Subject: Director's Minor Modification, DIR-2007-07, to allow a 383 square foot
addition to a one-story, single-family residence in a P(Rl-7.5) zoning
district, 10039 Oakleaf Place
Chapter 19.132 of the Cupertino Municipal Code allows for
administrative approval of minor changes in a project. The
Director reports his decision to the City Council and Planning
Commission in time to allow an appeal of the decision within
fourteen calendar days.
BACKGROUND:
Thesubject property is located at 10039 Oakleaf Place within a neighborhood
north of Stevens Creek Boulevard and west of Phar Lap Drive.
DISCUSSION:
The applicant is requesting a Director's Minor Modification, DIR-2007-07, to add
383 square feet to an existing one-story, 2,845 square foot residence in a planned
development zone. The addition will accommodate a new family room and
bedroom at the rear of the residence.
The project complies with the requirements of the use permit (11-V-80)
approving development in this neighborhood within a P(Rl-7.5) zoning district.
With the addition, the FAR will be .28, which is far below the maximum .45 FAR
allowed in accordance with the Rl-7.5 zoning district requirements. The
addition will also have a 48.5 foot rear yard setback and a 40 foot side yard
setback along the east side of the property, which far exceed the Rl-7.5
requirements. The addition will be attached to the west side and rear of the
residence; therefore, no changes are proposed to the front yard and west side
yard setbacks of the residence.

Staff supports the minor modification application as proposed.
ACTION:
The Director of Community Development deems the modification minor and
approves the addition to the residence.
This approval of the modification is effective March 16, 2007. The fourteen
calendar day appeal period will expire on March 30,2007.
