Subject: Director's Minor Modification, DIR-2007-21, to renew a use permit
modification, l-U-97(mod), to allow the continuing operation of a roof-
mounted personal wireless service facility at, 19111 Pruneridge Avenue.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
BACKGROUND:
In May 2001, Sprint PCS was granted permission to erect a personal wireless service
facility, consisting of antennas and base equipment on the roof of the Hewlett Packard
Building #45 at the intersection of Homestead Road and North Tantau Avenue. The
permit was granted for five years and upon renewal the City and applicant would have
an opportunity to review the permit to determine if there were opportunities to
improve the concealment based on new technologies or camouflage techniques.
DISCUSSION:
This facility is one of the better-screened facilities in Cupertino as can be seen in the
photographs, and staff believes the screening cannot be improved. In accordance with a
new state law, SB 1627, wireless facility permits, if entitled, must be for a period of at
least 10 years.
The Director of Community Development deems the modification minor and approves
an extension of the original approval for 10 years, to May 3, 2016.
This approval of the modification is effective August 24,2007. The fourteen calendar
day appeal period will expire on September 7, 2007.
