This letter confirms the decision of the Design Review Committee, given at the meeting of
June 28,2000, giving architectural and site approval to change the siding on existing and new
apartment buildings at 10159 S. Blaney Avenue, accQrdingto Design Review Resolution No.6
Please be aware that if this permit is not used within one year, it shall expire on
June 28, 2001.
Also note that an appeal ofthis decision can be made within 14 calendar days of the decision. If
this occurs, you will be notified of a public hearing which will be scheduled before the City
Council.

APPROVING BUILDING AND ARCHITECTURAL MODIFICATIONS TO AN APPROVED
APARTMENT DEVELOPMENT

SECTION II: FINDINGS
WHEREAS, the Design Review Committee of the City of Cupertino received an application for an
Architectural and Site Approval,. as described in this Resolution; and
WHEREAS, the Design Review Committee finds that the changes are beneficial and compatible with
the surrounding area;
1. The proposal, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or CGnvenience;
2. The proposal is consistent with the purposes of the zoning ordinance, and the General Plan.
3. The proposal will use materials that are compatible with neighboring properties,
4. The change of building material is considered an upgrade.
S. The horizontal siding is attractive and enhances the design.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application no. 13-ASA-OO, is hereby approved; and
That the subcondusions upon which the findings and conditions specified in this Resolution are based
and contained in the public hearing record concerning Application 13-ASA-OO as set forth in the
Minutes of the Design Review Committee Meeting of June 28, 2000, and are incorporated by reference
herein.

SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNTTY DEVELOPMENT DEPT.
1. DESIGN CHANGES
All existing buildings and the 24 recently approved buildings are approved for horizontal siding.
The buildings and trims shall be painted according to the approved material board under Use
Permit Application No. 14~U-98. Additionally, the existing building decks may have their railings
match the decision of the 24 approved units.
2. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, qrrd a description of the dedications, reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Governnient Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
