JOINT STUDY SESSION- CITY COUNCIL AND PLANNING COMNIISSION 1. General Plan A. Urban design study session Community Development Director Steve Piasecld highlighted the general plan review process and explained that the purpose of this session was to evaluate development options that might achieve multiple objectives of building a safe, balance, connected and walkable community. He said that the City Council agreed that the theme of the general plan update is building community, in which growth is directed in order to achieve community objectives. An urban design finn, Peter Calthorpe and Associates, was hired to brainsto.~.~ with the City Council and Planning Commission on this topic. The presenter was Matthew Taecker. Taecker described 4 planning principles (1) diversity and balance (holistic approach to community); (2) human scale (how people perceive their environment to be safe, inviting and pedestrian friendly); (3) conservation and restoration (understand assets embedded within each community in order to build on those assets); (4) larger context (how a community fits into a larger setting). Taecker talked about opportunity areas that wea-e ideotified by staff and prese.~ted case studies to highlight some of the possibilities and practical dimensions of new development and re- April 30, 2001 Cupertino City Council Page 2 development in these areas. These areas included (1) new development (large, vacant pieces of land) for mixed me/office campuses; (2) aging shopping malls; (3) community college facilities; (4) strip commercial areas (thirtner, shallower lots oriented foward highways); (5) boulevards (larger streets to shape future development). Items summarized under the mixed-use/office campus opportunity included thinking about the pace and rate of renovation, maintaining a balance of jobs and housing, working from a market standpoint, accessibility to shops (parking and visibihty), persuading corporate offices to integrate to mixed use, checking growth parameters (complete change vs. infill), bringing the community together and making it walkable. Aging shopping mall items included the Vallco mall and Cupertino Center transition, potential resistance to private developers such as De Anza College, resistance to walkability, and balancing safety and s~curity. Strip commercial items included thoughts about redevelopment money, developer/city involvement in planning, signage and street,scape plans, and street design standards for walkability. ' Boulevard items included free-flowing right turn lanes as a problem for pedestrians (street design standards for walkability) and connectivity of streets. General comments included how to communicate the desirability of urban vs. suburban, retail hierarchy, learning fi'om what didn't work, infrastructure costs, pace of development, advocating the need for development and communication (cooperative ventures and constituencies). The Santa Clara County Sheriff's Department showed a videotape made by the students illustrating the "Every 15 Minutes" program which uses a simulated drunk-driving accident to teach students about the danooerS of drinking and driving, and the aftermath that affects family and fi'lends. Commander Jeff Miles and Deputies Janet Shannon and Eileen Phares, the two School Resource Officers, introduced the video and discussed the program. Mayor James said the program is a wonderful example of partnerships, which include the City of Cupertino, the sheriff's department, the fire fighters, the vmergency services and Valley Medical Center. 3. Report by the Cupertino Bicycle and Pedestrian Advisory Committee (BPAC) of 2000 accomplishments and proposed 2001 goals. David GreY, stein, chairman of the BPAC, gave thc report. Their goals fi'om last year include (1) Adopt a Pedestrian TrAnsportation Plan; (2) Promote the Bicycle Transportation Plan (86.5% funding was accomplished for this goal); (3) Bike to Work Week. This was promoted well, but participation was down due to weather. (4) Advocate thc development of the Mary Avenue bicycle footbridge. This goal was achieved. (5) Thc Union Pacific Railroad Trail, which was also accomplished; (6) The Stevens Creek Recreational Trail, which has a task force handling its progress. The goals for 2001 include: (1) Complete the Pedestrian TrAnsportation Plan and present it to City Council; (2) Monitor the Bicycle Transportation Plan; (3) Promote bicycling in Cupertino, including Bike to Work Week, Safe Moves in the schools and for the seniors to promote safe cycling and advertising the wcbsite; (4) Facilitate thc feasibility study of the Mary Avenue bicycle footbridge; (5) Support the UP Railroad Trail. The Regnart Creek Trail is a proposed trail, starting at City Hall and going to Creekside Park; and (6) Participate in thc Stevens Creek Trail. Thc overall objeotivc of thc BPAC is to encourage walking and bicycling as a safe, practical and healthy alternative to the use of the family car. Council members acknowledged the hard work of the committee and congratulated the members on their accomplishments. 4. Presentation of a monetary contribution for improvements at Blackben'y Farm by Lion's Club representative John Kolski. Mr. Kolski was not able to be present, so this item was continued to the next meeting. POSTPONEMENTS May 7, 2001 Cupertino City Council Page 3 WRITTEN COMMUNICATIONS The City Clerk distributed a page missing from Item 24 (second page of a letter from Paula Belden) regarding the Lake Biltmore item. ORAL COMMUNICATIONS A. Sandra Yeaton of 10519 Sterling Blvd. spoke about noise problems from a neighbor's sub-woofer. He provided a copy of a noise ordinance from the City of Santa Rosa and asked Council to adopt similar provisions. Administrative Services Director Carol Atwood said the Sheriff's Office has responded to this residence 15 times, thc City's Code Bnforcement officers have responded six times and Code Enforcement Officer Alcx Wykoff has been driving by the residence on a regular bfi~is to ascertain whether there is any noise coming from the residence. Sound readings have been taken 6 times and none of the readings constituted code violations under the city's municipal code. Yeaton explained that thc decibel meter won't accommodate the kind of sound that needs to be measured, which is the low level setting, rather thsn the high frequency sound which has already been measured. The proposal was to ask for the low level frequency to · -- be able to bc measured. James directed staff to look into this proposal. B. Gordon Frolich of 1202 Bellmap Court spoke about his problem with GTE Verizon charging utility taxes on his mobile phone. The problem has been resolved due to planetfeedback.com looking into this issue and handling the complaint. He also talked about a problem with parking and congestion on the street near Regnart School. Only one car can pass on the street when cars are parked there and he is concerned about emergency services not being able to get through. James directed staff to look into this problem. Harry Greenwood of 1609 Hacienda Avenue of Campbell congratulated the City in its effort for a successful Cherry Blossom Festival. CONSENT CALENDAR Chang moved to approve the items on the Consent. Senior Planner Colin Jung reviewed the staff report. He compared city and county development stand-rds; reviewed legal, non-conforming issues; and discussed the assignment of appropriate zoning lot sizes consistent with the City's General Plan. He noted that both the Planning Commission and staff recommend approval of this prezoning. Lowenthal asked if there were any issues, sub-divisions or applications that need to be grandfathered into the project. Jung said that the county zoning prohibits this because the lot size range is appropriate for the city's RI-10 prezoning. Anythirig constructed with a building pe,uit would be considered legal in the City of Cupertino. The following individuals spoke in favor of the annexation. Their reasons for supporting it include the right to pay lower resident fees for recreation classes, to have their tax dollars support the parks, to be able to serve on Cupertino commissions that have residency gequirements, receive city services such as street sweeping and improved road maintenance, and to vote in Cupertino elections. It was noted that an active community group was fomied to support the proposal, called Garden Gate Neighbors for Annexation, and this group has a lot of enthusiasm and energy, which can serve Cupertino in other ways as well. Bumett said this issue reminded him about the time when his neighborhood was being annexed and that the community rallied its support. That organization is still in effect today. He thanked Don Weden ii'om the County Planning office for helping to make this happen. James said that woridng together on this issue brought the community together to fo,u a bond and a partnership. Appeal of Planning Commission decision regarding Applications 11-Z-98 and 14-U-98, Lake Biltmore, located at 10159 South Blaney Avenue (APN 369-03-008). Appellant lohn Moss. The City Clerk distributed a page missing from Item 24 (second page of a letter from Paula Belden) regarding the Lake Biltmore item. A brief video mil-in was shown. Senior Planner Vera C-il reviewed the staff report and explained that the applicant was requesting permission to permanently drain the ponds and replace th~u with amenities such as landscaping and a tot lot. She mentioned some conditions that staff suggested the Council take into account if they approve the appeal, in order to protect the resident ducks by having them removed in a safe manner. She reviewed the proposed features and the staff's recommendation for pedestrian access to the site, which would be voluntary by the developer. C-il said that the Planning Commission's denial of the request was based on testimony by a neighbor, Mr. Monk, who spoke about the aesthetic quality of the man-made lakes and his concern about the method used to survey the Lake Biltmore community. Gil noted that staff had reviewed the survey before it was distributed to the residents and felt that it encompassed everything that was needed. The survey results reflect that most of the residents preferred having the lakes removed in order to bring other amenities, such as a tot lot and picnic benches. Stsffrecommended to the Planning Commission that the lakes be removed and filled in with landscaping. Gil reviewed the history of the project and said that at one point the lakes were drained during this construction process. Currently, Prometheus is back before the Planning Commission and the City Council to keep the lakes permanently drained and have th~, removed. Jon Moss, representing the applicant, Prometheus, said that two years ago the City denied their request to remove the lakes in order to pursue the landscape plan. He was told that it would be reconsidered if Prometheus could illustrate that they had the residents' support through the form of a survey. Last November the survey was distributed to curr~t and new residents. Prometheus followed up by telephone and had a response of 44% to the survey, which he felt was significant. Moss said that the results of the survey showed that 80% of the residents who responded preferred the new landscape plan and he assumed the other residents who didn't respond didn't have a strong opinion one way or the other. -- Moss said he felt the survey was unbiased, especially since the City had reviewed it ahead of time. However, Prometheus is not opposed to another type of survey being distributed to the residents. May 7, 2001 Cupertino City Council Page 8 Moss laid out 5 masons to go ahead with the landscaping plan. 1. To create more useable open space 2. Increased safety (there are now more children living in the community) 3. The lakes must have chemicals added to keep them free of algae and require significant amounts of water 4. The plan for landscape improvements is consistent with other improvements that Lake Biltmore has done and is doing to modernize and upgrade the complex $. The majority of the residents prefer the proposed plan. He said that all the residents were sent notices for the Planning Commission meeting. One resident spoke in favor and no residents spoke in opposition. He said that if Council is not in favor of the current plan, perhaps they would approve an alt~mtive plan allowing removal of some of the lakes but keeping the ones in the center of the complex. Barbara Langworthy of 20030 Rodrigues Ave. #K took issue with the way the survey was written because it was impossible to vote to have new amenities and keep some of the lakes. She was in favor of keeping at least one lake, if the Council decides to uphold the appeal. ' George Monk of 19985 Price Avenue was opposed to the removal of the lakes and referred to a letter he had written to the Planning Commission in March. He felt there were no compelling reasons to fill in the lakes, and also said that the survey is leading. He disagreed with the developer saying that filling in the lakes would create more open space, because 14 new apmh~.ents are being currently built on open space. Lowenthal said that the only issue was trying to find out what the residents really want. He was opposed to building a security gate where it is proposed, but there is no legal basis to stop this fi'om going in. He said that he doesn't think the owners have really talked enough with the residents to find some common ground. Bumett said that the survey doesn't provide enough choices. He said that keeping the center lake sounds like a good compromise and that will keep the development's unique feature. He would support the compromise suggestion. Chang said that the two issues are what the residents and the owner want and the process of carrying this out. He asked about the role the City played in approving the survey because it didn't look very even to him. Director of Community Development Steve Piasecki said that staff had asked the developer to keep the survey simple and make it possible for people to indicate a clear choice. Staff felt that had been achieved. Chang said that he would like to see tighter, more credible surveys. He said that the survey did seem to gauge what the people wanted and he felt that preserving some of the lakes makes the most sense to him while still allowing for some of the other amenities. May 7, 2001 Cuperlino City Council Page He said he would also 1/ke to see an casement as a condition to this proposal, and have the residents become more involved in the process. James noted for the record that her son had been living in Lake Biltmore apa~h,,ents, but would be leaving in two days, and that she has no financial interest in the matter, nor did she know how her son felt about this issue. James said that she feels that since the residents do not own the land, the owner has the right to develop the pwperty and the Council shouldn't legislate it. She also didn't think that an easement was required since anyone can walk through the property currently and that a sidewalk exists half a block away. She agreed with the compromise plan. Lowenthal said he was concerned about the split of the council and wanted to make the access issue separate from the lake issue. Council concurred on this point. City Attorney Chuck Kilian clarified that if the Council is split on this issue as a 272 vote, then the decision of the Planning Commission stands. Lowenthal'moved to allow thc developer to reiiiove all but the center lakes, keeping the conditions recommended in the model resolution, with the exception of Sec. WI, paragraph 6, Pedestrian Access. Bumett seconded and the motion carried 4-0. · -' Public access through the property was discussed. Moss was concerned about safety for the residents in the back of the project with public access. Kilian felt this requirement would not hold up under defense, and that thc developer seems willing to provide access for the residents through the area. The developer agreed. Burnett said that he thought access for the residents was important. He saw no reason to put a gate up and didn't feel there was a safety issue. Lowenthal moved to accept the first paragraph of condition 6 of the model resolution as written, providing for a paved pedestrian path through the proPerty to the mutual gate being provided by the adjacent property owner. Bumett seconded and the motion carried 4-0. 25. Rezoning and modification of a use permit to change appwximately 3,000 square feet from the Forum property P (Institutional) to Oak Valley properties P (Residential). The motion carried 4-0. PLANNING APPLICATIONS UNFINISHED BUSINESS NEW BUSINESS 26. Review of bids and award of contract for Pawment Restoration, Project No. 2001-02. Pubhc Works Director Ralph Quails explained that the annual pavement restoration project provides for a variety of replacement of surface areas on streets. The project should be dhanged to the 2000-2001 adopted budget. Lowenthal moved that City Council award the project to the low bidder, Silicon Valley Paving, Inc., in the amount of $170,$40.20, and authorize a contingency of $17,000.00 for a total project cost of $187,$40.20. Bumett seconded and the motion carded 4-0. 27. Schedule dates for two budget study sessions. Administrative Services Director Carol Atwood said that one session is already scheduled for Wednesday, May 30 at 4:00 p.m. and wants to add another study session to discuss the CIP programs and effects on operating costs for any new programs that Council would be discussing. Council concurred to hold study sessions on May 23, 4:00 p.m. and on May 30, 4:00 p.m. 28. Report on California Housing Finance Agency (CHFA) loan for Cupertino Community Services (CCS) and iss~_~__~_ ce of tax-exeiiipt bond financing. Administrative Services Director Carol Atwood reviewed the staffreport and said that the City was awarded the $2 million as a 10-year loan with 3% interest, but that it will result in a general obligation of the City's General Fund so we would be responsible for any un- funded principle and interest payback/n that 10-year period, estimated at $700,000. The City would prefer'to provide as much money up front for the CCS Affordable Housing Project without continuing to tie the City and its General Fund to this project for a long- teLm basis. Council has already approved monies from the Community Development Block Grant (CDBG) program and the Below Market Rate (BMR) pwgram and staff asked Council to decline the CI-IFA loan and to direct staff to issue tax-exempt bond financing, which would benefit CCS with a lower interest rate. Cupertino National Bank will buy the entire bond so it would be a private placement bond, the City can step out of the scenario and it becomes the obligation of CCS. Ma), 7, 2001 Cupertino City Council Pal~c 11 Council concurred to decline the CHFA loan and directed staff to issue tax-exempt bonds for the affordable housing project. 29. Request for 5-year extension of intemet sales tax agreement with Apple Computer. Administrative Services Director Carol Atwood reviewed the staff report and said that the agreement provides the City an average of $1.1 million in sales tax per year as opposcd to $290,000 prior to the agreement. Staffis looking for direction from Council. Mike Foulkes, from Apple Computer, said that Apple believes that this is a win/win agre¢iaeat for both the City and Apple Computer. Council concurred that the partnership with Apple has helped the community of Cupertino and they agreed to extend the agreement. ORDINANCES 30. Public Works Director Ralph Quails ~viewed the staff report and explained that Council had directed staff to revise the scope of the project to stay within the construction budget May 7, 2001 Cupertino City Council Page 12 of $1,000,000.00. The scope has been amended to a more basic improvement program with constant pavement cross-section on the roadway, and a minor paving and drainage project from San Lucia Avenue to Miramonte has been included. The combined budget for the two projects is $945,000. Brian-Kangas-Faulk will prepare a final Engineer's Estimate when the construction drawings have been completed. Council concurred to receive the report. 33. Report on proposal for gateway monument in the intersection of De Anza Boulevard and Stevens Creek Boulevard. Public Works Director Ralph Quails reviewed the staff report and said that if turn lanes were removed to accommodate a gateway feature in the intersection, the traffic level of service would degrade to level F at all four approach moves including all left turns, and there may be an increased potential for accidents. Another option for a relevant gateway location is the Four Seasons Plaza, which will be in conjunction with the Kimpton Hotel and Prometheus Housing projects. Council directed staff to discontinue any further pursuit of a mid-intersection monument at Stevens Creek and De 3,nTa and report back to Council in the fall of 2001 or the early part of 2002 with proposals for a gateway feature in the design of Four Seasons Park. COUNCIL REPORTS Lowenthal said he attended a meeting at the Chamber of Commerce with Rebecca Colin and they talked about the energy crisis. Cohn said to not expect any vehicle license fee backfill from the state because there will be no surplus. She said also to not expect any ERAF relief. He said that the Union Pacific Railroad Task Force was making good progress and they were ready to meet with the railroad to begin negotiations; he and Mayor James met with Jim Bell to talk about the Saratoga/San Tomas Creek Trail; and the Stevens Creek Trail Task Force has had 2 meetings. They are working on the alignment of the trail and getting thc community involved. Lowenthal said he attended thc Employee Service Awards meeting, the ABAG General Assembly, and the Rotary Golf Tournament. He noted that the Animal Control JPA has selected a general manager. A hearing for fines and fees regarding animal control will take place at the Santa Clara City Council Chambers on May 21. James said she attended thc retirement breal~fast of Captain Chris Donovan fxom the Fire Service. The Fire District also hosted the West Valley City Managers and Mayors luncheon and she and City Manager David Knapp attended that. BACKGROUND~ The following is a summary of bids received for the referenced project: Bidder Bid Amount Engineer's Estimate $202,106.00 Republic Electric $153,940.00 G.A.B. Construction, Inc. $148,475.00 The Wolfe Road Project will provide bicycle facilities where none existed, new signing, striping, and install bicycle detection at signalized intersections. The Bollinger Road Project will also provide bicycle facilities where none existed, upgrade existing bicycle facility, new signing, better signing, striping, and install bicycle detection at signalized intersections. Both projects will implement the City's Bicycle Plan. The City has received funding for Wolfe Road from the Transportation Fund for Clean Air (TFCA) Regional Program Funds and Transportation Development Act (TDA). The TFCA program provides 100% funding, which is $225,000.00. The City also received funding for Bollinger Road from the Transportation Fund for Clean Air (TFCA) Regional Program Funds, which is $140,000.00 and a local matching fund of 25% by the City, which is $35,000.00 (City General Fund). The low bidder is G.A.B. Construction, Inc. in the amount of $148,475.00. A 10% contingency of $15,000 is requested for unforeseen conditions and additional work as may be detemiined during the course of the work. Whenever the City receives a new transportation grant, Caltrans requires execution of Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements, or Fund Transfer Agreements and any amendments, with specific special covenants for each particular project. This resolution will authorize the City Manager to execute those agreements and amendments when necessary for the receipt of Federal and State funding. This Law Enforcement Services Plan is developed to satisfy these provisions of the Law Enforcement Contract. Resvonsibilitv Under thc Contract, it is the responsibility of the Sheriffto provide services to the City, in accordance with this plan. The Sheriff is solely responsible for the administration and supervision of all such services provided under the Contract. During the teu~ of this agreement, the City agrees not to contract with or purchase from any other entity, public or private, for law enforcement services without the cxpress consent of the Sheriff. Service Levels Service levels, referred to herein, are det¢.,,ined by the amount of reported hours provided and charged to the City under the te,,,,-~ of the Contract in each of the service categories of General Law Enforcement, Investigative Services and Supplemental Services. General Law Enforcement includes the patrol of established beats and response to emergency calls and other calls for service. Plan of Patrol The patrol established beats will be provided for by the assignment to specific geographical areas of the City by Sheriff's patrol units. Beat responsibility maps will be pwvided to the City as updating occurs. Based on the current Deputy Sheriff's Association Contract, the Sheriff's Field Operations Division, Patrol Section, employs a ten-hour workday for its sworn personnel. Patrol hours, will be conducted with marked patrol units, unmarked patrol units, motorcycles, and specialized units distributed by the West Valley Commander as to the shifts, hours, and days of the week to fulfill the contract and special needs. Priority 3: Any crime which exceeds in time limits of priority 2 (more than 15 minutes for crimes against persons or more than 10 minutes for crimes against property) or other situations which requires the response of a Deputy Sheriffin a timely manner. Prior/tv 4: Any call for service that does not require a timely response by a Deputy Sheriff. Average response time has some value in wei~hlng the issue of the number of patrol units assigned to an area. The average response time is affected by several factors: 1. The elapsed time from when the call is received by County Communications until it is dispatched to a patrol unit. 2. Need for an immediate response based on init/al reported/nformat/on. 3. Unit availability during peak t/me periods. 4. Call stacking by priority/nature of reported information. Plan of Service Delivery -- Page 3 FY 2000 - 2001, City of Cupertino Investigative Services West Valley Detectives will be responsible for handling fraud, forgery, embezzlements, assaults, auto theft, juvenile cases, missing persons, sexual assaults and all property crimes. Domestic violence, robbery, and homicide cases will be handled by Headquarters Detectives due to the specialized training requirements. The initial case investigative responsibility for all reported crimes, misdemeanor and felony, is with the responding patrol officer. The length and/or depth of this initial investigation depend on the time availability of the patrol officer. Cases requiring extensive follow-up investigation are routed to the West Valley Detective Section or assigned to appropriate beat units. Investigative services to the City of Cupertino will be provided by the Investigative Service Division. The Investigative Services Division, organized by investigative case specialization, investigates most felony and certain serious misdemeanor crime reported to the Sheriff's Department on a weighted case management basis. The Patrol Section conducts follow-up into misdemeanor and traffic investigations by case assignment to appropriate beat units. All reported felony and certain serious misdemeanor cases are assigned to an investigator for control purposes. Those cases showing no solvable case characteristics are case controlled and monitored by an assigned investigator, assisted by appropriate beat units. Not every felony or serious misdemeanor case can be successfully investigated to a conclusion. Those cases that indicate appropriate characteristics are focused upon to maximize the use of investigative time and cost. Other Law Enforcement Services Traffic investigations shall be handled by the two investigators assigned to the West Valley Station. These charges are now included in the West Valley Station overhead and shared by the three contract cities and the unincorporated areas based on percentage of total, general enforcement hours. Plan o£ Service Del]very -- Page 4 FY 2000 - 2001, City of Cupertino The Patrol Section, in fulfilling its responsibilities, provides other services to the City as needed to meet it commitments. Specialized services available to the City include: Hostage Negotiations Unit Sheriff's Emergency Response Team Underwater Recovery Unit Search and Rescue Unit Narcotics Unit Criminal Intelligence Unit Canine Unit (including narcotics dogs) Bomb Unit (ordinance) Coordinating agency and provided logistics for Auto Thef~ Task Force Sexual Predators Task Force Domestic Violence Task Force Although such units are not routinely used, their existence enhances the capabilities of the Patrol Section in its delivery of services. Special events, which are mutually identified by the Sheriff and the City, shall be charged at the actual costs of the event. Limitation of Char~es for 2001 - 2002 Cost recovery of unanticipated special events, requiring si~ificant increases in service provided to the City shall be negotiated by the Sheriffwith the City Manager. For fiscal year 2001-2002, the amount of service (chargeable hours) anticipated by category is shown in Appendix A. The 2001-2002 hourly rate shall remain in effect until July 1, 2002. Hourly rates will be provided in Appendix A. The new Appendix A shall be delivered to the City in accordance with Section H of the Law Enforcement Master Contract. Sheriff and City agree to follow these priorities and pursue the objectives. 1. Maintenance of Average Response Time Maintain thc annualized average response time for priority 1 and 2 calls for services at or below 7 minutes. 2. Monitor Serious Crime The Sheriff shall monitor the incidence of serious crime within the City by reporting districts and will: a. Focus additional patrol in areas of significantly higher activity in an effort to reduce such incidence level; and b. Report to the City such developments, including recommendations on measures to reduce these levels. 3. Review of Priorities and Objectives Review, on a quarterly basis, or as otherwise desired, priorities and objectives with thc City or its representatives. The above Plan of Service for 2001-2002 is hereby approved. It is the intent of the Sheriff to provide services according to this Plan, subject to the terms and conditions of the Law Enforcement Contract. RECOMMENDATION: Staff recommends that the City Council initiate reorganization proceedings for the territory designated Garden Gate 01-02, and set a public hearing date of July 2, 2001 BACKGROUND: .4nnexation Strate~ On Febvmry 2, 1998, the City Council adopted an overall annexation strategy for three of the larger unincorporated pockets in Cupertino: Rancho Rinconada, Garden Gate and Monta Vista (Exhibit A). That Strategy outlined a procedure for annexing Garden Gate in the event a Rancho Rinconada annexation was successful. The City was to encourage Garden Gate residents to petition for annexation; then the City would initiate prezoning and annexation of the area at no cost to the residents. Subsequently: A) Rancho Rinconada was annexed in March 1999, B) A group of Garden Gate residents petitioned the City for annexation on December 6, 1999 (Exhibit B), and C) The City Council directed staffto initiate prezoning on Februay 13, 2001 and adopted a prezoning of pre-RI-10 for Garden Gate on May 7, 2001. Public Outreach Staff has done extensive outreach with Garden Gate property owners and residents, which has included: A) The mailing of the "Garden Gate Annexation Answer Book" in early January 2001 and a "Garden Gate Annexation Update" in March 2001; B) A City-sponsored neighborhood meeting at the Quinlan Center on January 24, 2001; C) A web page on the City of Cupertino's website that provides information on upcoming meetings, answers to commonly asked questions, and documents on- line; and D) Attendance at resident-sponsored neighborhood meetings. DISCUSSION: City Taxes and Fees In consultation with the City Attorney and in reliance on a recent legal opinion of the State Attorney General, the City will not be conducting separate elections on the extension of City taxes to this area, as was done in Rancho Rinconada. Garden Gate residents and property owners will be fully informed of the extension of City taxes and fees to their area in the annexation public heating noticing. The requirements of Proposition 218 (Taxpayers Right to Vote on Taxes Initiative) will be satisfied by the protest provisions available in annexation law, that is, legal protests to the Garden Gate annexation serve as proxy votes on the extension of City taxes to this area. Next Steps This annexation project is nearing completion. The next steps in the process are as follows: May 21, 2001: City Council initiates proceedings; protest period begins. July 2, 2001: City Council holds annexation hearing. If less than 25% protest, then the Council may order in the annexation. If protests are greater than 25% but less than 50%, then the Council must schedule an election. If more than 50% protest, than the annexation is terminated. Est. July 28, 2001 If the Council is able to order in the annexation, the Local Agency Fo,~ation Commission (LAFCO) executive officer should have certified the proceedings, making the annexation official. WHEREAS, the City Council of the City of Cupertino has received a request for annexation of territory designated "Garden Gate 01-02" from property owners; and WHEREAS, the property, 107+ acres located in the unincorporated area generally bounded by Greenleaf Drive, Beardon Drive, Elenda Drive, Hazelbrook Drive, Ann Arbor Avenue, Gardena Drive and Stelling Road, commonly referred to as Garden Gate is contiguous to the City of Cupertino and is withi, its urban service area; and WHEREAS, ---exation would provide for use of City services; and WHEREAS, the following City taxes and fees will be extended to this area upon ._. annexation and the residents and property owners of Garden Gate will be duly notified in advance. The taxes and fees are: 1) The Utility Users' Tax, which is currently 2.4% of the natural gas, electricity, local and long distance telephone charges. Homeowners age 65 or over may apply for a utility users' tax exemption at City Hall. 2) The Stom~ Drainage Service Fee, which is currently $12.00 per residential parcel. 3) The Business License Fee applies if you have a home business in Cupertino. The annual fee is currently $94.00 for most home businesses. WHEREAS, this t~ritory is inhabited and was prezoned on May 7, 2001 to City of Cupertino Pre-R1-10 zone; and WHEREAS, the City of Cupertino, as Lead Agency for environmental review completed an initial study and lp~nted a Negative Declaration for reorguni~tion; and WHEREAS, the County Surveyor of Santa Clara County has found the map and description (Exhibits "A" and "B") to be in accordance with Government Code Section 56826, the boundaries to be defmite and certain, and the proposal to be in compliance -- with LAFCO's road annexation policies; and Resolution No 01-117 Page 2 WHEREAS, the County Assessor of Santa Clara County has found the boundaries of the proposed reorganization described in the aforementioned map and description conforming to Frees of assessment or ownership; WHEREAS, the fee set by the County of Santa Clara to cover staff cost for above certifications have been paid; and WHEREAS, as provided in Government Code Section 56826 the City Council of the City of Cupertino shall be conducting authority for a reorganization including an annexation to the City; and WHEREAS, Government Code Section 56837 provides that if a petition for annexation is signed by all owners of land within the affected territory the City Council may approve or disapprove the nnnexation without public hearing; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Cupertino hereby initiates reorganization pwceedings and will consider annexation of the territory designated "Garden Gate 01-02" and detachment of the same from the Santa Clara County Lighting Service District at a public hearing on Suly 2, 2001. This would allow the majority on each side to'decide whethe!'' it wants to annex or not. A~nexa'tion of.panels within Monla Vista will be the most problematic or'the thre~ areas due to the number of s~parate pockets (20), the hard core opposition of some long-time residents to armexation and possible state law limitations or~ the ~eatiun of additional pockets. It is quite likely that the effort expended will be greatly disproportionate to the number of parcels annexed. Sr,~ recommends a measurect, but mote proactive -~nexation approach than used in the past. focusing on azme'xiag those who want to be azmexed, possibly along with some of those who are indi~erent. The City should conduct city-initiated az~exations only in those pockets that show a clear majority (silent and favo~ng) at. no cost to the property owners. When Monta Vista property owners are required to am~e~ because of pti~ate redevelopment a~tivities, staff suggests : that notices be sent to the other pool(et residents inviting them to piggy-back on the annexation · at no co~t to them. In addition, the City could agree to waive its annexation fees and pay the · County fees (about $2,700 total) if the annexing propen~ owner could persuade sufficient pocket .neighbors to also annex to th= City. C~sT-~72' ORDINANCE NO. 1879 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO PREZONING APPROXIMATELY 107 ACRES, DEVELOPED WITH SINGLE-FAMILY DETACHED RESIDENCES AND GENERALLY BOUNDED BY GREENLEAF DRIVE, BEARDON DRIVE, ELENDA DRIVE, HAZELBROOK DRIVE, ANN ARBOR AVENUE, GARDENA DRIVE AND STELLING ROAD, COMMONLY KNOWN AS GARDEN GATE, TO PRE-RI-10 (SINGLE-FAMILy RESIDENTIAL WITH A MINIMUM LOT SIZE OF 10,000 SQUARE FEET) ZONING DISTRICT WHEREAS, an application was initiated by the City (Application no. 03-Z-01) for the prezoning of property to PRE-R1-10 (Single-family Residential Zoning District); and WHEREAS, the property is unincorporated, within the City's urban service area and has no City prezoning; WHEREAS, the prezoning is consistent with the City's general plan land use map & existing uses; WHEREAS, the prezoning will enable the property owner to develop his property in accordance with City residential development standards; WHEREAS, upon due notice and after one public hearing the Planning Commission recommended to the City Council that the pre'zoning be approved; and WHEREAS, a map of the subject property is a~ehed hereto as Exhibit B as a proposed amendment to the Master Zoning Map of the City of Cupertino. NOW, THEREFORE, BB IT ORDAINED AS FOLLOWS: Section 1. That the property described in attached Exhibit A is hereby prezoned to PRE-RI-10, Single-family Residential Zoning Dislrict; and that Exhibits A & B attached hereto are made part of the Master Zoning Map of the City of Cupertino. Section 2. This ordinance shall take effect and be in force thirty (30) days after its passage. CITY OF CUPERTINO REZONING 3,220 SQUARE FEET OF FORUM PROPERTY FROM P(1NSTITUTIONAL) TO P(RES) FOR 23657 & 23667 BLACK OAK WAY WHEREAS, an application was received by the City (Application No. 2-Z-01) for the rezoning of Forum property from P(Institutional) to P(RES ); and WHEREAS, the rezoning is consistent with the City's general plan land use rasp, proposed uses and surrounding uses; and WHEREAS, upon due notice and after one public hearing the Planning Commission recommended to the City Council that the rezoning be granted; and WHEREAS, a map of the subject property is attached hereto as Exhibit A as a proposed amendment to the, Master Zoning Map of the City of Cupertino, NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS: Section 1.
