This letter confirms the decision of the Planning Commission, given at the meeting of
September 13, 1999, approving a request to extend tar one year architectural and site
approval to expand a restaurant by 310 sq. ft., according to the enclosed copy of Planning
Commission Resolution No. 5067.
Please be aware that an appeal of this decision can be made within l4 calendar days of
the decision. If this occurs, you will be notified of a public hearing which will be
sclteduled before the City Council.

OF THE PLANNING COMMISSION OF THE C[TY OP CUPERTINO
AI'f'ROVING A ONE-YEAR EXSTENTION OF ARCHITECTURAL AND SITE APPROVAL TO
ALLOW A 310 SQUARE FOOT WAITING ROOM ADDITION FOR AN EXISTING
RESTAURANT M A SHOPPING CENTER A'F THE SOUTIIEASI'
QUADRANT OF HOMESTEAD ROAD AND S'fELLING ROAD
S[CTION L• FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for
Architectural and Site Approval, as described in Section II. of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and -he Planning Commission has held one or more public
hearings on this matter, and
WIiEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
I) 'I~hc proposed use, at the proposed location, will not be detrimental or injurious to property ur
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
2) "1"he proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of this title.

Restaurant, 20956 #A-1, Homestead Rd., Cupertino, Calif." dated July 1997 and consisting of two
sheets, 1 and 2, except as may be amended by the Conditions contained in this Resolution.

All previous conditions from Planning Commission Resolution No. 4864 remain in effect unless
otherwise amended by the conditions contained within this resolution.
3. "TIME EXTENSION
The time extension approval shall expire one year from the approval date of September l3, 1999.
