Chapter 19.132 of the Cuperth10 Municipal Code allows for ad1l1ll1istrative
appr.oval of mh10r c11a11ges h1 a project. The Director reports hIs decision
to the City Council a11d Pla1u1ing Commission. ll1 time to allow an appeal
of t11e decision wit11in fourtee11 cale11dar days.
BACKGROUND:
T11e subject property is located at 1699 S. De A11za Blvd. Tl1e property is z011ed Pla1u1ed
Development with commercial a11dj or reside11tial 5-15 dwelli11g units per gross acre,
[P(Com, Res 5-15]. The property is surrou11ded by ot11er commercial uses a11d this
project h.as no direct impact on any reside11tial property.
In JU11e 1987, the applicant got approval for operath1g t11e existu1g gasolh1e service
statio11 011 a twe11ty-four l10ur basis. Approval was also granted for ll1cide11tal sales of
c011venie11ce items at that time.

DISCUSSION:
The gas station currently has three service bays. The total building area is 1498 sq. ft.
The applicant is proposing to incorporate two service bays into a convenience store and
re-configure the existing cashier's area, storage areas and restrooms. With this
reconfiguration, the convenience store will be approximately 1,126 sq. ft.
Front Elevation:
The applicant is adding sliding glass doors at the front of the building. Cement pilasters
are being added to the snack shop and service bay to add architectural interest in the
building. The owner is keeping the brick veneer at the base of the building and carrying
it through in the areas where walls are being added to enclose the auto bays.
A condition of approval have been added with respect to the windows to better balance
the front elevation. The three windows in the center of the front elevation are to be
converted to two windows. The applicant is aware of this condition and is agreeable to
making this change.
The existing canopy over the gas dispensers is attached to the snack shop. As a part of
this project, the applicant is proposing to cut the canopy back and replace the existing
roof with a metal roof. The fascia around the roof is also being replaced.
Trash Enclosure:
The property has an existing trash enclosure that has been converted to an aIr
compressor enclosure without permits. Subsequently, a trash enclosure has been
constructed along the west property line also without permits. As a part of this project,
the applicant proposes to construct a new trash enclosure to match the building along
the west property line.
Site Improvements:
The applicant is closing the driveway on S. De Anza Blvd closest to the intersection of S.
De Anza Blvd and Prospect Road. At this location, the applicant is proposing a three-
foot wide planter as a continuation of the existing landscape planter at the corner. The
applicant is also widening an existing planter along the north property line.
Additionally, the applicant is removing one parking stall and using a portion of this
stall to enlarge an existing landscape planter along the west property line. The applicant
is also adding five new trees on the property. The species of these trees shall be
reviewed when the applicant applies for building permits and the final landscaping
plan is approved.
Hours of Operation:
When the use permit was granted in 1987, the Planning Commission had security
concerns with regard to the g'as station operating on a 24-hour basis. There were several
security measures installed at the gas station at the time. However, the gas station,
currently, does not operate on a 24-hour basis. Since May 2004, the gas station hours of

operation have been from 6 a.m. to 10 p.m. on weekdays and from 7 a.m. to 10 p.m. on
weekends (see Exhibit A). Since the gas station has not operated on a 24-hour basis for
over one year, the permit allowing this has expired.
ACTION:
The Director of Community Development deems the modifications minor and approves
the changes subject to the following conditions:
1. Change the three windows in the center of the front elevation to be two equal
windows.
2. A sign program shall be required prior to installation of signage on the property.
3. Applicant shall provide landscaping plans for review and approval prior to the
issuance of building permits.
This approval of the modification is effective September 25, 2007. The fourteen calendar
day appeal period will expire on October 9, 2007.
