You met with me a couple of weeks ago to get some feedback on several
scenarios for changes at St. Jude's church. Here is my informal, preliminary
feedback.
Fire access: One of your options is to fill in a parking area by the "farm house"
with a patio, and you asked whether the fire department would have a problem
with that. I talked with Wes Van Osdol from the Santa Clara County Fire
Department, which serves Cupertino. He said his department would respond at
the time a more detailed, scaled proposal is submitted. The generalized plans I
showed him are not accurate enough.
Parking spaces: The number of parking spaces you will be required to have
depends on your activities. Your existing approvals (3-U-94 and 5 -ASA -96) are
based on a matrix that laid our your activities. If you change your site plan and
number of spaces, we'd have to redo the matrix and see what your parking
demand is, based on your activities. I count 83 on your approved site plan. Your
notes say you have 86.
Handicap spaces: I believe your various plans are also too conceptual for the
building department to tell me where your handicap spaces need to be.
New parking area along Stelling, west of church: we talked about the sensitivity
of locating parking near the residential area. Therefore, it shouldn't be located
too close to that south property line. I believe you said there would be
landscaping between the parking lot and Stelling, and we would be looking for
that.
New access and parking along east property line. We probably would not
support another curb cut, so access would need to be from the existing entrances
to that parking area. We might want a 5' planting strip/swale between that
parking area and the property line. My notes say that you believe there is a
PG&E easement in that area, so you would need to see if paving/ parking is
allowed in that easement.
In general, when new hard surfaces are added, the run-off needs to be contained
on site, which is why landscaping swales are needed in or adjacent to parking
areas.
You mentioned that future parking might occur on an unimproved parking area.
However, future parking would require some sort of surface, perhaps pavers.

Perhaps my comments are of limited help to you, since your plans are very
conceptual, so I suggest you create an accurate site plan with your best guess as
to what you want to do, and we'll provide more detailed feedback. We'll also be
able to determine what level of planning review is required for your changes.

St. Jude's Site Vision 2007
Zoning:
St. Jude's is zoned BQ (Quasi -Public Buildings) which allows church uses subject to granting of a
use permit. St. Jude's currently has a use permit for the existing buildings and activities. Any
expansion of building areas or activities such as the Live Oak senior day care, classrooms etc.
may trigger the need for modification of the current use permit. Sid has worked with City Planner
Ciddy Wordell in the past. The planning department can assist the Church to determine if a use
permit is modification is required.
Plan visioning by example:
The concepts under consideration by the visioning committee have been installed by many other
churches, schools or in city parks. I suggest that the committee members collect a photo library
of examples they are familiar with to help with the visioning exercise. Pictures are also helpful
when it comes to implementing the vision or getting professional bids for work that may need to
be done such as electrical or plumbing.
It is helpful to draw up an opportunities and constraints diagram prior to discussing the possible
site plan options. Such a diagram will illustrate sun angles, sensitive areas for noise such as the
adjoining residential and noise impacts from passing traffic on the site.
Site Plan:
The orchard is a value asset based on the comments. Orchard trees could be carried throughout
the campus and/or at least through the parking areas. Strategic plantings of orchard trees could
give the impression the church was built in an orchard. The former Nut Tree parking lot in
Fairfield is an example of how effective this can look when the trees mature. The orchard
planting around the Saratoga Library
The youth play areas appear to
be located away from the streets,
which is a good thing in terms of
runaway balls etc. I would also
keep the play areas away from
the homes to the south to avoid
noise related complaints.
Parking expansion is expensive
and semi-permanent so it should
be considered carefully. If the
parking demand is limited to
special events then you may want
to consider allowing limited
parking in grassy areas or open
field areas during these events
and avoid the cost of a permanent
installation.
Perimeter fencing is covered by
the fence ordinance, Chapter
16.28 of the Municipal Code.
Please check with a planner prior
to finalizing your plans to ensure
consistency with the ordinance. We can process any of the minor site changes such as fencing
and landscaping as a "director's minor amendment" to the existing use permit. The application
fees are less and the time for processing much faster.
Curb Appeal:
The existing landscaping appears dry and understated. Curb appeal can be significantly
improved with enhanced perimeter landscaping, lighting to better announce the presence of the
church and better signage. St. Jude's may want to engage the services of a landscape architect
to help identify options to enhance the curb appeal and watering or pruning standards that will
enhance existing landscaping. Also, simple measures like repainting the buildings, wall murals,
and low voltage lighting to highlight trees or buildings can contribute to a memorable street
exposure.
Meditation Walkway:
All of the above features can be used to enhance the experience of a meditation walkway. The
Vision Committee may want to consider fountain features to muffle street noise to enhance the
meditation experience. Also, low voltage lighting can be used to accent the walkway at night.

Staff recommends that the Design Review Committee approve the Architectural and
Site Approval, file no. ASA -2008-08, for landscaping, parking improvements and
accessory structures at an existing church per the model resolution.
BACKGROUND:
The applicant, Tom Dyer, representing St. Jude's Episcopal Church, is proposing the
phased construction of a comprehensive program of site improvements that will change
the parking lot configuration and landscaping of an existing church and add a couple of
accessory structures. The property is located on the southeast quadrant of McClellan
and Stelling Roads and is surrounded by single-family dwellings to the north across
McClellan Road, another church to the east, single-family residences to the south, and
an office building and a townhouse community to the west across Stelling Road.

Construction phasing is proposed because of limited funds to implement the project.
The phasing plan will be presented at the hearing.
The improvements include:
• The addition of a roofed trash enclosure and 576 square feet of addition storage
cladded with materials to match the adjacent building;
• The removal of a central parking lot and its replacement with landscaping, paver
walkways, arbor and other pedestrian amenities;
• The development of a new parking lot to replace removed parking and increase
the number of stalls. As much of the new and existing parking will be striped to
the unisize standard. The new stalls will be constructed with "Grasscrete" which
allows the percolation of storm water onsite.
• Additional landscape renovation and pathways that create pedestrian linkages
from the public sidewalk to the church.
• Permeable pavers installed in the park strip between the curb and the sidewalk.
DISCUSSION:
About ten trees will be removed with this plan: two 6" diameter coastal redwoods; one
24" Monterey Pine; one 10-12" Apricot, and six 8-10" diameter Walnut trees. The trees
were not part of an approved landscape plan, so a separate tree removal permit is not
needed.
There is a missing section of fencing in the front setback between the church and the
abutting single-family residence. A 3 -foot tall wooden fence should be constructed
behind the pittosporum hedge. This was added as a condition of approval.
The applicant has been working with the Public Works Department to address some on-
going traffic/ circulation issues associated with church activities and needed repair
work to the abutting sidewalk. Those conditions of approval are also added to the
approval resolution.

held one or more public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said
application; and has satisfied the following requirements:

APPROVED EXHIBITS
Approval is based on the plan set submitted by Aitken Associates titled: "St. Jude
Apostle Episcopal Church/ 20920 McClellan Road, Cupertino, CA" dated 6/3/08
and consisting of three pages labeled L1 (sheet 1 of 3), L2 (sheet 1 of 2) and L2
(sheet 2 of 2), except as may be amended by conditions in this resolution.
2. FENCING
The applicant shall construct a 3 -foot tall wooden fence at the southerly property
line between the sidewalk and existing 6 -foot tall fence.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant
to Government Code Section 66020(d) (1), these Conditions constitute written
notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that
the 90 -day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90 -day period complying with all
of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
SECTION IV: CONDITIONS ADMINISTERED BY THE PUBLIC WORKS
DEPARTMENT
4. TRAFFIC SIGNAL MODIFICATIONS
Prior to building permit approval, traffic signal modifications will be required to the
traffic light at Stelling and McClellan Roads, including one new detector loop, 6 new
countdown pedestrian heads, new backplates, installing two new signal heads (and
the necessary wiring), removing two existing signal heads, and repainting all heads
and visors to the satisfaction of the City Engineer.
5. SIDEWALK REPAIR
Prior to building permit approval, replace 100 feet of sidewalk along McClellan
Road that has cracks and breaks. Replace Cable TV box Cover (along Stelling Road,
near the intersection of Stelling Road and McClellan Road) to the satisfaction of the
City Engineer.
6. TRAFFIC MEDIAN EXTENSION
Prior to building permit approval, extend center traffic median along South Stelling
Road past the existing driveway to the satisfaction of the City Engineer.

Applicant: Tom Dyer (St. Jude's Episcopal Church)
Location: 20920 McClellan Rd.
Architectural and Site approval for landscaping, parking improvements and
accessory structures at an existing church.
Design Review Committee decision final unless appealed.
Staff member Jung explained that the applicant is requesting to do some site improvements at
the church in phases. The project will be phased because the church will be fundraising in order
to raise the money to do the renovations. The applicant plans to construct a covered garbage
storage area, two small accessory structures, remove an old orchard on one side to construct a
new parking area and renovate an orchard on the other side. They plan to demolish the existing
parking area and install landscaping. The new parking area will use pavers instead of asphalt to
ensure drainage. The renovation project will provide connectivity from the sidewalks, parking
areas and throughout the rest of the property. In the approval resolution, Staff has included a

requirement to replace a missing section of fence along the property line abutting a single-
family residence. The Public Works department has also included some conditions of approval
in the resolution. Commissioner Rose wanted to make sure that if the project was phased, the
applicants would not have to come back in for a new approval when they got ready do each
part of the project. Staff member Jung explained that the approval today would not expire as
long as they started the project within two years. The building permit that the applicant needs
to obtain do expire, but the applicant wouldn t be getting them until they were ready to do the
actual construction. Chairperson Giefer asked about planting something other than Crepe
Myrtles along the street and suggested that the applicant post a notice on the site informing the
public of their intent to renovate the remaining orchard during the construction of the new
parking area to mitigate concerns that might arise when people see the apricot trees coming
down. Jennifer Stern, leader of the development of this plan for St Jude's Church, explained to
the committee that the church's plan is to beautify the campus to draw people to a place of
meditation in a "spiritual oasis'. She stated that the church has funding to do all of the
renovation projects except for the central courtyard. The orchard renovation will be a volunteer
project to be done by the congregation. Chairperson Giefer asked if the applicant planned to
add square footage to the Senior day care. The applicant explained that they were adding
storage space for the Boy Scouts. The applicant expressed concerns with two of the Public
Works conditions; the condition to pay for traffic signal maintenance and the requirement to
repair the sidewalks. They agreed with the requirement'to repair the sidewalks, but the cost of
the traffic signal modifications was prohibitive. The applicant suggested that they would rather
extend the median on Stelling Road so people are not able to make a left turn into their
driveway. They would rather have a designated left turn lane further down to direct people into
the new driveway as part of the second phase of the project. The discussion continued
concerning the legality of having the church bear the burden of improving the traffic signal at
that intersection when the proposed project will not be generating additional trips.
Commissioner Rose moved to approve the application with the following modification to the
Resolution: Remove Condition #4, Section VI,; in it's entirety
Add verbage to Condition #6, Section VI;
"The Public Works Department shall evaluate the suggestion of having the applicant, upon
completion of phase two, to include a designated left turn pocket on Stelling Road to direct
traffic into the new parking lot."
MOTION: Commissioner Rose moved to approve ASA -2008-08 with the above mentioned
changes to the model resolution
