Chapter 19.128 of the Cupertino Municipal Code allows for administrative approval ofa
use permit, authorizing the use of a site in any zoning district for a temporary use (no
more than 6 months). The Director reports his decision to the City Council and Planning
Commission in time to allow any Councilmember or Planning Commissioner to appeal
the decision within fourteen calendar days.
Application:
File No. DIR-2007-04: Director's Temporary Use Permit to allow two separate two-day
car sales events for credit union members at 19055 and 19111 Pruneridge Avenue.
The applicant, Cars-Net, is proposing to host two, two-day car sales events for credit
union members of Addison Avenue Federal Credit Union, which is affiliated with
Hewlett Packard. The applicant proposes to bring in a fleet of used, for-sale vehicles
after hours on two separate Fridays, preceding the sales events and park and display them
in a satellite parking lot at 19111 Pruneridge Avenue on the Hewlett Packard Campus
(see Exhibit A). Customers will park at the adjacent lot located at 19055 Pruneridge
Avenue and complete the documentation of any car sale in the credit union building
located at the same address. The 2007 sales dates are Saturday & Sunday: February 24th
and 25th, and August 18th and 19th from 9:00 a.m. to 6:00 p.m. Saturday, and 10 a.m. to 5
p.m. Sunday. All sales tax will be reported from this Cupertino location. All vehicles
will be removed by Sunday night. The sales event will be fully contained on these two
parking lots and will not interfere with surrounding land uses.
The temporary use permit is necessary because the zoning for this Hewlett-Packard
property is P(MP) - Planned Development Industrial Park Zoning, which does not permit
retail sales. Temporary vehicle sales events have been previously allowed on these
properties with temporary use permits over the last two years.
Action:
In accordance with Chapter 19.128 of the Cupertino Municipal Code, the Director of
Community Development finds
1. The granting of the application will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public, health,
safety, general welfare, or convenience; and
2. The proposed use will be located and conducted in a manner in accord with the
Cupertino General Plan and the purposes of this title.
The Director of Community Development grants two (2)- day temporary use permits,
effective February 24-25, and August 18-19,2007 to allow two car sales events for credit
union members at 19055 and 19111 Pruneridge Avenue. Approval is contingent upon the
applicant reporting all vehicle sales from this Cupertino location for sales tax purposes.
The approval is granted on February 1,2007. The fourteen calendar day appeal period
will expire on February 15, 2007.
