SUBJECT: PLANNING COMMISSION ACTION LETTER - Application. 13-EXC-98,
19-ASA-98.
This letter conYirms the decision of the Planning Commission, given at the meeting of
October 26, 1998, approving a sign exception for anoff--site and for three signs on one
parcel in accordance with Chapter 17.08 of the Cupertino Municipal Code, and an
architectural and site approval to approve emergency access gate, limited access gates to
the apartments, and to modify building colors according to Planning Commission
Resolution Nos. 4974 and 4975.
Please note tftat the sign exception permit will expire 1 year from the date of approval and
the architectural site approval will expire 2 years from the date of approval.
Also, be aware that an appeal of these decisions can be made within 14 calendar days of
the decisions. If this occurs, you will be notified of a public hearing which will be
scheduled before the Ciry Council.

APPROVING AN ARCHITECTURAL AND SITE APPROVAL OF EMERGENCY ACCESS
GATES, LIMITED ACCESS GATES TO THE APARTMENTS AND MODIFICATION OF
BUILDING COLORS.

SECTION II: FINDINGS
WI-[EREAS, the Planning Commission of the City of Cupertino received an application for an
Architectural and Site Approval, as described in this Resolution; and
WHEREAS, the Planning Commission finds that the changes are beneficial and compatible with the
surrounding area.

The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
