CC Resolution No. 7516 RESOLUTION NO. 7516 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO APPROVING 1988 AMENDMENT TO THE SANTA CLARA COUNTY SOLID WASTE MANAGEMENT PLAN TO COMBINE THE NORTH AND CENTRAL SUBREGIONS, RENAME THE SOUTHWEST SUBREGION AND PROVIDE CONTINUED ACCESS TO GUADALUPE MINES LANDFILL AND PROVIDE FOR ANNUAL REPORTING REGARDING WASTE REDUCTION TO ACHIEVE 25% GOAL BY 1995 WHEREAS, the City Council has preYiously concurred in the principles and objectiyes of the Solid Waste Management Plan for Santa Clara County; and WHEREAS, the Santa Clara County Intergoyernmental Council has requested that this city consider amending the Plan to include the proYisions of this Amendment in the Solid Waste Management Plan for Santa Clara County; and WHEREAS, the Board of SuperYisors of the County of Santa Clara has here- tofore adopted a Negatiye Declaration under the California Enyironmental Quality Act (CEQA) in connection with said proposed ReYision; and approyed the amendment; NOW, THEREFORE, the City of Cupertino hereby finds and determines as follows: 1. The City of Cupertino as a responsible agency considered the enyironmental effects of the proposed Amendment as shown in the Negatiye Declaration. 2. The Amendement to combine the North and Central Subregions, rename the Southwest Subregion and proYide continued access to Guadalupe Mines Landfill, and proYide for annual reporting regarding waste reduction to achieye 25% goal by 1995, an amendment to the Solid Waste Management Plan for Santa Clara County attached hereto and made a part hereof, is approyed. 3. Concurrence in the principles and objectiyes of said Plan is reaffirmed. 4. The City Clerk is directed to forward a certified copy of the Resolution to the IGC Solid Waste Committee for Santa Clara County, c/o Paula Stoner, Solid Waste Planning Program Analyst, County Goyernment, 70 West Hedding Street, 7th Floor, East Wing, San Jose, CA 95110. Wolfe Deputy City Clerk /s/ John M. Gatto Mayor, City of Cupertino Resolution No. 7516 The Santa Clara County Solid Waste Management Plan is amended to add the following: 1. The Northwest Area Subregion and the Central Area Subregion are combined to create the North/Central Subregion. 2. The Southwestern Subregion is renamed the "West Valley Subregion." The existing Guadalupe Mines Landfill is to remain the West Valley Subregion and continued access to the Guadalupe Mines Landfill will be assured to comply with existing disposal contracts and current practices regarding industrial/commercial disposal and public drop- off. * 3. To decrease the flow of wastes filling yaluable landfill space and to assist in meeting the requirements of Section 66780.5 of the California Goyernment Code (as amended by AB 1462 of 1987), each city in the County shall submit annual reports to the Intergoyernmental Council outlining programs and plans to reduce the amount of wastes disposed of in landfills by 25% calculated between January 1, 1978 and January 1, 1995.** The Intergoyernmental Council shall report annually on the amount of wastes recycled and the leyel of budgetary commitment made to pursue recycling by each city in the county. 4. In all other respects, the suhregional policy shall remain as described in the current Plan. *The operator of the Guadalupe Mines Landfill has filed applications (PDC-87-l2-l00) with the City of San Jose for prezoning and annexation of the site to San Jose. Nothing herein is intended to depriye current users of the Guadalupe Mines Landfill of continued use of the site. **Acceptable methods for calculating the 25% reduction must be agreed to by the IGC.
