Subject: Director's Minor Modification (DIR-2008-), for an extension of an existing
Temporary Use Permit to utilize a vacant lot.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow any
Council member or Planning Commissioner to appeal the decision within
fourteen calendar days.
BACKGROUND:
The applicant, Barry Swenson, is requesting an extension of a Temporary Use Permit
(DIR-2008-10), to utilize a vacant lot located on 19160 Stevens Creek Boulevard. Under
the use permit, the contractor, Royal Electric, utilized the lot as a staging area for trucks
and equipment and performed electrical work for and around the City of Cupertino.
Work included installing fiber optic cabling to interconnect traffic control
communication systems between the cities of Cupertino, San Jose and Santa Clara.
DISCUSSION:
Royal Electric did not complete the project by the anticipated date, which was
September I, 2008. A majority of the work has been completed; however, the City of
Cupertino requested the installation of additional strand fiber jumpers. The applicant
requests an extension to November I, 2008 to allow Royal electric to complete their
work.
ACTION:
The Director of Community Development deems the modification minor, and approves
the application.
This approval of the modification is effective October 6, 2008. The fourteen calendar
day appeal period will expire on October 20, 2008.
