CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4528 4-ASA-94 OP THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING EXTERIOR ARCHITECTURAL MODIFICATIONS AND A SIGN EXCEPTION, TO AN EXISTING RESTAURANT SECTION I• ' PROJECT DESCRIPTION Aoolication 4•ASA-94 - B.C. Golden Gate: ASA review and approval of exterior architectural modifications and a sign exception to an existing restaurant. The restaurant is located on the Wesl side of De Anu Doulevard, approximately 600 R. North of McClellan Road. SECTION ll• FINDINGS ' WHEREAS, the Planning Commission of the City of Cupertino received an application far modifications, as described in this Resolution; and WHERL•AS, the applicant has demonstrated a compelling reason for granting the modifications and has met the following findings subject to the conditions contained herein: A. That the literal enforcement of the provisions of this ordinance will result in restrictions inconsistent with the spirit and intent of this ordinance; B. That the granting of the exception will not result in a condition which is materially detrimental to the public health, safety, or welfare; C. That the exception to be granted is one that will require the least modification of the prescribed regulations and the minimum variance that will accomplish the purpose; D. That a 36 inch high logo sign is important to the balance the architectural features of the building, the character of the restaurant and (or visibility from De Anza Blvd.; E. That an 18 inch high "Boston Chicken" sign is appropriate for the building due to its setback from De Anza Boulevard. E. That the architectural modifications arc acceptable and will not be detrimental to the aesthetics of the area. SECTION fll• CONDITIONS A. The approved sign program and architectural modifications for the restaurant are based on the elevation exhibit labeled A-7 and dated April 7, 1994, except as may be amended by the conditions enumerated herein. B. The approved signs shall consist of the following: • One "Doston Chicken" sign with 18 inch letters and a 36 inch logo sign on the east or south elevation; • One 36 inch high logo signs, one on the west elevation. NOW, THEREFORE, BE IT RESOLVED: ' That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the request for a sign exception is hereby approved; and That the subconclusions upon which the findings specified in this Resolution are based and contained in the Public Hearing record concerning Application 4-ASA-94 as set forth in the Minutes of the Planning Commission Meeting of May 23, 1994, and arc incorporated by reference herein. De Anna Blvd. required a minor modification to the approved building design application, 4-ASA-94. This minor modification has been approved by Bob Cowan, Director of Community Development with the condition that only 6 feet of the southerly side of the enclosure may be covered with a roof. Pursuant to Cupertino Municipal Code Chapter 19. 136, each City Councilmember and Planning Commissioner were notified of this decision and have 14 calendar days, until March ]0, 1995, to appeal this decision.
