WHEREAS, the City Council of the city of CUpertino has received a
request for annexation of territory designated "Byrne Avenue 88-11" iran
property owner, Evelyn Serrano; an:l
WHEREAS, the property, appraxbnately 0.63 acre on the east side of
Byrne Avenue between Alcazar Avenue an:l Dolores Avenue (APN 357-14-030) is
contiguous to the City of CUpertino an:l is within its UJ:ban service area;

WHEREAS, annexation watld provide for use of City services; an:l
WHEREAS, this territory is uninhabited an:l was prezoned on JUne 4,
1984; an:l
WHEREAS, the city of CUpertino, as Lead Agency for enviromnenta1
review COIIpleted an initial sbJdy an:l granted a Negative Declaration for
annexation; an:l
WHEREAS, the County SUJ:veyor of Santa Clara County has founi the map
an:l description (Exhibits "A" an:l "B") to be in accordance with Government
Code Section 56826, the bc:JurDaries to be definite an:l certain, an:l the
proposal to be in cx:arpliance with IAF'CX)'s road annexation policies; an:l
WHEREAS, the fee set by the County of Santa Clara to cover staff costs
for above certification has been paid; an:l
WHEREAS, as provided in Government Code Section 56826 the city Council
of the City of CUpertino shall be con:iucting authority for a
reorganization incll.1din;J an annexation to the City; an:l
WHEREAS, Government Code Section 56837 provides that if a petition for
annexation is signed by all owners of lan:l within the affected territory
the City Council mayawrove or disapprove the annexation without public
hearing ;

regular meetirxJ of February 21, 1989.
