Subject: Director's Minor Modification, DIR-2007-16, to allow a 135 square foot
addition to a one-story, single-family residence in a P(Rl-7.5) zoning
district, 10039 Oakleaf Place
Chapter 19.132 of the Cupertino Municipal Code allows for
administrative approval of minor changes in a project. The
Director reports his decision to the City Council and Planning
Commission in time to allow an appeal of the decision within
fourteen calendar days.
BACKGROUND:
The subject property is located at 10039 Oakleaf Place within a neighborhood
north of Stevens Creek Boulevard and west of Phar Lap Drive.
On March 16, 2007, the applicant received approval of a Director's Minor
Modification (DIR-2007-07) to construct a 383 square foot addition to the existing
residence to accommodate a new family room and bedroom at the rear of the
residence. The plans complied with the requirements of the use permit (11-V-80)
approving development in this neighborhood within a P(Rl-7.5) zoning district,
and all other development standards in accordance with the R1 (single-family
residential zone) ordinance.
DISCUSSION:
The property owners are requesting to add a 135 square foot nook to the kitchen
area. The proposed nook addition will be located at the rear of the residence,
adjacent to the previously approved addition, to the west.
The project complies with the requirements of the previous use permit (11-V-80)
that approved the development within this neighborhood, and all other
development requirements in accordance with the R1 zoning ordinance. With

this new addition, the FAR will be 29.9%, which is far below the maximum .45
FAR allowed in accordance with the Rl-7.5 zoning district requirements. The
addition will also have a 22-foot side yard setback and a 60-foot rear yard
setback.
ACTION:
The Director of Community Development deems the modification minor and
approves the addition to the residence.
This approval of the modification is effective May 10, 2007. The fourteen
calendar day appeal period will expire on May 24, 2007.
