Staff recommends approval of ASA -2008-02 & EXC-2008-09, based on the model

BACKGROUND:
The project site is located at the northwest corner of Cupertino Square Shopping Center
east of the Macy's parking garage, south of highway 280 and along the west side of
Wolfe Road (see diagram to the
right, project site in green).
The applicant Ray Newcomer,
representing TGI Friday's, is
requesting approval to enhance and
modernize the exterior of the
existing restaurant. In addition, the
applicant is proposing to replace the
existing three wall signs and ground
sign with four new wall signs and
one ground sign exceeding the Sign
Ordinance requirements in sign
number and height.

Exterior Enhancements
Proposed exterior enhancements are summarized as follows:
• New exterior building colors and lighting.
• New elongated red and white striped awnings.
• New aluminum storefront doors and windows on the entry tower.
• New entry tower feature (approximate 25 ft.) with gold travertine finish.

The entire building will be crowned with brushed metal cornice replacing the
existing painted wood cornice.
Staff supports the proposed exterior changes and believes that they will significantly
enhance the existing restaurant building.
Sign Exceptions
Number of Signs
According to the Sign Ordinance Section 17.24.050, each business with exterior frontage
shall be permitted one wall sign. A second wall sign may only be permitted under
either one of the following circumstances:
1. Business adjacent to more than one street and with no ground sign; or
2. The second sign is directed to the interior of the project and not visible from a
public right-of-way.
The existing restaurant currently has three wall signs and a ground sign. Based on the
Ordinance, only one wall sign and one ground sign are permitted. The applicant is
proposing to replace the existing wall signs with two new wall signs on the new entry
tower along the south elevation (along Perimeter Road), one wall sign along the west
elevation (facing Macy's parking garage) and one wall sign along the north elevation
(facing the T.G.I. Friday's parking lot). In addition, the project proposes to replace the
existing ground sign along Wolfe Road. Staff supports the sign exception request to
permit the proposed wall signs based on the following reasons:
• The intent of the Sign Ordinance is to provide effective and visible signs. Given
the speed of traffic on Wolfe Road (vehicles exiting the freeway and coming
down from the highway bridge) and the amount of mature trees around the
project site, additional signage is warranted to allow visible and effective signs.
The proposed restaurant site is
located along the widest section of
Wolfe Road (with a median in the
middle). It is difficult for vehicles
on Wolfe Road to see the
proposed signs on the new tower
entry feature. Therefore the
secondary sign along the north
elevation is necessary.

The existing restaurant building is approximately 70 feet set back from Wolfe Road
although most of the proposed wall signs are set back more than 100 feet from the face -
of -curb along Wolfe Road. The proposed wall sign along the north elevation (facing
Highway 280 off -ramp) is approximately 77 inches in height, which exceeds the
ordinance requirement by 29 inches. Staff supports the proposed sign height exception
for the following reasons:
Given the location of the wall sign and existing trees, the proposed 77 inch tall
wall sign is intended to be only partially visible to the south -bound traffic on
Wolfe Road. In addition, the
sign is located underneath the
existing roof eave of the
restaurant and within an arcade
area so the proposed sign height
is appropriate in order to
achieve maximum effectiveness.

Findings for Exception
Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant
an exception based upon the following findings:
A. Literal Enforcement of the Sign Regulations will result in restrictions inconsistent with the
spirit and intent of this title.
The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony
of signs as they relate to building design" and to "provide [sign regulations] that
will allow for good visibility for the public and the needs of the business ....". The
proposed exceptions are necessary to provide effective and visible signs given the
project's location along Wolfe Road and surrounding mature trees. In addition,
T.G.I Friday's is located in the core business district of the City, staff feels that
flexibility in sign design is appropriate for this area to promote business identity and
the proposed signs are complimentary to the building architecture and design.
B. The granting of the exception will not result in a condition, which is materially detrimental
to the public health, safety, or welfare.
The signs do not create any health or safety problems.
C. Least modification of the prescribed regulations and the minimum variance that will
accomplish the purpose.
With the exception of the number and sign height, the proposed signs are consistent
with all aspects of the sign ordinance.
Other Recommendations
Staff recommends that the following measures be considered by Design Review
Committee to further enhance and activate the restaurant's interface with the public
right-of-way:
1. The existing outdoor patio area along the south of the building shall be enlarged
to wrap around to the east side along Wolfe Road to the maximum extent
possible.
2. Provide transparent windows whenever appropriate along Wolfe Road and
Perimeter Road elevations in order to help externalize the restaurant use and
enhance the visibility to the restaurant as viewed from the public right-of-way.
If the Design Review Committee finds merit in the above suggestions then it should
require the revised plans reflecting the patio and window revisions be reviewed and
approved by the Planning Department prior to issuance of building permits.

The gold travertine provides versatility and adaptability for
an existing application. Its natural, warm and smooth finish
enhances our contemporary look and compliments our
existing buildings with stucco and brick finishes. The
travertine is used in a 18 -inch x 18 -inch size in a running
bond pattern.
BRUSHED METAL CORNICE
The tower is crowned with a brushed metal cornice. The
brushed metal offers a crisp profile and reflective sheen
that contrasts and compliments the gold travertine. The
brushed metal cornice is 2 feet tall and features a classic
profile shape.
ALUMINUM STOREFRONT AND "F" DOOR PULLS
Aluminum storefront door and window system compliment
the overall tower design by keeping with the theme of
adding silver metal accents. The storefront system offers a
clean look and provides an open view into the restaurant.
Two brushed "F" door pulls accent the entry doors and add
to the overall visual appearance of the tower.
SWIRL SCONCE
The entry is accented with a red and white swirl sconce in
the shape of the tumbler. The sconce adds a splash of red
white color with a silver metal accent surround trim. At
night, the swirl sconces gleam with a brilliant glow of light,
which adds to the overall visual experience of the tower.

stop sign on the building. Providing a contrasting and
contemporary background for the stop sign provides a
strong visual focal point that reinforces the brand's trade

background provide a rich and contrasting back drop for the
red white striped and brushed metal stop sign. It also
serves to break up the repetitive series of red white stripe

STOP SIGN
The stop sign is a vacuum formed painted acrylic face that
is backlit with fluorescent lighting and a brushed metal
cabinet. The sign face is dimensional with extruded red
and white stripes and extruded large bold typeface. The red
stripes are a rich, dark hue and the brushed metal cabinet
provides a border around the sign, reinforcing the
contemporary silver metal finish. The size may vary
depending on the wall but often a 45 s.f. stop sign that is 8
foot wide by 5.5 foot in height can be a sufficient and
prominent size.

the entry tower. The gold travertine is used as a border,
creating a natural landscape shaped frame. The travertine
is an 18 inch x 18 inch size and installed in a running bond

The center portion and majority of the feature wall color is
composed absolute black granite. The absolute black
granite is rich, dark black with a high gloss finish. The black
granite is an 18 inch x 18 inch size and installed in a
stacked bond pattern. The overall size and presence of a
high gloss black surface allows the red white striped stop
sign to stand out.
BUILDING COLORS
The primary building color is a warm natural beige, which
acts as neutral color and allows the bold colors of the red
white stripe awnings and gold travertine to contrast and
resonate their presence. The beige color is a Sherwin
Williams paint called Croissant. An accenting brown color
is also used for vertical pilasters and horizontal building
banding and trim. The brown color is Sherwin Williams

Architectural and Site approval for a new exterior entrance and minor exterior changes
and a Sign Exception request to allow signs to exceed the number and maximum height
limitations for an existing restaurant (T.G.I Friday's) located at the Cupertino Square
Shopping Center.
Design Review Committee decision final unless appealed.
Staff member Pettis explained that the restaurant is planning several exterior enhancements as part of the
Architecture and Site approval application including repainting, updating the awnings and adding a tower
element for signage. There are several existing signs around the restaurant that will be replaced, removed
and repaired and updated. Staff supports the Sign Exception request due the increased speed of the cars
exiting the freeway onto Wolfe Road and extensive landscaping surrounding the site contributing to the
overall reduced visibility of the restaurant. Staff is requesting that the applicant wrap around the patio
dining area around the Wolfe Road side of the restaurant to provide additional visibility and help activate
pedestrian traffic along the walkway. Commission Rose asked for clarification on the placement of the
signs. The applicant, Ray Newcomer, stated that the signs and colors are part of the corporate logo brand
design. They do not have a problem with the patio enhancement as long as the increased capacity won't
necessitate a redesign of the bathrooms per the Building Code. Chairperson Giefer complimented the
applicant for using energy efficient bulbs for the signs and asked about using low emission paints.
Commissioner Rose asked if the interior of the restaurant will be remodeled. The applicant said that the
entire store will be renovated and updated. Chairperson Giefer agreed that he additional signage would be
beneficial and was not concerned that the signs are higher in height that the Sign Ordinance allows. She
would like the applicant to use low emission paint. Commission Rose concurred with Chairperson Giefer.
She felt that the redesign would be good for the mall and was excited to see it when its finished.
MOTION: Chairperson Giefer moved to approve ASA -2008-02 and EXC-2008-09 with the
condition that the applicant use low emission paint if available in their corporate
standard colors
