Subject: Director's Minor Modification, DIR-2008-06, to a Use Permit (2-U-81) to
construct a 120 square foot addition to within 9'6" of the rear property line in a
Planned Residential P(Res 4-8) zoning district, at 22760 Medina Court.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
BACKGROUND:
The applicant is requesting a Director's Minor Modification DIR-2008-06 to a use permit
(2-U-81) to construct a 8'-2" X 14'-4" (120 square foot) addition to an existing two-story
single-family residence in a Planned Residential P(Res4-8) zoning district.
The subject property is located south of Stevens Creek Boulevard and west of Foothill
Boulevard, at the back of Medina Court, and is part of a 37-unit planned development
originally constructed in 1984.
DISCUSSION:
The property owners are requesting to add 120 square feet to an existing kitchen on the
first floor. The proposed kitchen addition will be located along the rear side of the
residence, following the existing rear setback of the residence. Because the lot is not
typical in shape, the existing private outdoor space is located at the left side portion of
the lot and would not be decreased in square feet due to the addition.
The residence currently equals 3,058 square feet, and has a 36% FAR. With this new
addition, the FAR will be 37.8%, which is below the previously approved Floor Area
Ratio for this Planned Development. Staff believes the 9'-6" rear setback is not
significant, because the addition is a continuation of the existing setback and there is
ample usable outdoor space due to the atypical shape of the lot. The addition is also

buffered by mature landscaping, a11d a 9'-0" fence. The project complies with all other
requirements of t11e use permit (2-U-81) that approved the development within this
neighbor11ood. In addition, the applicant contacted all adjacent property owners and
provided their signed conse11t of the project.
ACTION:
The Director of Commu11ity Development deems the modification minor and approves
the addition to the residence.
This approval of the modification is effective April 17, 2008. The fourteen calendar day
appeal period will expire on April 30, 2008.

Dear Resident,
The City of Cupertino Planning Division received an application (file number DIR-2008-
06) for a Director's Minor Modification to a Use Permit (2-U-81) to construct a 120
square foot addition to within 9' 6" of the rear property line in a Planned Residential
Development, located at 22706 Medina Court. This application requires staff approval
and adjacent neighbors are notified with the opportunity to comment on the project.
The proposed project conforms to the Single Family (R1) Ordinance (Chapter 19.28 of
the Cupertino Municipal Code), development regulations and landscaping regulations.
The Director of Community Development deems the modification minor and believes
that the project is compatible with homes in the neighborhood and intends to approve
the project based on the enclosed plans.
