Subject: Director's minor modification (file no. DIR-2007-13) of a hillside
exception (EXC-2005-08) to construct the main residence after
completion of the second living unit.

Chapter 19.132 of the Cupertino Municipal Code allows for
administrative approval of minor changes in a project. The
Director reports his decision to the City Council and Planning
Commission in time to allow an appeal of the decision within
fourteen calendar days.
Application:
On December 13, 2005, the Planning Commission granted an exception request to
allow the construction of a new 5,155 square foot residence and a detached
secondary dwelling unit located on a prominent ridge line. The applicant is
currently preparing to submit the building permit application for the detached
secondary dwelling. Due to financial considerations and moving logistics, the
applicant is requesting that the building permit for the main house be submitted
six months after the completion of the secondary dwelling unit. .
Action:
The Director of Community Development deems the modification minor and
approves the request with the following condition:
1. A complete building permit application for the main house, deemed
acceptable by the Building Official, shall be submitted to the Building
Department no more than six months after the issuance of the final
certificate of occupancy for the secondary dwelling unit.
2. This approval of the modification is effective June 1, 2007. The fourteen
calendar day appeal period will expire on June 15, 2007. The new
expiration date for the exception approval (EXC-2005-08) shall be June 1,
2009.
