(OAIC VALLEY} SECTION I: PROTECT DESCRIPTION Application No.: ASA-2001-18 Applicant: Gerry Ploof (The O'$rien Group) Location: 10481 Serra Street Oak Valley) SECTION IT: FINDINGS WHEREAS, the Design Review Committee of the City of Cupertino received an application for an Architectural and Site Approval, as described in this Resolution; and WHEREAS, the Design Review Committee finds that the changes are beneficial and compatible with the surrounding area; 1. T11e proposal, at the proposed. location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; 2. The proposal is consistent with the purposes of the zoning ordinance, and the General Plan, as new restaurant will occupy a building historically used as a restaurant in a corrunercial center. 3. Tl~e design will not result in abrupt changes in building scale between the subject site and neighboring properties, as the project does not propose significant exterior changes. 4. The proposal will use materials that compliment neighboring structures, as the proposal does not propose significant exterior changes. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application no. APPROVED EXHIBITS Approval is based on the plan set entitled "Oak Valley Estates, Lot 2-18, 10481 Serra Street" dated 4/8/02, consisting of 8 sheets labeled T-1, Al-1, Al-2, Al-10, Al-11, A1- 12, Al-13 and C 1.1, except as may be amended by the conditions contained in this resolution.. 2. PRIVACY SCREENING FOR SECOND STORY DECK Privacy screening for the second story deck, subject to staff approval,. shall be planted. prior to final occupancy. The property owner shall record a covenant on this property to inform future property owners of the privacy protection measures and tree protection requirements. The precise language will be subject ko approval by the Director of Community Development. Proof of recordation must be submitted to the Community Development Department prior to final. occupancy of the residence. 3. WINDOW SI°IUTTERS The window shutters shall be enlarged in size to appear to cover the window openings if closed. Revised plans shall be submitted to the Planning Department for review and approval prior to issuance of building permits. 4. GARAGE.
