Subject: Director's Minor Modification, DIR-2007-29, to allow a 192 square foot garden
shed on the northwest corner of the Marianist retirement center property located at
22622 Marianist Way in the BQ (Quasi-Public Building) zoning district.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow any
Council member or Planning Commissioner to appeal the decision within
fourteen calendar days.
BACKGROUND:
The subject property is located on the north side of Alcalde Road, west of Foothill
Boulevard and east of Lockwood Drive. The surrounding land uses are primarily
residential duplexes to the north, east and west, and single-family residences to the
south across Alcalde Road.
On August 23, 2005, the Marianist Center received approval of a Use Permit and
Architectural and Site Review from the Planning Commission to convert and expand an
existing retreat center into a 27-bedroom retirement center for the Marianist Brothers, a
Catholic religious order of brothers. These approvals also allowed for improvements to
the site, including new landscaping throughout the property and additional parking
spaces on site.
Construction of these improvements is nearing completion and final occupancy.
However, during one of the final occupancy inspections, staff noticed that a garden
shed was constructed on the property on the northwest corner of the site, which was
not a part of the approved Use Permit and Architectural and Site Review. Therefore,
the applicant is requesting approval of the Director's Minor Modification to retain the
shed.
DISCUSSION:
The garden shed is 12 feet by 16 feet, with a gable roof whose maximum height is 11 feet
1 inches. The 192-square foot shed is constructed of vertical wood siding with asphalt
shingle roofing material and has a 4-foot setback along the west side property line and a
28-foot setback along the north (rear) property line. The eave setback along the western
side of the property is 3 feet 3 inches. The garden shed is adjacent to the rear yards of
duplex properties to the west and north, and is, therefore, not anticipated to create

impacts on these adjacent properties, since there is landscape screening along these
property lines that exceed the height of the shed.
ACTION:
The Director of Community Development approves the minor modification to allow the
garden shed to remain on the property with the following conditions:
1. The applicant shall obtain a building permit and final occupancy of the shed prior to
the release of the final occupancy for the retirement center.
This approval of the modification is effective September 4, 2007. The fourteen calendar
day appeal period will expire on September 18, 2007.
