WHEREAS, the city Council of the City of Olpertino has received a
request for annexation of territo¡:y designated "HerJoosa Avenue 88-09" from

WHEREAS, the property, approximately 0.27 acre on the north side of
Hermosa Avenue between Byrne Avenue an:i Oran;Je Avenue (APN 357-l6-042) is
contiguous to the city of Olpertino an:i is within its UJ:ban savice area;

WHEREAS, annexation 1NCUld provide for use of City savices; an:i
WHEREAS, this territo¡:y is =inhabited an:i was prezoned on June 4,
1984; an:i
WHEREAS, the City of Olpertino, as lead Agency for enviromnenta1
review campleted an initial study an:i granted a Negative Declaration for
annexation; an:i
WHEREAS, the County SUrveyor of Santa Clara County has found the map
an:i description (Exhibits "A" an:i "B") to be in accordance with Government
Code section 56826, the boun:Jaries to be definite an:i certain, an:i the
proposal to be in campliance with JAF(X)'s road annexation policies; an:i
WHEREAS, the fee set by the County of Santa Clara to caver staff costs
for above certification has been paid; an:i
WHEREAS, as provided in Government Code section 56826 the City Council
of the city of QJpertino shall be C01'rluctirç authority for a
reorganization including an annexation to the city; an:i
WHEREAS, Government Code section 56837 provides that if a petition for
annexation is signed by all owners of lan:i within the affected territo¡:y
the city Council may approve or disapprove the annexation without public
hearirç;

Olpertino hereby initiates annexation proceej~ an:i will consider
annexation of the territory designated "Herm:Jsa Avenue 88-09" at their
regular meetirç of January 17, 1989.

All that certain real property situate in the County of Santa Clara, State
of California, more particularly described as follows:
Being a portion of lot 53 and a portion of Hermosa Ave. as shown on that
certain map entitled, "Map of Subdivision "A" Monta Vista", recorded in
Volume P of Maps, Page 20, Santa Clara County Recorders, more particularly
described as follows:
Beginning at the Southwest corner of that certain parcel of land annexed to
the City of Cupertino entitled, "Hermosa Ave. 71-15"; said corner also being
the northeast corner of Lot 67 of said map;
Thence West 50.08 feet to the Northwest corner of said lot 67; said corner
also being on the southerly line of Hermosa Avenue;
Thence North 238.42 feet;
Thence East 50.08 feet to the northeast corner of said lot 53; said corner
also being the northwest corner of said annexation "Hermosa 71-15":
Thence South 238.42 feet to the Point of Beginning.
Containing: 0.27 acres, more or less.
