• At their May 17 regulaz meeting, the City Council authorized aone-year deferment of the parking and
circulation driveway improvements required by an agreement between Symantec, the Cupertino City
Ccnter, and the City located on the eastern edge of Stevens Creek and De Anna Boulevards. Attached
is a copy of Resolution No. 99-143 speaking to this issue.

THE C1TY MANAGER TO EXECUTE AN AMENDMENT OF RESOLU'T'ION 9751, AN
r~GREEMENT BETWEEN SYMANTEC, CUPERTINO CITY CENTER DUILUINGS, ANU
THE CITY OF CUPERTINO. THE AMENDMENT PERTAINS TO THE DEFERMEN"f OI'
PARKING AND CIRCULATION DRIVEWAY IMPROVEMENTS FOR TI•IE "CORNGR
PARK" AT THE INTERSECTION OF DEANZA BOULEVARD AND STBVENS CREEK
BOULEVARD
WHEREAS, the City Council adopted resolution No. 9751, which is :u: agrccmcnt
between Symantec, Cupertino City Center Buildings, and the City of Cupertino I'or the
improvement of an existing private park located on the corner of Stevens Creek Boulevard and
DeAnza Boulevard and the installation of sidewalk and landscaping on the property easterly of
and adjacent to the said corner site; and
WHEREAS, deferments of the parking and circulation improvements were authorized by
Resolution No. 98-162 & 98-293.
WHEREAS, the Stevens Creek Boulevard sidewalk and landscaping I:as been installed
on the adjoining "hotel" property to the cast, and
WHEREAS, the owner of the "hotel site" property adjoining the comer park
improvements referenced in City Council Resolution 9751 arc still pursuing the construction of a
hotel, and
WHEREAS, it is in the public interest to continue to provide tlcxibility I'or tl:c dcsignol'
and construction of said potential hotel by deferring parking and circulation drive improvements
on the eastern edge of said corner park, and
WHEREAS, the terms, conditions and provision of this amended agrccmcnt have been
reviewed and approved by the City Manager and the Director of Community Development;
NOW, THEREFORE, BE lT RESOLVED that the City Council of tltc City of Cupertino
hereby approves a deferment of the circulation and parking improvements on the "tlte corner
park" in concept as described on Exhibit A and authorizes the City Manager to execute said
amended agreement on behalf of the City of Cupertino. The final agrccmcnt shall be approved as
to form and content by the City Attorney.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 17`h day of May, 1999, by tltc following vote:

Exhibit A of Resolution 99-143
The six-month deferment of the Perimeter Road/parking area referenced in paragraph I3 of
Exhibit A of City Council Resolution 9751 as amended is extended for a one year period ending
June l5, 2000. At the end of tltc term, this item will be re-evaluated by the City Council based
upon continued progress for the pursuit of a conditional use permit application for development
of the City Center "hotel site".
