Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow any Council member or Planning Commissioner to appeal the decision within fourteen calendar days. BACKGROUND: On July 18, 2006, the City Council approved a Use Permit and Architectural Site Approval to demolish the existing single-story storage facility buildings at Public Storage and construct three new multi-story storage facility buildings with associated site improvements. The new site improvements include amini-park at the entry to the site, a pedestrian trail accessing from the adjacent Oak Park Village condominium site, and new landscaping, paved driveways and parking configuration. On September 21, 2006, Public Storage also received approval of the detailed architectural materials to be used on site and a landscaping plan by the Design Review Committee in accordance with the conditions of approval by the City Council. The detailed architectural materials specified the type of exterior building materials to be used on the buildings. Additionally, the landscape plan detailed the particular planting materials for the site, including the areas for the new mini-park and pedestrian trail. DISCUSSION: Public Storage is requesting approval to slightly modify both the selection of exterior building materials for the new buildings and the elevations of the buildings to make the project economically feasible for Public Storage to proceed with the development of the project. Public Storage has indicated that the project as it is currently approved makes the development cost-prohibitive at this time. Public Storage is also requesting approval to implement alternative storm water run-off methods to meet the intent of the pervious pavers in Condition No. 20 (See Enclosures) of the Use Permit and ASA conditions of approval. The proposed architectural changes to the buildings include an increase of split face concrete block along the lower portions of the buildings, the addition of smooth face DIR-2008-23 20565 Valley Green Drive Page 2 concrete block with reveal lines in lieu of a stucco EIF (exterior insulation and finish) system along some portions of the elevations, and replacement of clear glass windows with spandrel glass windows. Additionally, the shape of some "tower" portions of the buildings have been modified to accommodate utility structures such as stairwells, elevators and rooftop mechanical screens. Public Storage is also requesting to use alternative methods to reduce storm water run- off to meet the intent of using pervious pavers on site. The alternative method would allow Public Storage to construct driveways with asphalt pavement, but use a combination of solid pipe, infiltration trenches, perforated pipes and grassy swales to handle storm water run-off. The Public Works Department has reviewed this proposal and is supportive of these alternative storm water run-off methods since these methods are also an improvement from the existing storm drainage system on site. No other changes are being requested by Public Storage for the development of this project. Therefore, all other previously-approved conditions of approval for the project remain effective. Staff believes that the requested changes are minor in nature and is supportive of these modifications to facilitate development of this project. ACTION: The Director of Community Development approves the application as proposed. This approval of the modification is effective September 2, 2008. The fourteen calendar day appeal period will expire on September 16, 2008. Require Building C to be additionally set back or reduced in height to one story facing Valley Green Drive apartments. Reduce the allocation requirement fioin 101,300 square feet to 10,000 square feet. 4. Security signage & phone number must be posted on site. A copy of the lease contract to the City Attorney. 6. Add benches to the pedestrian pathway and vines to grow along trellises attached or adjacent to the building to soften the exposed flat wall areas. 10. Require a double row of trees along the pedestrian trail with tree types that provide canopy coverage. 11. Hourly patrol while open. 12. Added architectural details and lighting to be reviewed by the Design Review Corrunittee. The Use Permit Conditions are as follows: SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT T1FPT 1. APPROVED EXHIBITS The reconunendation of approval is based on Exhibits submitted by RHL Design Group, Il~c. dated March 21, 2006, consisting of 21 sheets including a Site Plan, Floor Plans, Elevations, Colored Elevations, and Preliminary Landscape Plan, except as inay be amended by the Conditions contained in this Resolution. 2. DEVELOPMENT APPROVAL Approval is granted to construct two new three-story buildings consisting of 74,511 square feet for Building A and 80,742 square feet for Building B for use as a iniiu-storage facility. 3. PARKING The applicant shall provide a minimum of 80 parking spaces on site, in accordance with the parking study prepared on March 20, 2006 by TJKM Transportation Consultants. 4. LANDSCAPE PLAN The applicant shall submit detailed landscape aild imgation plans to be reviewed and approved by the Desib 1 Review Committee (DRC) that: a. Provide additional trees within the landscape area on the Cal Trans h~terstate 280 right-of--way adjacent to the northern property line of the project site. The applicant shall work with Cal Trans to secure approval for planting of these trees along the project site on Cal Trans property. U-2006-03 July 21, 2006 3 b. Provide additional trees within the planter areas on site and around the perimeter of the site to mitigate the privacy impacts of the project from the adjacent residential neighborhoods. c. Provide landscaping along the masonry wall separating the project site from adjacent residential uses. Landscaping shall consist of a combination of trees, sluubs and/or climbing vines that will enhance the privacy screening for the adjacent residential uses. 5. TREE PROTECTION As part of the dezolition or building permit drawings, a tree protection plan shall be prepared by a certified arborist for the trees to be retained. Izl addition, the following measures shall be added to the protection plan: - For trees to be retained, chain link fencing and other root protection shall be installed around the dripline of the tree prior to any project site work. - No parking or vehicle traffic shall be allowed under root zones, unless using buffers approved by the Project Arborist. - No trenching within the critical root zone area is allowed. If trenching is needed in the vicinity of trees to be retained, the City's consulting arborist shall be consulted before any trenching or root cutting beneath the dripline of the tree. - Wood chip mulch shall be evenly spread inside the tree projection fence to a four- inch depth. - Tree protection conditions shall be posted on the tree protection ban-iers. - Retained trees shall be watered to maintain them in good health. - A covenant on the property shall be recorded that identifies all the protected trees, prior to final occupancy. The tree protection measures shall be inspected and approved by the certified arborist prior to issuance of building permits. The City's consulting arborist shall inspect the trees to be retained and shall provide reviews before building permit stage, during construction and before final occupancy of the garage. A report ascertaining the good health of the trees mentioned above shall be provided prior to issuance of final occupancy. 6. TREE PROTECTION BOND All trees that are not required to be removed shall be covered by a tree protection bond. A tree protection bond in the amount of $50,000 shall be provided prior to issuance of demolition or building permits. 7. LANDSCAPE REVIEW The applicant shall submit a comprehensive landscaping plan, including water conservation and pesticide reduction measures, in conformance with Cizapter i 4. i 5, Xeriscape Landscaping and the pesticide control measures referenced in Chapter 9.18, Stonnwater Pollution Prevention and Wartershed protection, of the City Municipal Code. U-2006-03 4 July 21, 2006 8. BICYCLE PARKING The applicant shall provide bicycle parking and bike racks for the proposed project. The number of bicycle parking spaces and location of bike racks shall be determined by the Director of Community Development. 9. UNUSED BUILDING MATERIALS In lieu of disposing of unused building materials for the construction of the project, the applicant shall be required to recycle the unused building materials. 10. BUILDING MATERIAL RECYCLING The existing building and site materials shall be recycled to the maximum extent possible subject to the review by the Building Official. Proof of recycling shall be submitted to the City for review prior to final occupancy. 11. DEMOLITION REQUIREMENT All existing structures on the site shall be removed prior to or concurrently with project construction. The developer shall assume the responsibility to obtain all required demolition permits in accordance with City Ordinances. The applicant shall agree to site inspection by the Historical Society if requested. 12. MASONRY WALL A six-foot masonry wall shall be provided on the project's mutual boundary with residentially zoned or used property. Said wall shall be at least six feet in height as measured from highest adjoining grade; greater height may be required if the project creates noise impacts that will require an acoustical consultant report. 13. SCREENING All mechanical and other equipment on the building or on the site shall be screened so they are not visible from public street areas or adjoining developments. Screening materials/colors shall match building features and materials. The height of the screening shall be taller than the height of the mechanical equipment that it is designed to screen. The location of equipment and necessary screening shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 14. TRASH AND DELIVERY ACTIVITIES A detailed refuge and truck delivery plan must be prepared by the applicant. The plan shall specify locations of trash facilities, refuge pick up schedules and truck delivery schedules and routes. All trash facilities must be screened and enclosed to the satisfaction of Public Works Department. The final plan shall be submitted to the City for review and approval prior to issuance of building permits. U-2006-03 July 21, 2006 5 15. CONSTRUCTION MANAGEMENT PLAN A comprehensive construction operation plan must be submitted to the City for review and approval prior to issuance of grading and building permits addressing the following: - Staging area - Tree protection - Construction hours and limits - Construction vehicle and truck routes - Dust and erosion control - Garbage and debris container location and pick up schedule - Signage advising contractors of the restrictions - Construction equipment and construction vehicle parking locations In addition to the construction management plan described above, the following additional construction activity limitations apply: - No grading is allowed during the rainy season -October through April. - On Saturdays, grading, street construction, demolition, underground utility work and other construction work that directly involves motorized vehicular equipment are prohibited. - On Sundays, construction is prohibited. - Staging of construction equipment shall not occur within 250 feet of residential property 16. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuai7t to Government Code Section 66020(x), has begun. If you fail to file a protest within this 90- day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions.. 17. SIGNAGE Signage is not approved with this permit application. Signage shall conform to the City Sign Code. 18. RECYCLING FACILITIES The developer shall make provisions for recycling facilities, which shall be in accordance with Chapter 19.81 of the Cupertino Municipal Code. 19. PUBLIC ART Prior to occupancy, the applicant shall set aside .25% (up to $100,000) of the total project budget for on-site art. The plan shall be reviewed and approved by the Fine Arts Commission and installed prior to issuance of final occupancy permits. U-2006-03 July 21, 2006 6 20. PERVIOUS PAVERS The applicant shall install pervious pavers in lieu of asphalt pavement on site, if they are in compliance with Fire Department requirements. SECTION N: CONDITIONS ADMINISTERED BY THE PUBLIC WORKS DEPT. 21. BEST MANAGEMENT PRACTICES Utilize Best Management Practices (BMP's), as required by the State Water Resources Control Board, for construction activity, which disturbs soil. BMP plans shall be included in your building plan submittals. 22. EROSION CONTROL PLAN The applicant must provide an erosion control plan with the building permit submittals. The City must approve this plan prior to the corrunencement of any construction on site. 23. BUILDING PERMIT APPLICATION The applicant will be required to obtain Public Works Depai-tnent approval for any on site construction via the building permit process. A stone drain fee of $4,013.40 would be required in addition to the standard fees assessed in accordance with the Public Works Department review. 24. DRAINAGE All drainage shall be provided to the satisfaction of the City Engineer. 25. ABANDONED WATER WELLS The property owner shall seal abandoned or unused water wells if the City, after consultation with the Santa Clara Valley Water District, determines that said abandoned or unused water wells have a potential to contaminate the water supply. 26. SANITARY DISTRICT The applicant shall be 'required to comply with the requirements of the Cupertino Sanitary District, which shall include the following: a. Abandorunent of the existing sewer service for the project site to the property line. The abandonment plans shall be submitted to and reviewed by the Sanitary District. b. Additional Sanitary District fees and/or permits shall be required for the proposed improvements. c. Improvement plans for the subject property shall be reviewed by the District. A District Plan Checking and Inspection Deposit may be required. As we discussed, the purpose of the meeting is to review the proposed changes to the elevations that have previously been discussed with staff. We have attached colored plans showing both the approved and proposed revised elevations for Building A. We have also provided black and white plans showing both the approved and the proposed revised elevations for all of the buildings (i.e., Buildings A, B and C). In reviewing these changes with Public Storage, it appears that the revised plans are largely consistent with the theme, materials and elements of the approved plans. My initial reaction was that the revised plans appear to be very similar in nature to the approved plans and based on the project location there appears to be limited visibility to the areas that have been revised. Staff seems to have had a similar reaction to the revised plans as indicated by the attached email from planner Aki Honda to project architect Jeff Holtzer. After you have had a chance to review the revised plans, we are hoping to discuss the modification approval process. Ciddy and I reviewed the revised plans with Steve Piasecki, our Community Development Director, and have the following comments: 1. The height of the building appears to be higher than the originally approved plans and exceeds the maximum height limit of 45 feet for this area. Could you reduce the overall height of the building not to exceed 45 feet as in the approved plans? 2. I believe the originally approved plans took into consideration the parapet height to screen the roof -top equipment on the buildings, except for the elevator towers. Could the roof -mounted equipment be screened by the parapet as on the originally approved plans? The elevator towers can remain at a height above the parapet as shown on the approved plans. 3. Is there any type of material that mimics the look of spandrel glass to at least provide a spandrel glass substitute along elevations where the spandrel glass was shown on the approved plans? We look forward to reviewing any ideas you may have to achieve this. 4. Could you provide a "green screen" that restores the trellis elements on the back side of the building that can be planted with clinging vines to help mitigate the massing impacts of the building? This will help to soften the appearance of the back of the building. I've included some photos of the type of planting trellises that we'd like to see on the rear sides of the buildings. That the subconclusions upon which the findings and conditions specified in this resolution are based and contained in the public hearing record concerning Application ASA -2006-05 set forth in the Minutes of the Design Review Committee meeting of, September 21, 2006, and are incorporated by reference as though fully set forth herein. SECTION III. CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS Approval is based on architectural and landscape plan sets for Public Storage, consisting of twenty four sheets dated October 19, 2005, except as may be amended by conditions in this resolution. 2. CAL TRANS RIGHT-OF-WAY LANDSCAPING Provide additional trees within the landscape area on the Cal Trans Interstate 280 right- of-way adjacent to the northern property line of the project site as permitted by Cal Trans. The applicant shall work with Cal Trans to secure approval for planting of these trees along the project site on Cal Trans property. Resolution No. 243 ASA -2006-05 September 21, 2006 Page 2 3. BENCHES Benches shall be provided along the pedestrian pathway. The location and design of benches shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 4. LANDSCAPING A. Landscape planter areas shall be installed in front of the trellis elements that are placed against the buildings and shall be planted with clinging vines that shall be trained to grow onto the trellis elements. B. Arbutus 'Marina' (preferably multi -trunk) trees or a combination of the Arbutus 'Marina', Brisbane Box and New Zealand Christmas (evergreen) trees shall be planted along the pedestrian pathway and shall provide adequate canopy coverage year around. These trees shall also be of a type that can be planted next to the existing eucalyptus trees. The trees to be planted shall be reviewed and approved by the Director of Community Development. C. Coast Redwood trees shall be planted along the north (rear) and west side yards of the property and shall provide screening around the west and north perimeter of the property year around. The applicant may also intersperse trees with pepper trees along the north (rear) property line to provide some visibility of the upper portion of the buildings. The trees to be planted shall be reviewed and approved by the Director of Community Development. 5. PEDESTRIAN PATHWAY The pedestrian pathway along the south perimeter of the site shall be comprised of pervious crushed granite in lieu of a concrete pedestrian pathway. The pervious crushed granite pathway shall be ADA compliant. 6. LIGHTING Public Storage shall provide -lighting details to be reviewed and approved by the Director of Community Development. Lighting shall not reflect upwards to the sky, but be focused downwards, so as not to impact the adjacent residential uses to the east and west. Lighting details of the approved lighting shall be submitted to the Design Review Committee as an information item. Update the project approval allowing construction of the 155,250 square feet, 3 and 4 story mini -storage facility per the revised exhibits with the 45 foot max height building elevations, including lowering the building height on Building B to acconunodate the decorative arch within the 45. foot height limit. 2. Require Building C to be additionally set back or reduced in height to one story facing Valley Green Drive apartments. 3. Reduce the allocation requirement from 10 1,3 00 square feet to 10,000 square feet. 4. Security signage & phone number must be posted on site. 5. A copy of the lease contract to the City Attorney. 6. Add additional Public Works requirements including street improvements, improvement agreement, storm water pollution prevention best management practices, as stated in the staff report. 8.. Require a public access easement connecting the new mini -park and pedestrian trail to the Oak Park Village pedestrian access. 9. Add benches to the pedestrian pathway and vines to grow along trellises attached, or adjacent to the building to soften the exposed flat wall areas. 10. Require a double row of trees along the pedestrian trail with tree types that provide canopy coverage. 11. Hourly patrol while open. 12. Added architectural details and lighting to be reviewed by the Design Review Committee. The Use Permit Conditions are as follows: SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. L. APPROVED EXHIBITS The reconunendation of approval is based on Exhibits submitted by RHL' Design Group, Iuc. dated March 21, 2006, consisting of 21 sheets including a Site Plan; Floor Plans, Elevations, Colored Elevations, and Preliminary Landscape Plan, except as may be amended by the Conditions contained in this Resolution. 2. DEVELOPMENT APPROVAL Approval is granted to construct two new three-story buildings consisting of 74,511 square feet for Building A and 80,742 square feet for Building B for use as a mini -storage facility. 3. PARKING The applicant shall provide a minimum of 80 parking spaces on site, in accordance with the parking study prepared on March 20, 2006 by TJKIVI Transportation Consultants. 4. LANDSCAPE PLAN The applicant shall submit detailed landscape and irrigation plans to be reviewed and approved by the Design Review Conunittee (DRC) that: a. Provide additional trees within the landscape area on the Cal Trans Interstate 280 right-of-way adjacent to the northern property line of the project site. The applicant shall work with Cal Trans to secure approval for planting of these trees along the project site on Cal Trans property. U-2006-03 July 21, 2006 3 b. Provide additional trees within the planter areas on site and around the perimeter of the site to mitigate the privacy impacts of the project from the adjacent residential neighborhoods. c. Provide landscaping along the masonry wall separating the project site from adjacent residential uses. Landscaping shall consist of a combination of trees, shrubs and/or climbing vines that will enhance the privacy screening for the adjacent residential uses. 5. TREE PROTECTION As part of the demolition or building permit drawings, a tree protection plan shall be prepared by a certified arborist for the trees to be retained. _In addition, the following measures shall be added to the protection plan: ➢ For trees to be retained, chain link fencing and other root protection shall be installed around the dripline of the tree prior to any project site work. ➢ No parking or vehicle traffic shall be allowed under root zones, unless using buffers approved by the Project Arborist. ➢ No trenching within the critical root zone area is allowed. If trenching is needed in the vicinity of trees to be retained, the City's consulting arborist shall be consulted before any trenching or root cutting beneath the dripline of the tree. ➢ Wood chip mulch shall be evenly spread inside the tree projection fence to a four - inch depth. ➢ Tree protection conditions shall be posted on the tree protection barriers. 9 Retained trees shall be watered to maintain them in good health. ➢ A covenant on the property shall be recorded that identifies all the protected trees, prior to final occupancy. The tree protection measures shall be inspected and approved by the certified arborist prior to issuance of building permits. The City's consulting arborist shall inspect the trees to be retained and shall provide reviews before building pen -nit stage, during construction and before final occupancy of the garage. A report ascertaining the good health of the trees mentioned above shall be provided prior to issuance of final occupancy. 6. TREE PROTECTION BOND All trees that are not required to be removed shall be covered by a tree protection bond. A tree protection bond in the amount of $50,000 shall be provided prior to issuance of demolition or building permits. 7. LANDSCAPE REVIEW The applicant shall submit a comprehensive landscaping plan, including water conservation and pesticide reduction measures, in conformance with Chapter 14.15, Xeriscape Landscaping and the pesticide control measures referenced in Chapter 9.1 S, Stormwater Pollution Prevention and Wartershed protection, of the City Municipal Code. U-2006-03 El July 21, 2006 8. BICYCLE PARKING The applicant shall provide bicycle parking and bike racks for the proposed project. The number of bicycle parking spaces and location of bike racks shall be determined by the Director of Community Development. 9. UNUSED BUILDING MATERIALS In lieu of disposing of unused building materials for the construction of the project, the applicant shall be required to recycle the unused building materials. 10. BUILDING MATERIAL RECYCLING The existing building and site materials shall be recycled to the maximum extent possible subject to the review by the Building Official. Proof of recycling shall be submitted to the City for review prior to final occupancy. 11. DEMOLITION REQUIREMENT All existing structures on the site shall be removed prior to or concurrently with project construction. The developer shall assume the responsibility to obtain all required demolition pen -nits in accordance with City Ordinances. The applicant shall agree to site inspection by the Historical Society if requested. 12. MASONRY WALL A six -,foot masonry wall shall be provided on the project's mutual boundary with residentially zoned or used property. Said wall shall be at least six feet in height as measured from highest adjoining grade; greater height may be required if the project creates noise impacts that will require an acoustical consultant report. 13. SCREENING All mechanical and other equipment on the building or on the site shall be screened so they are not visible from public street areas or adjoining developments. Screening materials/colors shall match building features and materials. The height of the screening shall be taller than the height of the mechanical equipment that it is designed to screen. The location of equipment and necessary screening shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 14. TRASH AND DELIVERY ACTIVITIES A detailed refuge and truck delivery plan must be prepared by the applicant. The plan shall specify locations of trash facilities, refuge pick up schedules and truck delivery schedules and routes. All trash facilities must be screened and enclosed to the satisfaction of Public Works Department. The final plan shall be submitted to the -City for review and approval prior to issuance of building permits. U-2006-03 July 21, 2006 5 15. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other .exactions. You are hereby further notified that the 90 -day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90 - day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. . 17. SIGNAGE Signage is not approved with this permit application. Signage shall conform to.the City Sign Code. 18. RECYCLING FACILITIES The developer shall make provisions for recycling facilities, which shall be in accordance with Chapter 19.81 of the Cupertino Municipal Code. 19. PUBLIC ART Prior to occupancy, the applicant shall set aside .25% (up to $100,000) of the total project budget for on-site art. PERVIOUS PAVERS The applicant shall install pervious pavers in lieu of asphalt pavement on site, if they are in compliance with Fire Department requirements. BEST MANAGEMENT PRACTICES Utilize Best Management Practices (BMP's), as required by the State Water Resources Control Board, for construction activity, which disturbs soil. BMP plans shall be included in your building plan submittals. 22. EROSION CONTROL PLAN The applicant must provide an erosion control plan with the building permit submittals. The City must approve this plan prior to the cominencement of any construction on site. 23. BUILDING PERMIT APPLICATION The applicant will be required to obtain Public Works Department approval for any on site construction via the building pen -nit process. A stone drain fee of $4,013.40 would be required in addition to the standard fees assessed in accordance with the Public Works Department review. 24. DRAINAGE All drainage shall be provided to the satisfaction of the City Engineer. 25. ABANDONED WATER WELLS The property owner shall seal abandoned or unused water wells if the City, after consultation with the Santa Clara Valley Water District, detennines that said abandoned or unused water wells have a potential to contaminate the water supply. 26. SANITARY DISTRICT The applicant shall be required to comply with the requirements of the Cupertino Sanitary District, which shall include the following: a. Abandonrnent of the existing sewer service for the project site to the property line. The abandonment plans shall be submitted to and reviewed by the Sanitary District. b. Additional Sanitary District fees and/or permits shall be required for the proposed improvements. c. lrmprovement plans for the subject property shall be reviewed by the District. A District Plan Checking and Irispection Deposit may be required. U-2006-03 July 21, 2006 7 The Architectural and Site Approval conditions are as follows: SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 27. APPROVED EXHIBITS The recommendation of approval is based on Exhibits submitted by RHL Design Group, Inc. dated March 21, 2006, consisting of 21 sheets including a Site Plan, Floor Plans, Elevations, Colored Elevations, and Preliminary Landscape Plan, except as may be amended by the Conditions contained in this Resolution. 28. DEVELOPMENT APPROVAL Approval is granted to construct two new three-story buildings consisting of 74,511 square feet for Building A and 80,742 square feet for Building B for use as a mini -storage facility. 29. PARKING The applicant shall provide a minimum of 80 parking spaces on site, in accordance with the parking study prepared on March 20, 2006 by TJKM Transportation Consultants. 30. LANDSCAPE PLAN The applicant shall submit detailed landscape and irrigation plans to be reviewed and approved by the Design Review Committee (DRC) that: a. Provide additional trees within the landscape area on the Cal Trans Iriterstate 280 right-of-way adjacent to the northenl property line of the project site. The applicant shall work with Cal Trans to secure approval for planting of these trees along the project site on Cal Trans property. b. Provide additional trees within the planter areas on site and around the perimeter of the site to mitigate the privacy .impacts of the project from the adjacent residential neighborhoods. c. Provide landscaping along the masonry wall separating the project site froiia adjacent residential uses. Landscaping shall consist. of a combination of trees, shrubs and/or climbing vines that will enhance the privacy screening for the adjacent residential uses. 31. TREE PROTECTION As part of.the demolition or building permit drawings, a tree protection plan shall be prepared by a certified arborist for the trees to be retained. In addition; the following measures shall be added to the protection plan: > For trees to be retained, chain link fencing and other root protection shall be installed around the dripline of the tree prior to any project site work. No parking or vehicle traffic shall be allowed under root zones, unless using buffers approved by the Project Arborist. U-2006-03 July 21, 2006 8 ➢ No trenching within the critical root zone area is allowed. If trenching is needed in the vicinity of trees to be retained, the City's consulting arborist shall be consulted before any trenching or root cutting beneath the dripline of the tree. ➢ Wood chip mulch shall be evenly spread inside the tree projection fence to a four - inch depth. ➢ Tree protection conditions shall be posted on the tree protection barriers. ➢ Retained trees shall be watered to maintain thein in good health. ➢ A covenant on the property shall be recorded that identifies all the protected trees, prior to final occupancy. The tree protection measures shall be inspected and approved by the certified arborist prior to issuance of building permits. The City's consulting arborist shall inspect the trees to be retained and shall provide reviews before building permit stage, during construction and before final occupancy of the garage. A report ascertaining the good health of the trees mentioned above shall be provided prior to issuance of final occupancy. 32. TREE PROTECTION BOND All trees that are not required to be removed shall be covered by a tree protection bond. A tree protection bond in the arnount of $50,000 shall be provided prior to issuance of demolition or building permits. 33. LANDSCAPE REVIEW The applicant shall submit a comprehensive landscaping plan, including water conservation and pesticide reduction measures, in conformance with Chapter 14.15, Xeriscape Landscaping and the pesticide control measures referenced in Chapter 9.18, Stonnwater Pollution Prevention and Wartershed protection, of the City Municipal Code. 34. BICYCLE PARKING The applicant shall provide bicycle parking and bike racks for the proposed project. The number of bicycle parking spaces and location of bike racks shall be determined by the Director of Community Development. 35. UNUSED BUILDING MATERIALS In lieu of disposing of unused building materials for the construction of the project, the . applicant shall be required to recycle the unused building materials. 36. BUILDING MATERIAL RECYCLING The existing building and site materials shall be recycled to the .rnaximum extent possible subject to the review by the Building Official. Proof of recycling shall be submitted to the City for review prior to final occupancy. ' 37, DEMOLITION REQUIREMENT All existing structures on the site shall be removed prior to or concurrently with project construction. The developer shall assume the responsibility to obtain all required demolition permits in accordance with City Ordinances. MASONRY WALL A six-foot masonry wall shall be provided on the project's mutual boundary with residentially zoned or used property. Said wall shall be at least six feet in height as measured from highest adjoining grade; greater height may be required if the project creates noise impacts that will require an acoustical consultant report. 39. SCREENING All mechanical and other equipment on the building or on the site shall be screened so they are not visible from public street areas or adjoining developments. Screening materials/colors shall match building features and materials. The height of the screening shall, be taller than the height of the mechanical equipment that it is designed to screen. The location of equipment and necessary screening shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 40. TRASH AND DELIVERY ACTIVITIES A detailed refuge and truck delivery plan must be prepared by the applicant. The plan shall specify locations of trash facilities, refuge pick up schedules and truck delivery schedules and routes. All trash facilities must be screened and enclosed to the satisfaction of Public Works Department. The final plan shall be submitted to the City for review and approval prior to issuance of building permits. 41.
