held one or more
public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and
has satisfied the following requirements:
1. The proposal, at the proposed location, will not be detrimental or injurious to property
or improvements in the vicinity, and will not be detrimental to the public health, safety,
general welfare or convenience; and
2. The proposal is consistent with the purposes of this chapter, the General Plan, and
. zoning ordinance;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted
in this matter, the application no. DIR-2007-33, is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this Resolution are
based and contained in the public hearing record concerning Application
DIR-2007-33 as set forth in the Minutes of the Desigri Review Committee Meeting of November
15, 2007 and December 6, 2007 are incorporated by reference herein.

1. APPROVED EXHIBITS
Approval is based on the exhibit titled "Revision A-l/1, except as may be amended by
conditions in this resolution.
2. REVISED LANDSCAPE PLAN AND STORM DRAINAGE/UTILITY PLAN
Prior to building occupancy, the applicant shall submit a revised landscape plan and storm
drainage/ utility plan for the areas affected by the driveway relocation to be approved by
the Director of Community Development and Director of Public Works respectively.
3. TRAFFIC CIRCULATION SIGNAGE PLAN FOR THE PARKING STRUCTURE
Prior to building occupancy, the applicant shall submit a traffic circulation signage plan for
the garage to be approved by the Director of Public Works.
4. NOTICE OF FEES, DEDICATIONS, RESERV A nONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90":day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
