RESOLVED, BY THE CITY aJUNCIL OF THE CITY OF aJPERl'INO, CALIFORNIA,
that
WHEREAS, this City Council has passed ordil1ance No. 1458 entitled "An
Ordi.nanc:e of the city Council of the City of CUpertino Orderin:.J the
Sul:unission of a Proposition of Incurrin:.J Bonded DeÞt for the Purpose of
the Acquisition, ConstJ:uction and CoI\¡:)letion of Park, Recreational and
Open Space I.an:i ani Inprovements to the Qualified vaters of the City of
CUpertino at an Election to De Held for the Purpose, II orderin:.J the
submission of a proposition to the qualified voters of the city of
CUpertino (the "Ordinance");
WHEREAS, this City Council desires that the specialIIIUIÙcipal election
provided for in the ordil1ance De consolidated with the statewide general
election to occur on November 8, 1988" ani that said proposition De
included on the ballot for said statewide general election which ballot is
prepared Þy the santa Clara County Clerk; ani
WHEREAS, section 5011, section 5013 ani section 5014.5 of the
Elections Code of the state of California authorize the filin:.J of an
iIrpartial analysis of written arguments for or against any ballot
proposition, ani of rebuttals;
NOW, 'I'HEREFdl<Ii:, IT IS ORDERED as follOltlS:
1. '!he Board of SUpervisors of the County of Santa Clara is hereÞy
requested to permit the Santa Clara County Clerk to provide such services
as may De necessazy to properly ani lawfully hold ani COIXiuct a special
IllUlÙcipal election in the City on November 8, 1988, pursuant to the
Ordinance, includin;J but not restricted to the providin:.J ani printin:.J of
ballots and pollin:.J place cards, election SUWlies, votin:.J Þcoths, flags,
registration lists ani any other materials ani services required to
lawfully COIXiuct the election.
2. For its signature this Council hereÞy directs the City Manager
and his staff to prepare ani file a written argument, ani a rebuttal, if
required, for the þ:topusition to De submitted at said specialIIIUIÙcipal
election. Said written argument for the proposition shall not exceed 300
words in length ani said rebuttal shall not exceed 250 1NOrds in length,
ani the argument ani rebuttal shall otherwise confODII to ani oatply with
all awlicable provisions of the Elections Code of the state of
California. '!he deadline date for the submittal of arguments, in favor or
in opposition, shall De August 12, 1988.
3. '!he provisions of California Elections Code Section 5014.5 -
Rebuttal Arguments are hereby adopted.
4. '!he City Clerk is hereby directed to submit to the City Attorney
a certified copy of the Ordinance. '!he City Attorney is hereby authorized
ani directed to prepare an inpartial analysis of the proposition specified
in the Ordinance shOItI'in:J the effect of the measure on the existin:.J law and
the operation of the measure, said analysis to De submitted Þy the City
Attomey to the Registrar of Voters or other appropriate officer of the
County of santa Clara for printin:.J Defore the arguments for ani against
the measure. '!he analysis shall not exceed 500 words in lEID3th ani shall
otherwise c:at1ply in all respects with the applicable provisions of the
Elections Code of the State of California. '!he deadline date for the
submittal of the analysis shall De August 16, 1988.
5. '!he city Clerk is hereby directed to file with the Board of
SUpervisors of the County of santa Clara a certified copy of this
Resolution ani of the Ordinance on or Defore August 12, 1988.
6. 'Ibis Resolution shall De effective upon its adoption,
