A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO DENYING THE
PETITION OF JANE WU SEEKING COUNCIL RECONSIDERATION OF ITS APPROVAL
OF APPLICATION NO. U-2006-06, A USE PERMIT FOR THE CONSTRUCTION OF AN
OFFICE BUILDING AND PARKING GARAGE, TO BE LOCATED AT 10495 N. DE ANZA
BLVD. IN CUPERTINO, ASA-2006-06, TR-2006-09, AND EA-2006-09, A MITIGATED
NEGATIVE DECLARATION.
Whereas, Application No. U-2006-06, a use permit for the construction of an office building
and parking garage, to be located at 10495 N. De Anza Blvd. in Cupertino, ASA-2006-06, TR-
2006-09, and EA-2006-09, a mitigated negative declaration, was approved by the City Council
with conditions on August 15, 2006; and
Whereas, Jane Wu has requested that the City Council reconsider its decision under the
provisions of section 2.08.096 of the City's ordinance code; and
Whereas, the City Council has considered all relevant evidence presented by the parties
at all hearings, including evidence presented at the October .17,2006 reconsideration
hearing.
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
1. The petitioner's Reconsideration Petition is defective on its face in that it does not offer
proof of facts as required by Municipal Code section 2.08.096.
2. The petitioner has made no offer of new relevant evidence that, in the exercise of
reasonable diligence, could not have been produced at any earlier city hearing. (See Municipal
Code S 2.08.096B(1).)
3. The City Council did not exclude any evidence presented by the petitioners at any prior
city hearing. (See Municipal Code S 2.08.096B(2).)
4. The City Council has proceeded entirely within its jurisdiction regarding the application
for a use permit. (See Municipal Code S 2.08.096B(3).)
5. The petitioner has failed to present any evidence that the City Council failed to provide a
fair hearing. (See Municipal Code S 2.08.096B(4).)
6. The petitioner has failed to demonstrate that the City Council abused its discretion
regarding the application. (See Municipal Code S 2.08.096B(5).) Specifically, the City Council
determines that:
a. The City Council proceeded in a manner required by law.
b. The City Council's decision is supported by findings of fact.
c. The findings of fact related to the City Council's decision were supported by
substantial evidence in the record of proceedings.

7. The specific allegations contained in the petition for reconsideration are refuted by
specific City Council findings, which are attached to this resolution and incorporated herein.
8. The petitioner's Petition for Reconsideration of the City Council's determination of
August 15, 2006 is DENIED

CITY COUNCIL FINDINGS IN RESPONSE TO PETITION FOR RECONSIDERATION
Pursuant to Cupertino Municipal Code section 19.124.070 a conditional use permit may be
granted where the decision maker makes the following findings:
1) The proposed use, at the proposed location, will not be detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of this title.
In granting the use permit application U-2006-06 (Chang Architecture, former Any
Mountain building), the City Council finds: a. that the use was in accord with the Cupertino
General Plan Land Use Map; and, b. that the use of the subject property will not be detrimental
to the public health, safety, general welfare, or convenience.
Municipal Code section 2.08.096 states:
"A petition for reconsideration shall specify, in detail, each and every ground for
reconsideration. Failure of a petition to specify any particular ground or grounds for
consideration, precludes that particular omitted ground or grounds from being raised or litigated
in a subsequent judicial proceeding.
The grounds for reconsideration are limited to the following:
1. An offer of new relevant evidence which, in the exercise of reasonable diligence,
could not have been produced at any earlier city hearing.
2. An offer of relevant evidence which was improperly excluded at any prior city
hearing.
3. Proof of facts which demonstrate that the City Council proceeded without, or in
excess of its jurisdiction.
4. Proof of facts which demonstrate that the City Council failed to provide a fair hearing.
5. Proof of facts which demonstrate that the City the City Council abused its discretion
by:
a. Not proceeding in a manner required by law; and/or
b. Rendering a decision which was not supported by findings of fact; and/or
c. Rendering a decision in which the findings of fact were not supported by the
evidence. "
A petition for reconsideration of Application No. U-2006-06, a use permit for the construction of
an office building and parking garage, to be located at 10495 N. De Anza Blvd. in Cupertino,
ASA-2006-06, TR-2006-09, and EA-2006-09, a mitigated negative declaration, was submitted
by Jane Wu on August 25, 2006.

CONCLUSION
The petition for reconsideration did not comply with Municipal Code Section 2.08.096 in that the
petition did not meet the requirements by offering any of the following:
I. An offer of new relevant evidence which, in the exercise of reasonable diligence,
could not have been produced at any earlier city hearing.
2. An offer of relevant evidence which was improperly excluded at any prior city
hearing.
3. Proof of facts which demonstrate that the City Council proceeded without, or in
excess of its jurisdiction.
4. Proof of facts which demonstrate that the City Council failed to provide a fair hearing.
5. Proof of facts which demonstrate that the City the City Council abused its discretion
by:
a. Not proceeding in a manner required by law; and/or
b. Rendering a decision which was not supported by findings of fact; and/or
c. Rendering a decision in which the findings of fact were not supported by the
evidence. "
In addition the Council finds that with the conditions imposed by the Council:
I) The proposed use, at the proposed location, will not be detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of this title.
In reviewing the Petition filed by Jane Wu to Reconsider the Council's decision to grant the
applications as noted in detail above, the City Council.tinds that there is no relevant evidence or
proof of facts that support any of the grounds for reconsideration as required by Cupertino
Municipal Code Section 2.08.096 B. 1-5.

As of 8-25-06 noon we received a fax from Sand Hill Properties addressing our first
item of appeal. Their response is not satisfactory and although they assume that our
request is based on our acceptance of the consent to the Amendment to Declaration and
Grant of Reciprocal Parking Easement sent to us back in July 2006, this is not an accurate
assumption on Sand Hill's part. Weare not now in a position to sign. We still need to
negotiate changes for what has been presented today is not completely acceptable. Please
take this under advisement as you read our appeal. Thank you for your time and efforts

Dear Ms. Wu,
Weare in receipt of your letter dated August 21, 2006 regarding the above referenced
project. We have been working with our architect to address the concerns you have
raised relating to the garage, building, parking and traffic issues and we believe that we
can address the concerns referenced in your letter. We have assumed that your requested
changes are the basis for your delivering to us your consent to the Amendment to
Declaration and Grant of Reciprocal Parking Easements which we had sent you
previously but attach again herewith for your convenience. Although we take issue with
whether such consent is required for our project to proceed, our efforts to address your
concerns are in the spirit of compromise that would fully resolve the easement consent
issue. Based on that assumption, here are our responses to each of your requests:
Parking Garage:
I. We will be sending you a revised plan for the garage which we believe
addresses all of the concerns you brought up at the hearings. We will await
your response once you have seen the revised plan.
2. As you will see from the revised plan, we have made the garage as small as
possible while still meeting the Citys parking requirement.
3. We will have our landscape architect include landscape treatment to the side
of the garage facing your property.
4. There will be a minimum of 40 feet from your building wall to oW' garage
wall.
5. There will be access to the garage from your property.
6. We will set the garage back from Mariani Avenue so as to leave the view
from half of your windows facing our parcel clear of the garage.
Building Issues:
1. If we need to relocate the phone tenninal, we will work with our contractor as
well as the service provider to minimize any downtime to your phone service.
Relocation will be at our expense.

2. Ifwe need to relocate tbe sanitary sewer lines, we will work with our
contractor as well as the City to minimize any downtime to your service.
Relocation will be at our expense.
3. We will install a monument sign, subject to City approval, at the garage
entrance for your business.
4. Instead of wood fencing, we will install chain link fencing with fabric which,
in our experience, is sufficient in blocking dust and noise from the
construction and is the typical fencing used in construction projects.
5. We will address your concerns regarding dust and construction noise with our
contractor.
Parking and Traffic Issues:
1. You will have access to the garage as per the parking easement.
2. We will stripe and paint a patient walkway as requested between your
building entrance and the garage.
3. We will look into how to relocate the ramp, subject to meeting Building Code
and ADA requirements.
4. We will make reasonable efforts to prevent construction traffic through your
property during construction.
Compensation:
We believe that the above responses address your concerns regarding the design and
construction of our project. There will be significant expense required to comply with
your requested changes. While we are willing to bear that expense, we are not able to
also provide you with additional compensation.
We look forward to hearing from you when you have had a chance to review our revised

Approved a Use Permit and Architectural and Site Review with the following conditions and
direction for the Design Review Committee:
· Traffic mitigation is capped at $25,000 subject to the satisfaction of the
director of public works;
· Delete condition No. 14 from the Use Permit and ASA, pertaining to
consent of adjacent property owner prior to issuance of building permits;

· Levy lump sum sales-tax-in-lieu fee of $181 ,61 0 and cap it at this amount
to address general plan policy No. 2-42. Condition subject to any future
implementation of policy 2-42 that may allow for rebate or partial rebate of
the fee if office tenants are revenue generating, for example;
· Design of garage is subject to review by the Design Review Committee
with Council direction to lessen the visual impact of the structure on the
adjacent office building (Mariani Business Center). This may include:
o Using a smaller footprint parking garage, such as the one approved
by the planning commission;
o Setting back the garage as far as possible from the rear property line
nearest the Mariani Business Center;
o Landscaping around the parking structure to soften the view of the
structure from the Mariani Business Center;
o Flipping the garage, so the les$ massive ramp is closer to the
Mariani Business Center; and
o Lower garage height by depressing garage Y; level below grade
Use Permit Conditions are as follows:
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT
DEPT.
1. APPROVED EXHIBITS
The recommendation of approval is based on a plan set titled: " Any Mountain Office
Building" consisting of 13 sheets labeled: C, AI, A2, A2.l, A2.2, A3, A4, CI through C-
5 and CL1, except as may be amended by the Conditions contained in this Resolution.
2. DEVELOPMENT APPROVAL
Approval is granted to construct a 60,000 square foot office building with a 3-level
parking structure with one level below grade.
3. PARKING GARAGE
The approved garage site plan and floor plans are based on Exhibit A, subject to design
reVIew.
4. REVENUE ANALYSIS OF OFFICE DEVELOPMENTS
The City Council shall determine compliance with the General Plan Policy 2-42, Revenue
Analysis of the Office Development, which requires new office developments greater than
50,000 square feet to provide revenue benefits to the City.

5. BICYCLE PARKING
The applicant shall provide bicycle parking and bike racks for the proposed project in
accordance with the City's Parking Regulations under Chapter 19.100 of the Cupertino
Municipal Code.
6. DEMOLITION REQUIREMENTS
All demolished building and site materials shall be recycled to the maximum extent
feasible subject to the Building Official approval. The applicant shall provide evidence
that materials will be recycled prior to issuance of final demolition permits.
7. DEVELOPMENT ALLOCATION
The applicant shall receive an allocation of 33,000 square feet of the office industrial
allocations for the North De Anza Boulevard Planning Area.
8. LANDSCAPE PLAN
The applicant shall submit a detailed landscape and irrigation plans to be reviewed and
approved by the Director of Community Development prior to issuance of building
pennits. The landscape plan shall include:
a) water conservation and pesticide reduction measures in confonnance with Chapter
14.15, Xeriscape Landscaping, and the pesticide control measures referenced in
Chapter 9.18, Stormwater Pollution Prevention and Watershed Protection, of the
Cupertino Municipal Code.
b) Four 48" box Arbutus Marina trees in lieu ofthe 24" box trees proposed.
c) Landscaping where feasible to soften the appearance of the westerly side of the
parking structure.
9. NOTICE OF FEES. DEDICATIONS. RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice ofa statement ofthe
amount of such fees, and a description of the dedications, reservations, and other
exactions. You are hereby further notified that the 90-day approval period in which you
may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020( a), has begun. If you fail to file a protest within this 90-
day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
10. PUBLIC ART
The applicant shall install public art onsite prior to final occupancy. The public art shall
be valued at a minimum of one-quarter percent (1/4%) of the total project budget, not to
exceed $100,000. The applicant shall submit a public art plan to be reviewed by the Fine
Arts Commission prior to installation of the public art.

11. SCREENING
All mechanical and other equipment on the building or on the site shall be screened so
they are not visible from public street areas or adjoining developments. Screening
materials/colors shall match building features and materials. The height of the screening
shall be taller than the height of the mechanical equipment that it is designed to screen.
The location of equipment and necessary screening shall be reviewed and approved by the
Director of Community Development prior to issuance of building permits. No parking or
storage of materials shall be allowed under the protected trees.
12. TREE PROTECTION
Prior to the issuance of grading and demolition permits, the applicant shall enter into a
contract with an ISA-certified arb ori st to review and comment on all construction
drawings and monitor grading, demolition and building construction to ensure that the
recommendations described in an arborist report titled: "Tree Assessment and
Recommendations for the Redevelopment Project Proposed at 10495 North De Anza,
Cupertino, California, " prepared by Walter Levison and dated 5/12/06. Applicant shall
provide a copy of the contract to the Director of Community Development. No parking or
storage of materials shall be allowed under the protected trees.
The tree protection measures shall be inspected and approved by the certified arborist with
a confirmation letter sent to the Director of Community Development prior to issuance of
grading and demolition permits. The supervising arborist shall monitor construction
activities and prepare a final report ascertaining the health of the protected trees prior to
issuance of final occupancy.
13. TREE PROTECTION BOND
The applicant shall provide a tree protection bond in the amount of $100,000 to ensure
protection of the trees slated for preservation prior to issuance of grading, demolition or
building permits. The bond shall be returned after completion of construction, subject to a
letter from the City arborist indicating that the trees are in good condition.
14. APPROVAL OF PARKING LOT RECONFIGURATION (Council deleted this
condition)
SECTION IV: CONDITIONS ADMINISTERED BY THE PUBLIC WORKS DEPARTMENT
15. STREET WIDENING
Street widening and dedications shall be provided in accordance with City Standards and
specifications and as required by the City Engineer.
16. CURB AND GUTTER IMPROVEMENTS
Curbs and gutters, sidewalks and related structures shall be installed in accordance with
grades and standards as specified by the City Engineer.

17. STREET LIGHTING INSTALLATION
Street lighting shall be installed and shall be as approved by the City Engineer. Lighting
fixtures shall be positioned so as to preclude glare and other forms of visual interference to
adjoining properties, and shall be no higher than the maximum height permitted by the zone
in which the site is located.
18. FIRE HYDRANT
Fire hydrants shall be located as required by the City and Santa Clara County Fire as needed.
19. GRADING
Grading shall be as approved and required by the City Engineer in accordance with Chapter
16.08 of the Cupertino Municipal Code. 401 Certifications and 404 permits maybe required.
Please contact Army Corp of Engineers and/or Regional Water Quality Control Board as
appropriate.
20. DRAINAGE
Drainage shall be provided to the satisfaction of the City Engineer.
21. FIRE PROTECTION
Fire sprinklers shall be installed in any new construction to the approval of the City as
needed.
22. UNDERGROUND UTILITIES
The developer shall comply with the requirements of the Underground Utilities Ordinance
No. 331 and other related Ordinances and regulations of the City of Cupertino, and shall
coordinate with affected utility providers for installation of underground utility devices. The
developer shall submit detailed plans showing utility underground provisions. Said plans
shall be subject to prior approval of the affected Utility provider and the City Engineer.
23. IMPROVEMENT AGREEMENT
The project developer shall enter into a development agreement with the City of Cupertino
providing for payment of fees, including but not limited to checking and inspection fees,
storm drain fees, park dedication fees and fees for under grounding of utilities. Said
agreement shall be executed prior to issuance of construction permits.

Based on the latest effective PG&E rate schedule approved by the PUC
Bonds:
a. Faithful Performance Bond: 100% of Off-site and On-site Improvements
b. Labor & Material Bond: 100% of Off-site and On-site Improvement
c. On-site Grading Bond: 100% of site improvements.
-The fees described above are imposed based upon the current fee schedule adopted by the
City Council. However, the fees imposed herein may be modified at the time of
recordation of a final map or issuance of a building permit in the event of said change or
changes, the fees changed at that time will reflect the then current fee schedule.
24. TRANSFORMERS
Electrical transformers, telephone vaults and similar above ground equipment enclosures
shall be screened with fencing and landscaping or located underground such that said

27. TRAFFIC CONTROL PLAN
The developer must submit a traffic control plan by a Registered Traffic Engineer to be
approved by the City. The plan shall include a temporary traffic control plan for work in the
right of way as well as a routing plan for all vehicles used during construction. All traffic
control signs must be reviewed and approved by the City prior to commencement of work.
The City has adopted Manual on Uniform Traffic Control Devices (MUTCD) standards for
all signage and striping work throughout the City.
28. REFUSE TRUCK ACCESS
The developer must obtain clearance from the Environmental Programs Department in

be valued at a minimum of one-quarter percent (1/4%) of the total project budget, not to

building permits. The bond shall be returned after completion of construction, subject to a

25. BEST MANAGEMENT PRACTICES
Utilize Best Management Practices (BMP' s), as required by the State Water
Resources Control Board, for construction activity, which disturbs soil. BMP plans
shall be included in your grading and street improvement plans. Erosion and or
sediment control plan shall be provided.
26. STORMW ATER QUALITY GUIDELINES FOR DEVELOPMENT PROTECTS
For a project creating or replacing one (1) acre or more of impervious surface, the
applicant must fulfill the City's storm water quality requirements, which includes
but is not limited to a Storm Water Management Plan/Notice of Intent (NOI),
BMP operation and maintenance responsibilities and BMP inspection and
reporting.
27. TRAFFIC CONTROL PLAN
The developer must submit a traffic control plan by a Registered Traffic Engineer to
be approved by the City. The plan shall include a temporary traffic control plan for
work in the right of way as well as a routing plan for all vehicles used during
construction. All traffic control signs must be reviewed and approved by the City
prior to commencement of work.
The City has adopted Manual on Uniform Traffic Control Devices (MUTCD)
standards for all signage and striping work throughout the City.
28. REFUSE TRUCK ACCESS
The developer must obtain clearance from the Environmental Programs
Department in regards to refuse truck access for the proposed development.

General Notes
1. "Green or Sustainable Landscape':
a. Landscape walls to be constructed of recycled aggregate with 'Trex'
veneer to match the building,
b. Majority of the De Anza entry paving will be impervious to allow rain water
to percalate bock Into the groundwater table.
c. Landscape heoderboard between paving and planting to be 'Trex' recycled
plastic and wood fiber or approved equal.
d. Reuse of the numerous existing landscape boulders on site.
e. All plants and planting areas ore to be amended and mulched with recycled
wood from BFI Organics (yard trimmings and wood waste) or approved equal,
f. 90" of the selected plants are classified os 'low water usage' by the State of
CoIifornkt, Department of Water Resources (WUCOlS).
g. All tr08$ and shrube wIN be watered by a low volume or drip Irrigation system.
2. Provide a minimum 3" layer of rec)'Cled wood mulch within existing tree driplines.
The area 5' from each tree trunk is not to be pion ted, watered, nor is any
trenching allowed,
