"BYRNE AVENUE 88-OJ", PR:)PER!'Y LOCATED CN THE EAST SIDE OF BYRNE
AVENUE BEIWEEN AIMADEN AVENUE AND SAN FERNANDO AVENUE;
APProXIMATELY 0.21 ACRE, B.?\BB
WHEREAS, the City Council of the city of CUpertino has received a
request for annexation of territory designated "Byrne Avenue 88-OJ" from
property owners, Kenneth and BaJ:Dara Babb; and
WHEREAS, the property, 0.21± acre on the east side of Byrne Avenue
between A1lnaden Avenue and San Fernan10 Avenue (Am 357-l5-24) is
contiguous to the city of CUpertino and is within its urban service area;
and
WHEREAS, annexation would provide for use of city services; and
WHEREAS, this territory is mrlnhabited and was prezoned on June 4,
1984 to City of CUpertino Rl-7.5 zone; and
WHEREAS, the City of CUpertino, as lead 1Iqency for enviromental
review oc:mpleted an initial study and granted a Negative Declaration for
annexation; and
WHEREAS, the County SUrveyor of Santa Clara County has found the map
and description (Exhibits "A" and "B") to be in accordance with Government
Code Section 56826, the bouOOaries to be definite and certain, and the
proposal to be in oc:mpliance with IAFOO's road annexation policies; and
WHEREAS, the fee set by the County of Santa Clara to Cl:Ner staff costs
for above certification has been paid; and
WHEREAS, as provided in GoverrmIent Code section 56826 the City Council
of the City of CUpertino shall be con:iucting authority for a
reorganization including an annexation to the City; and
WHEREAS, Government Code section 56837 provides that if a petition for
annexation is signed by all owners of land within the affected territory
the City Council may approve or disapprove the annexation without public
hearing ;

NCM, ~UI(t;, BE IT RFSOLVED, that the City Council of the City of
CUpertino hereby initiates annexation proceedin;¡s and will consider
annexation of the territœ:y designated "Byrne Avenue 88-03" at their
regular meeting of JUly 5, 1988.
PASSED AND AOOPI'ED at a regular meeting of the city Council of the
City of CUpertino this 6th day of June , 1988, by the following vote:

State of California, more particularly described as follows:
Beginning at the southwest corner of Lot 104 as shown on the Map of
Subdivision "A", Menta Vista, recorded in Book P of Maps, page 20;
said point being along the boundary of the certain annexation to the
City of Cupertino entitled "San Fernando Ave. 84-1";
Thence NORTH; 90.82 feet along said annexation to a point on the
north~rly boundary of said Lot 104;
Thence along said northerly boundary EAST, 100.15 feet; said course
being along that annexation to the· CIty of Cupertino entitled
"Almaden 84-3", to a point on the easterly boundary of said Lot 104;
Thence SOUTH, 90.82 feet along said easterly boundary;
Thence WEST, 100.15 feet to the Point of Beginning.
Containing: 9.096 square feet more or less or 0.21 acres more or less.
