AMENDING RESOWl'ION NOS. 6901, 5214 AND 7255

The City Council of the City of CUpertino resolves that Resolution
Nos. 6901, 5214 am 7255 are éIIIIen3ed as follows:
section 8. Retainer: The City Attorney shall receive a mnthly retainer
frcm the city in the sum of $4,171.00 which shall be considered full
c:cmpensation for the purposes of contributions am withholdin;Js with
respect to retirement, social security, inoane tax withholdin;Js, am the
like. The mnthly retainer shall be paid at the eIXl of each mnth on the
payroll account of the City. Furt:hern¥:lre, the city shall contribute to
PERS retirement am health benefits in the same aoount it does for regular
City E!l!ployees. Furt:hern¥:lre, any rebate of PERS retirement contributions
shall be at the same rate as Classified Management E!l!ployees of the city
of CUpertino.
Section 9. Jldditional Comœnsation: In addition, the City Attorney shall
receive the followin;J contractual services c:cmpensation.
(a) Administrative.
'lb the extent that the collective time of the City Attomey and other
members of the law firm of the city Attorney, for the performance of
administrative services, ~.. thirty (30) hours in any one mnth
excludin;¡' the time spent at am preparation for regular am special City
Council meetin;Js am Planning CœmIission meetin;Js, the City Attorney shall
be entitled to receive additional canpensation frcm the city at the rate
of $90.00 per hour.
(b) Litication.
The City Attorney shall receive as a canpensation for the performance
of litigation services, am for the litigation services of the Deputy City
Attorney am other attorneys of the law firm of the City Attomey,
c:cmpensation at the rate of $90.00 per hour.
Section 11. OVerhead: Except as herein otherwise expressly provided, the
City Attorney shall pay for his own overl1ead, am that of the Deputy city
Attorney am other members of the law firm of the Attomey incurred at the
office located at 852 North Fir!;t street, 'Ihi.rd Floor, San Jose,

secretarial, bookJœepin;J, reception, postage, stationeJ:Y, office supplies,
insurance, library, copyin;J, taxes am licenses. F\Jrt:heJ:nDre, telephone
calls in which there is no substantive conversation betweem the city
Attorney or a member of his firm am a City Council 'l"'""'M'[" = city staff
shall be considered part of the overl1ead costs. Nevertheless, the city
shall supply the city Attorney with "City of CUpertino" letterl1ead
stationeJ:Y am envelopes am shall also pay for all costs incurred in
connection with maintainin;J the special IIIL1I'1icipal law library books owned
by the city which are on loan to the City Attorney.
Effective date of the above chan;Jes shall be the same date as for
other employees.
