WHEREAS, the City Council of the City of Olpertino has received a
request for annexation of territory designated "Alcazar Avenue 88-08" from
property owners, Craig A. Clark an:i O1ee-Wan Lee; an:i
WHEREAS, the property, 0.21± acre on the south side of Alcazar Avenue
between Orange Avenue an:i Byrne Avenue (Am 357-14-38) is contiguous to
the City of Olpertino an:i is within its w:ban service area; an:i
WHEREAS, annexation would provide for use of City services; an:i
WHEREAS, this territory is uninhabited an:i was prezoned on JUne 4,
1984 to City of Olpertino Rl-7.5 zone; an:i
WHEREAS, the City of Olpertino, as Lead 1Igercy for enviromnental
review campleted an initial study an:i granted a Negative Declaration for
annexation; an:i
WHEREAS, the Colmty SUrveyor of Santa Clara Colmty has found the map
an:i description (Exhibits "A" an:i "B") to be in accoràance with Government
Code Section 56826, the boumaries to be definite an:i certain, an:i the
proposal to be in campliance with IAFCX>'s road annexation policies; an:i
WHEREAS, the fee set by the Colmty of Santa Clara to Cl:Ner staff costs
for above certification has been paid; an:i
WHEREAS, as provided in Government Code section 56826 the City Council
of the City of Olpertino shall be c:oniucting authority for a
reorganization including an annexation to the City; an:i
WHEREAS, Government Code section 56837 provides that if a petition for
annexation is signed by all owners of lan:i within the affected territory
the City Council may approve or disapprove the annexation without public
hearirç ;

All that certain real property situate in the County of Santa Clara,
State of California. more particularly described as follows:
All of Lot 131, as shown on that certain map entitled, "Map of
Subdivision "A", Monta Vista", which map was filed for record in
the Office of the Recorder of the County of Santa Clara, State of
California, on April 11, 1917 in Book "P" of Maps, at Page 20, more
particularly described as follows:
Beginning at the southeast corner of said Lot 131, said corner being
on the boundary of that certain annexation to the City of Cupertino
by Resolution No. 5601 entitled "Alcazar Avenue 80-49", said corner
also being on the westerly sideline of Orange Avenue;
Thence from said Point of Beginning North 90.82 feet along said
westerly sideline of Orange Avenue, also along the boundary of said
annexation;
Thence West 100.15 feet along the southerly sideline of Alcazar Avenue,
also along the boundary of said annexation;
Thence South 90.82 feet along the boundary of said annexation;
Thence East 100.15 feet to the Point of Beginning.
