September 26, 1994, approving an architectural application according to the enclosed copy of Planning
Commission Resolution No. 4559.
Please be aware that an appeal of this decision can be made within fourteen calendar days of the

SF('TION Il: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for exterior buildinS modifications
and an exception [o the Sign Code, az described in this Resolu[ion; and
W-HEREAS, the Planning Commission finds the following with reeards to this application:
that the literal intent of the provisions of the Sign Code will result in restric[ions inconsistent wnh the spirit and intent of
the Code;
that the granting of the exception will not result in a condi[ion which is materially det[iy0ental to tht public health,
safety, or welfare;
• that the exception~to be granted is one that will require the least modification of the prescribed r~galations and the
minimum variance that will accomplish the purpose;
• that the exposed neon is not excessive and is in kcepine with the character of the restaurant; and
• that the proposed colors and architectural modifications are consis[ent with the cha~cter of the tesy1urant and will not
deter from the appearance of the building.
NOS'. THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, face, exhibits, testimom• and other evidence submitted to this trtatler, the building
modifications and the exposed neon lighting is hereby approved subject to the conditions which are enumera[ed in this
Resolution; and
That the subconclusions upon which the findings and conditions specified in this Resolution are; based ~,d Contained in the
Public Hearing record concerning Application 13-ASA-94 as set forth in the Minutes of tho PI~tnB Commission Meeting
of September 26, 1994, and are incorporated by reference herein.
