A RESOIlJTION OF '!HE CITY CXXJNCIL OF '!HE CITY OF aJt'~·J.!'lO

"STELLING OOAD 88-05", PROPERI'Y IDCATED ON THE WEST SIDE
OF STELLING OOAD BEIWEEN OROGRANDE PIACE AND CARRIAGE CIRClE,
APPROXIMATEVl 0.979 ACRE, TANEX) AND KIYOYE HIRANO

WHEREAS, the City Ccuncil of the City of CUpertino has received a
request for annexation of territory designated "Stelling Road 88-05" from
property owners, Taneo and Kiyoye Hirano; and
WHEREAS, the property, approximately 0.979 acre on the west side of
Stelling Road between Orograrxle Place and Carriage Circle (Am 359-6-58)
is contiguous to the City of CUpertino and is within its urban service
area; and
WHEREAS, annexation would prOIIide for use of city services; and
WHEREAS, this territory is uninhabited and was prezoned on September
15, 1980; and
WHEREAS, the city of CUpertino, as Lead kJency for environmental
review canpleted an initial study and granted a Negative Declaration for
annexation; and
WHEREAS, the County SUrveyor of Santa Clara County has foun:l the l1'a.p
and description (Exhibits "A" and "B") to be in accordance with Government
Code section 56826, the bourrlaries to be definite and certain, and the
proposal to be in compliance with IAFCX:>'s road annexation policies; and
WHEREAS, the fee set by the County of Santa Clara to COlIer staff costs
for abo<1e certification has been paid; and
WHEREAS, as prOIIided in GoveunuenJt Code section 56826 the city Council
of the city of CUpertino shall be conducting authority for a
reorganization including an annexation to the City; and
WHEREAS, Government Code section 56837 provides that if a petition for
annexation is signed by all owners of land within the affected territory
the City Ccuncil l1'a.y approve or disapprove the annexation without public
hearing ;

NOO, THEREFORE, BE IT RESOLVED, that the city Council of the city of
CUpertino hereby initiates annexation p100eedings and will consider
annexation of the territory designated "stelling Road 88-05" at their
regular meeting of october 31, 1988.
PASSED AND AOOPI'ED at an adjourned regular meeting of the City Council
of the City of CUpertino this '9th day of Septemher, 1988, by the

All that certain real property situated in the County of Santa Clara, State of
California, more particularly described as follows:
Beginning at the Northeast corner of that certain parcel of land as shown upon
the Record of Survey, which Map was recorded in Book 131 of Maps, at page 24,
Santa Clara County Records, said point of beginning being 20 feet westerly of
the Centerline of Stelling Road, as shown upon said Map; said orner being
common to the boundaries of Cupertino City limits as established by the
July 1, 1979 San Jose - Cupertino Municipal Reorganization, and that certain
annexation "Stelling Rd. 'D' 80-45".
Thence from said Point of Beginning along a line common to said annexation
"Stelling Rd. 'D' 80-45" and the easterly line of said parcel of land
S.0.002'50" W. 177.87 feet;
Thence S. 59°27'04" W. 15.73 feet along the Southeasterly line of said Parcel
of land;
Thence along a tangent curve to the left having a radius of 232.50 feet with
a central angle of 12°05'58" for an arc length 49.10 feet to a point of
reverse curvature, said curve being along the Southeasterly line of said
Parcel of land;
Thence along the tangent to the right with a radius of 25.00 feet, a central
angle of 85°34'43" for an arc length of 37.34 feet;
Thence N. 47°04'11" W. 315.71 feet along the Southwesterly line of said
parcel of land;
Thence along a line common to said San Jose-Cupertino Municipal Reorganization
and the Northerly line of said parcel S. 89°59'38" E. 318.16 feet to the
Point of Beginning.
Containing 0.979 acres more or less
