This letter confirms the decision of the Design Review Committee, given at the meeting
of May 18, 2006; conditionally approving a sign exception to allow two signs to exceed
the maximum allowed sign height and for two additional wall signs and an
Architectural and Site denying an~ increase in the height of the canopy fascia from 25"
to 48" at an existing service station, located at 10625 N De Anza Blvd, according to
Resolution No. 236 & 237.
Please be aware that if this permit is not used within one year, it shall expire on
May 19, 2007.
Also, please note that an appeal of this decision can be made within 14 calendar days
from the date of this letter. If this happens, you will be notified of a public hearing,
which will be scheduled before the City Council.

OF THE DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO
DENYING AN ARCHITECTURAL AND SITE APPROV AL TO INCREASE THE HEIGHT
OF THE CANOPY FASCIA FROM 25" TO 48" AT AN EXISTING SERVICE STATION.

SECTION II: FINDINGS
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Design Review Committee has held one or more
public hearings on this matter; and
WHEREAS, the applicant has not met the burden of proof required to support said
application; and has not satisfied the following requirements:
1. Abrupt changes in building scale is avoided and a gradual transition related to height
and bulk is achieved;
2. In order to preserve design harmony between new and existing buildings and in order
to preserve and enhance property values, the proposal should harmonize with
adjacent development;
3. The proposed height and size of outdoor advertising signs and structures shall
harmonized with adjacent development.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the design review application is hereby denied.
That the subconclusions upon which the findings and conditions specified in this resolution
are based and contained in the public hearing record concerning Application ASA-2006-08
set forth in the Minutes of the Design Review Committee meeting of, May 18, 2006, and are
incorporated by reference as though fully set forth herein.
