Subject: Director's Minor Modification, DIR-2007-28, to renew a use permit, ll-U-OO, to
allow the continuing operation of a stadium light/ antenna monopole personal
wireless service facility at 10100 Finch Avenue
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
BACKGROUND:
In 2000, Nextel Communications, now merged with Sprint PCS, was granted use permit
approval to erect a personal wireless service facility at Cupertino High School. The
approval consisted of a base equipment station and antennas mounted in a canister on a
monopole that replaced an existing stadium light pole. The permit was granted for five
years and upon renewal the City and applicant would have an opportunity to review
the permit to determine if there were opportunities to improve the concealment based
on new technologies or camouflage techniques.
DISCUSSION:
The monopole was originally approved with a diameter that more closely matched the
diameters of the other stadium light poles. The monopole was also granted a height
exception, to accommodate a collocation of another carrier's antennas. As the project is
located on school property, the building permit was reviewed an~ approved by the
State Office of the Architect. This state agency required a thicker diameter pole because
of structural concerns with having stadium lights and antennas on the same pole.
Nextel did not plant the required screening tree as part of the original approval, but its
successor, Sprint-Nextel has planted the required 36" box Coastal Redwood prior to the
Director's action.

The Director of Community Development deems the modification minor. The Director
approves an extension of the original approval for 10 years, to September 11, 2015.
This approval of the modification is effective August 28,2007. The fourteen calendar
day appeal period will expire on September 11, 2007.
