OF THE PLANNING COh1MISS10N OF THE CITY OF CUPERTINO APPROVING
ENTRANCE CANOPY AND A SIGN EXCEPTION TO AN EXISTING RESTAURANT
SECTION I• PROJECT DESCRIPTION
Aonlication 6-ASA-94 -San Jose AwninE .o.. Inc.: ASA review and approval of an entrance canopy and a sign exception to an
existing restaurant. The restaurant is located on the South side of Stevens Creek Boulevard, approximately 200 ft. West of Blaney
Avenue.
SECTION Il: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for modifications, az described in this
Resolution; and
WHEREAS, the applicant has demonstrated a compelling reason for granting the modifications and haz met the following fmdings
subject to the conditions contained herein:
.. That the literal enforcement of the provisions of this ordinance will result in restrictions inconsistent with the spirit and intent of
this ordinance;
D. That the granting of the exception will not result in a condition which is materially detrimental to the public health, safety, or
welfare; and
C. That the granting of exception will require the least modification of the prescribed regulations since "Hamazushi" levering is 16
in. high and meets the size requirements. The shape of the canopy lends itself to position the Japanese character above the
"Hamazushi" lettering.
D. That the architectural modifications are acceptable and will not be detrimental to the aesthetics of the area.
I. $jpn Approval:
The approved sign program for the restaurant is based on the project development plans dated April 26, 1994 (7 sheets), except as
may be amended by the conditions contained herein.
NOW, THEREFORE, BE IT RESOLVED:
That afier careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the request for a sign
exception is hereby approved; and
That the subconclusions upon which the findings specified in this Resolution are based and contained in the Public Hearing record
concerning Application 6-ASA-94 az set forth in the Minutes of the Planning Commission Meeting of May 23, 1994, and are
incorporated by reference herein.
PASSED AND ADOPTED this 23rd day of May, 1994 at a Regular Meeting of the Planning Commission of the City of Cupertino by
the following roll call vote:
