This letter confirms the decision of the Planning Commission, given at the regulaz meeting of
August 29, 1995, approving patio enclosure according to the enclosed copy of Planning
Commission Resolution No, 4635.
Please note these conditions cazefully. Please contact our office if you have questions about
this matter. Please note these conditions carefully. Subsequent submittal of materials for
building permits or other entitlements will be checked for compliance with the conditions
listed in the Resolution; discrepancies may result in processing delays. Please contact our
office if you have questions about this matter.
Please be awaze that an appeal of this decision can be made within fourteen calendar days of
the decision. If this occurs, you will be notified of a public hearing which will be scheduled
before the City Council.

OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING CONSTRUCTION OF PATIO ENCLOSURE AT 8131 PARK VILLA CIRCLE
SECTION 1: PRO T D .S iPTION

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for
architectural and site approval for the construction of a patio enclosure in a planned development. as
described in this Resolution; and
WHEREAS, the Planning Commission finds that
1. The patio enclosure is architecturally compatible with the surrounding structures.

2.1t is not visible from any of the surrounding residences, except from the rooftops.
3. The material specification for the enclosure indicates that the space is limited to recreation
and outdoor living purposes only, and cannot be used as a habitable room.
4. The additional space does not have any impact on existing parking, since parking
requirements are based on number of bedrooms.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the construction of patio enclosure is here by approved; and
That the subconclusions upon which the findings and conditions specified in this Resolution arc based
and contained in the public hearing record concerning Application 4-ASA-95 as set forth in the
Minutes of Planning Cotmission Meeting of ?9th of August 1995 and are incorporated by reference
herein.

enclosure, except as may be amended by the conditions conutined herein.
2. B ~i~'!ding Permit: The cttrrent International Conference of Building Officials (ICBO) plans and
details of the patio enclosure and electric work shall be submitted to the Building Department I'or
issuance of a building permit within 21 days after obtaining Planning Commission approval.
